Well, you're kinda right. Yes, it's a two-parter as per the comma however a militia does not mean the people. here is the definition of Militia. However, the comma is very important as that comma is what gives the citizens the right to "Keep and bear arms." Militia: 1. a military force that is raised from the civil population to supplement a regular army in an emergency. "creating a militia was no answer to the army's manpower problem" 1a. a military force that engages in rebel or terrorist activities in opposition to a regular army. 1b. all able-bodied civilians eligible by law for military service.

The 2nd Amendment, if any one pays attention, mentions the militia, however, twice, it CLEARLY states the average citizens right to bear arms WILL NOT be infringed. So, YES, ALL American citizens have the right to own guns. Period

The point of mentioning a militia was because the government they instituted for their brand new country was designed with purpose, but it was experimental. They anticipated that some person or faction might try to turn their position into a dictatorship. Militia was their imagined way for people to protect themselves from the potential of tyranny. They didn’t mention protection of self, property, or family. They didn’t mention hunting. The land was vast, and in many places one could travel days without seeing humans. Of course guns made sense when there was no protection by any sort of law enforcement near. Of course guns made sense for hunting. A gun was handy if you found a rattlesnake had slithered into your home. Nobody envisioned supermarkets. Guns were as common as house keys are now, and just as important. These days, hunting is less frequent, and law enforcement is more readily available, but guns are just as important today, even though they are in use by a smaller percentage of the population than back then. Militia is not for the purpose of protecting the government. It is for the protection of the Constitution, and the citizens from an unjust, tyrannical government. Look at the oath sworn by every elected official, and military member. “I state your name promise to protect and defend the Constitution of the United States…” Not Congress, nor president. They have secret service for them. It is the Constitution which must be protected no matter what the cost. Because, men can be turned to evil things, but the Constitution is the shield to protect the citizens.

One of the things that I heard long ago, was that every able bodied person age 17-45 in New York state was automatically part of the militia. Google searches cite a few different articles on legislation confirming this. Basically the governor can draft New Yorkers at any time to serve. I don't know if other states have similar laws, and I can only imagine the hub-bub if Cuomo or Hokul actually tried to use that law.

I believe, that something akin to the 2nd Amendment, is ABSOLUTELY NECESSARY! I also believe that the 2nd Amendment, is not AT ALL well written! Here's what it actually says; "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." What part of the recent school shooting incidents (and way too many other shooting incidents) has/had anything to do with... "A well regulated Militia." ??? This amendment, needs to be written better, so that it more accurately defines the historical need, and establishes the minimum structure that... "A well regulated Militia" would be REQUIRED to fulfill... to qualify as such. Because, if WE aren't actually in... "A well regulated Militia..." (in my opinion) There is no justification (or right)... conveyed in the words above... for ANY CITIZEN, to own or bear firearms of any kind, more-less a semiautomatic assault rifle. Further, the clause... "being necessary to the security of a free State," is stated as a FACT, which has not in anyway been established or demonstrated as anything other than a presumed ideal... anywhere in the Constitution or it's later amendments... IT WAS/IS HOWEVER... alluded to in the Declaration of Independence, IN SEVERAL PLACES, not the least of which being these words... "Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. Ok, so, "Duke Wayne" is John Wayne aka "The Duke", Clint Westwood is actually Clint Eastwood, Gary Cooper was a very manly actor who starred in the movie "Sgt. York". Gary cooper played Sgt Alvin C. York. Which was a very decorated soldier during WW2. He was a bad person by that i mean a drunk and lazy and no help to his widowed mother. That is till he got saved and did a 180. You should watch the movie Sgt York. And the state of Tennessee gave him a home and 40 acres for what he done during the war. He was my 5th cousin. He has passed and was a very humble man right up to his death.

Hey Van! Just subscribed!! The second amendment DOES guarantee the right of the people to bear arms. The people writing it had lived through and led a revolution against the government. The Founding Fathers meant for the average citizen to be armed and able to rise up if necessary to resist tyranny. Just as they had done.

One of the real joys of this show was how Lionel interacted with Archie. While Mike and Gloria directly challenged him, resulting in shouting matches that got nowhere, Lionel disagreed, one-upped, and insulted Archie without him ever even knowing it. In fact, Lionel often let Archie believe they were in agreement even though he’d just wiped the floor with him. Genius. When Lionel showed up at the door, things were about to go to another level intellectually.

More likely, for the country to defend off invasions. Remember, at the time a full-time standing army did not exist, nor did the government keep a cache of firearms to hand out to its citizens. The only way to defend from an outside invasion would have been for the government to quickly organize a militia of citizens, whereby the citizens bring their own firearms into battle. Essentially, the 2nd Amendment is a cost-cutting measure: No need for the government to buy, store and maintain large quantities of firearms, and no need to employ thousands of professional soldiers during peace time. Obviously, the conditions have changed quite a bit since those days.

The “militia “ is citizens who are ready to fight. So all citizens are a militia to protect our Constitutional freedoms. Every dictator ( Stalin, Mao, Che, Hitler) all confiscated guns or created a “national registry “ so that they knew who had guns and when chose to would go take their guns. I have a great grandmother who escaped Communism. Right now, Australia is suffering terribly and have no way of self defense. They agreed to the buy back program years ago and now, they are basically prisoners now. I have close Aussie friends there , and it’s bad. Much love!

Second amendment, the ‘well regulated militia’ was just one example of many reasons a person has the right to a firearm. The other writings of the founding fathers were clear that a man’s right to self defense is undeniable. The British were putting troops in peoples houses and taking their guns which left them totally defenseless to their tyranny.

This was a great show. I wish you would of seen a longer version of this episode where Archie writes in a rebuttal and gets to go on TV to give his views on why we need guns and gives an example that he could prevent sky jackings by handing out pistols to all the passengers before the flight and collect back them afterwards. Lol. Please react to the episode of Cousin Maude's visit. It introduces Bea Arthur (Golden Girls) and she really gave it back to Archie. That episode launched another spinoff "Maude" which also became successful.

I just started watching your videos and I like your opinions on these things. As a Jewish person I would say that I have looked into the gun issues in this country and it's very common in the Jewish community to have a gun. It's not for the purpose of a militia, it's generally because of the sordid history with Jewish people being attacked by governments. I'll have to think about this. WE are the militia in the context of the constitution. It was the PEOPLE who rose up to defend their country and claim independence from King George. People argue the "Well regulated militia" line all the time, they gleefully ignore the next 1,000 times the founding fathers have spoken about gun ownership after the declaration, clearly stating that we all have the right to bare arms, NOT granted by the constitution, NOT granted by the government, but a GOD GIVEN RIGHT to defend ourselves with said firearms.

To understand the 2nd Amendment, is to understand what a militia is, in the first place. A militia is made up of private citizens, apart from the miltary. And you cannot build a militia if the private citizens are not allowed to keep and bear arms. Some people try to use the words "well regulated," to justify gun control. But the meaning behind those words, is to state that the militia, itself, must be well regulated...not gun ownership. Militias must be well regulated... they must be organized, trained and must fight by the rules of war...using the same guidelines as the actual miltary. Fun fact; The organized miltary, of the day, did not have enough weaponry to compete against the British forces. They actually had to borrow cannons from private citizens. So even private citizens, at the time of the ratification of the 2nd Amendment, actually owned "weapons of war."

The rest of this episode is even funnier. Archie decides to demand equal time from the tv station that presented the editorial, so he goes on tv and does his own editorial on why gun control is a bad thing. In his editorial, he says the way to stop hijackers on jet planes is for the airline to arm all the passengers when they board the plane! His idea is the stewardess will give each passenger a loaded gun on the way onto the plane and then take back all the guns when they leave the plane. That way, the hijacker will be too scared to hijack the plane. Brilliant plan Archie!

The militia is the people, not a military. Hunting and target shooting is how we train and keep our skills. Militias in the period in which the Bill of Rights was passed, as well throughout the entire history of the American colonies, militias were composed of individual citizens in a given community who owned guns - farmers, blacksmiths, tradesmen, etc. In 18th century America, militias could not have existed without individual gun rights. The two concepts were inextricably tied together.

I was a little too young for All In The Family. I remember my parents watching it, but I usually went off to play with toys. I did watch a lot of the Jefferson's so I'm enjoying this series because I get to see where George was "born". I'm also amazed at the things they were able to say on TV then that we can't now....which is funny because profanity couldn't be used back then, but can now....but we mustn't offend people.

This was an oft debated issue at that time, that the right to bear arms was limited by service in the militia (modernly the National Guard). D.C. v Heller 2008 was the most recent Supreme Court ruling on this matter, holding that the portion regarding the militia does not limit or expand the operative right to bear arms. It was a 5-4 decision and left open the state's ability to regulate the types and manner of bearing the arms.

I saw that interview as well having watched the series back in the 70's, I was taken back as to how soft spoken Carol O'Connor (Archie) was in real life and how elegant and so incredibly well spoken Jean Stapleton (Edith) was. Both possessed the opposite personalities in comparison to the character's roles that they portrayed which only emphasizes the incredible talent these 2 Iconic actors displayed ...RIP Jean Stapleton & Carol O'Connor with thanks for the laughter you gave us all those years!.. This episode demonstrates how conservatives interpret the Constitution versus how liberals/Democrats do. "The Right of the people to keep and bear arms" means just what it says and militias have always been made up of the average citizen, not military personnel, so the militia is non-military! Something else Democrats fail to understand is the Bill of Rights 1-10 outlines the people's inalienable rights (natural rights) which weren't given by government and is not dependent upon the existence of the Constitution. The Bill of Rights also restricts the power and authority of government.

U.S. Supreme Court (1939): In the absence of any evidence tending to show that possession or use of a “shotgun having a barrel of less than eighteen inches in length” at this time has some reasonable relationship to the preservation or efficiency of a well regulated militia, we cannot say that the Second Amendment guarantees the right to keep and bear such an instrument. Certainly it is not within judicial notice that this weapon is any part of the ordinary military equipment or that its use could contribute to the common defense.

Therefore, whether you conceive of militia as an organized group, or a group of citizens that voluntarily make sure their guns work properly, does not translate into the Federal Governments regulation of firearms. The right should not be infringed, not the actual manufacture of guns. Guns are plenty regulated.

The best interpretation of the 2A was done by a show called Bullshit by penn and teller. The right of the people Separate of the Militia shall not be infringed. The right of the “people” not militia shall not be not be infringed. The “people” just fought a war against a militia to win their freedom from England. The term, well-regulated that was used in the framing of the 2nd amendment in the 18th century meant well organized, well-maintained, well-established. It doesn't mean limited, or overly-controlled or curtailed. Even today, regulators on anything are used for peak performance, efficiency, and overall strength.

Best thing I ever did was go online and read the entire declaration, constitution and bill of rights for myself. I highly recommend that everyone do this regardless of political beliefs

A military is a Army. A milita is a citizen soldier. An army of one or more. When you said the Pledge of Allegiance (“I pledge allegiance to my Flag and the Republic, for which it stands,-one nation, indivisible-with liberty and justice for all.”) you became a milita of one out of many.

Many of our founding fathers went forward to expand on what they meant in the 2nd amendment. The "militia" IS the people at large... the population. "Well regulated" did NOT mean regulated by the GOVERNMENT. It meant the people were to be ready and able, amongst themselves, to form up if and when necessary. With weapons in good repair. Glad to provide numerous quotes by the authors if you would like.

Actually Sgt. York is a very interesting story. He was anti-violence because of his religion and wanted to be exempt from the draft in WWI. His petition was denied and he was sent to France, where he became the most highly decorated hero of the war because he wanted to save lives. There's an excellent movie called Sgt. York starring Gary Cooper. Highly recommend watching it.

This guy cracks me up 😂😂 he actually wasn't at all prejudice in real life, he was a kind man,. With a heart of gold , his adopted son was African American I believe his son passed away I'm not exactly sure how , but tv most definitely changed , in a most positive way this was how show's were back then it was harmless back then ,but like you said today it would be thrown off, but it goes to show us back then people would crack jokes laugh 😂 now it's a hole different ball game . 😊

Hello, Carroll O'Connor son name was Hugh O'Connor and yes he was adopted he's white not African american and he did pass by suicide, Hugh O'Connor also played on the show In The Heat of the Night , I believe he played a cop, both were good actors.😢😢❤❤ RIP to both

The son-in-law is played by Rob Reiner, who went on to be a highly successful writer/director/producer. His IRL dad is Carl Reiner, who was also a super successful writer/director/producer. Just some trivia to throw in. :-) you may want to look up Rob Reiner's movies sometime. You've probably seen some of them, but if you haven't, you'll probably enjoy them. ;-)

Duke Wayne is the nickname for John Wayne the actor. He starred in westerns as did Clint Eastwood and Gary Cooper. Gary Cooper starred in a movie called Sergeant York.

I definitely understand the constitution greatly, but there are two parts to the second amendment and the first is for people (all people) to keep and bear arms, as well as a regulated militia - which specifically refers to conscription - as there was a worry that you needed to have people to help create a militia to fight against the British who were the government at the time of its writing (it should be used as a protection against a government that isn’t adhering to their constitutional roles). This is talked about openly in many documents from the founders prior to the actual writing of the constitution. This understanding was affirmed by the SCOTUS in multiple rulings.

I just subscribed to your channel and am so happy to know there are people that can laugh at this old classic show. I grew up watching this and so many other shows from the era. Just sit back and enjoy this and so many other classics like this they are truly funny. I always liked Archie's comebacks because he was actually witty with them and in all honesty he made sense.

The first part of the 2nd Amendment states a fact, and the main reason (in the minds of those who wrote it) for the second part. The second part is not dependent on the first, but the first part IS dependent on the second. The people are the militia, and as of about a hundred years ago, with the Militia Act (the first one I think), the National Guard became the “organized” militia, and the rest of us became the “unorganized” militia. For further info on this topic, I suggest checking out the work of one of our top constitutional scholars, Dr. Edwin Vierra Jr. (brother of TV’s Meredith Vierra).

The National Guard are considered Professional soldiers due to the fact they recieve the same level of training as the Regular Enlisted Military. They are not the militia forces being discussed in the second amendment at all. The militia there is comprised of armed private citizenry.

The Supreme Court recently clarified the misconception that the militia clause disallowed citizens from carrying outside of their own home. The 2nd Amendment specifically allows private citizens to carry as the militia is every able bodied American. There is a video with an English language expert clarifying the 2nd Amednment as well.

Ahh thanks for the laughs which are much needed today. I absolutely love All in the Family, so funny. Getting rid of legal guns means only criminals will have them. I was just watching Timcast IRL (highly recommend for fantastic political commentary and news stories the main stream news will not cover).. he was talking about how police in many areas cannot get there for up to an hour... even in the cities where seconds matter, police can't get there for minutes, but people don't have minutes. How do you stop a bad guy with a gun? A good guy with a gun. Edit:(writing more as I continue watching)..haha great Edith impression. LOL...... as for the militia, the militia is actually us.. the people.. WE are the militia. Also, one of the main reasons for guns is in case the government ever becomes tyranical. Just take a look at what is happening in Australia right now. They gave up their guns, now they are being brutalized by the government and the so called police. I don't think the division in the USA is between blacks or whites... or even Democrats and Republicans..I believe the real division is between those who are okay with an authoritarian government that is steering us towards socialism and a global corporate takeover... (notice how the government is killing small business)... and those who love freedom.

This is how it translates to the way people speak today. "Being that a well-regulated militia is necessary to the security of a free state, the right of the PEOPLE to keep and bear arms shall not be infringed. So Archie was right and the meathead was wrong.

2nd amendment had two parts to it. First part give states the right to authorize militias this is because the US originally wasn't supposed to have a permanent military (technically speaking we still don't) due to the poor track record of military and civilian "interaction" in Europe. Having a militia with made up of not professional soldiers but townspeople like blacksmiths, general store clerk, jeweler, etc was seen as the solution bc can't have a country with zero defensive force. Even still people were leery about it so the second part affirms the people's right to keep and bear arms. Notice it doesn't say militia there, it says people. Simply put 2nd amendment should be read as "Because we are going to do militias, we affirm the people's right bear arms" There is there's even some debate whether or not States actually had to authorize militias because the word regulated back then just met well functioning. Meaning anyone could decide to get a bunch of people together put in place a code to follow and be an armed militia.

The funniest thing about Archie was how he always screwed up his own facts. He came across like he knew so much, but he actually knew very little. It's supposed to highlight the silliness of his ideals. Like when he said "casting pearls into wine," he actually meant casting pearls before swine, which means wasting your time by offering something that is helpful or valuable to someone who does not appreciate or understand it. Archie also screwed up the names of several Hollywood actors including John Wayne, Clint Eastwood, and Gary Cooper. Graven images being part of the Gettysburg Address. Archie was a mess, but he stood firm in his mess lol.

The 2nd Amendment (like all of them) is written from the People’s point of view. You must read all the amendments from that context to understand them. The passage containing ‘Militia” is the People’s acknowledgement that an ‘Army’ (Militia covers all warfare) of some sort would need armed to defend the ‘Declaration.’ This is the People’s permission for a future Government to be Armed to defend the new nation. The rest is clear, the People’s right to Keep and Bear arms SHALL NOT be infringed. They used ‘shall not” because, well the 2nd Amendment was written by men, watched closely by MEN, heavy Armed MEN, fresh off their victory over the British. Nothing less than SHALL NOT was acceptable to MEN who just risked, and gave, their lives for freedom from the crown. On 15 Dec 1791, when the 2nd Amendment was ratified, Citizens like me and you owned Warships capable of facing the British Navy head to head. On 16 Dec 1791, they still owned those ships and were not hassled. WHY? ‘Shall Not’ is crystal clear. Sir, thanks for asking for perspectives on the 2nd Amendment. Once everyone understands all their rights, the better off America will be.

The episode was written to be pro gun control. Hollywood pushed gun control for quite a while in the 70s-90s and toned it down in films and tv and celebrities started doing it more in interviews and stuff. But gun control has historically made things worse. You have a right to bear arms. Don't let people convince you that it's a bad thing.

The constitution was written during the early period of the colonies and winning the War of Independence was the key to building national identity and empowering the expansionist agendas of the 'land owners' or 'Planting colonies'. But the frontier was fraught with dangers, not only from the indigenous tribes who became more menacing as the pilgrims pressed further West, but any rogue factions who might might try to conquer or pillage their greatest treasures: the Plantations. And in addition to this, it was considered necessary for slave owners to bear arms in order to guard and manage their work force. So the concept of a militia as an armed and organized civilian force was tied into this idea of safeguarding and protecting their VERY valuable properties from any possible incursions. Everyone was given the 'right' to be a part of such a coalition and to protect their property, but since slaves WERE property and could not vote or own land, they were capriciously excluded from any such constitutional rights by being defined as only 3/5 of a human being!! How's that for Big Stankin White loophole???

During framing of Constitution, "the well regulated" = well armed (ie having arms and ammo) "militia" = armed citizens. The term militia has obviously changed since then.

6:45 Backed up by the writing of the Federalist Papers, the 2nd amendment is comprised of two statements, the first statement describes why the amendment is there (for having a well-regulated militia) and the proclamation (right to bear arms shall not be infringed). People argue over what a "militia" means, but in that period, any orderly (well-regulated) group of citizens (as opposed to a mob) gathered for defense is a "militia". It is not restricted to a government controlled group, like a standing army.

Getting rid of guns would accomplish a few different things. 1: It would create a society where law abiding citizens are unable to defend themselves against criminals with guns, leading to crime skyrocketing. 2: it would lead to law abiding citizens becoming criminals by owning illegal guns in order to defend themselves against criminals with guns. 3: It would further incentivize smuggling of guns into the US by Mexican Cartels, leading to even more money and power in their hands, much like the war on drugs. 4: It would remove any and all safeguards against the potential for our own government to truly become tyrannical. Regardless of which side was in control, eventually the draw would become too strong.

You have a right to protect yourself and your family and home. If someone breaks into your home they are not coming in to just say hi and have dinner with you and your family. I have had to protect myself before more than once I I was kidnapped when I was 18 and went through hell he is in prison now and he will never get out and my ex husband tried to kill me and I knocked him out with 1 hit with my fist and I ran away before he was able to get back up. He is 6foot 4 and lm 5foot 1 size don't always matter. We got divorced after that he is now abusing his 4th wife he abused all of them.
