You can't "assassinate" anyone and call it "2nd Degree Murder.". It doesn't work like that. When you intentionally target someone, by default you are pre-planning their killing. Making IT a....PREMEDITATED, and therefore a 1st Degree PREMEDITATED MURDER. Nobody in the history of mankind has ever spontaneously "assassinated" anyone. Assassinations don't work like that. They by their very nature, require pre-planning, from selecting the target, to planning the murder itself. The very fact that Luigi Mangioni and Daniel Penny both got charged with the same crime, one intentionally pre-planning and then carrying out the cold blooded murder of another human being, while the other physically restrains a career criminal with a violent criminal history that included smashing elderly people in the face with his fists, and was loudly threatening the lives of people on the subway that day when Daniel Penny who had no possible way of pre-planning this interaction, acted in self defense of himself and others by physically restraining Jordan Neeley who died as a result of having multiple pre-existing health conditions. The fact that both of these en were charged with the same crime, simply shows that the DA's office in New York City is influenced by political ideology and group-think social justice narratives.
