So, a special proceeding was held regarding the assignment of mortgage being forged. The judge, Guzman, signed the order without judicial annotations and Nullified the "writ of assistance" that was issued by the judge, Friedlander, based on a 8/2004 judgement of foreclosure that was 'procured on condition' because the lawyer, Ted May, requested to have the original caption changed from the Originating Bank, "First Franklin Bank", to reflect a transfer/assignment to a Wells Fargo Trust. The Judge, Friedlander, granted the change of caption under the condition that the assignment "would be later filed". Instead, 4 months later, 12/2004, the lawyer, Ted May, filed and recorded a document that suggested an illegal transfer. The document he prepared had the transfer date on the alleged assignment to be 2/6/2003. That date conflicted with the Wells Fargo Trust creation date of 4/1/2003. (that is noted because the Wells Fargo Trust wasn't created as a trust until 2 months later) The trust was created on 4/1/2003 thus making it, the assignment, an impossibility; as "a transfer cannot occur into something that doesn't exist". And therefore the assignment the foreclosing attorney filed was invalid/forged and any subsequent action that occurred because of it's existence had to be nullified. 👉The signed "Guzman ORDER" Nullified the "Writ of Assistance" and was filled and recorded in the NYC Register. (the referee's deed was nullified as a result of the forged assignment in the record, and because of it, the conditions of the "Friedlander Judgment of Foreclosure" had not been satisfied) the correction was noted in the record in 11/2013 and the deed was restored and mailed to the owner by the NYC Register at that time. 5 months later, 2/2014 , the clerk in the NYC Register, on instructions from a rogue NYC sheriff, entered arbitrary comments on block 4872 and lot 66-68. The record of the aforementioned block and lot was corrupted when the clerk added the following false comment: the Signed "Order To Show Cause in Special Proceeding", that Nullified the "Writ of Assistance", was NOT A COURT ORDER and to DISREGARD the owners "correction deed". (Outrageous) That false comment the clerk entered in the NYC Register conflicts with the NYS Courts definition of "Order To Show Cause in Special Proceeding". The Courts definition states: "Order to Show Cause in Special Proceeding" is, in fact, a "Court Order". Nonetheless, Three days after the unethical clerks unauthorized and unlawful entry in the NYC Register entry, a rogue sheriff along with a 30 man (GOON SQUAD) battalion forced the owner out of their home of 55 years, at gunpoint, using the reanimated "Nullified Writ of Assistance" as the legal premise. The Case of Forgery was proved in Court and the Unethical Behaviors of the NYC Register Clerk and the incestuous rogue sheriff violated their oaths and the owners "right to due process". The institutional malfeasance that occurred caused the looting of all of the owners personal belongings from the homestead during the forceful, "unlawful eviction without notice" of the owner. Based on the magnitude of the aforementioned circumstances of fraud, forgery, corruption and lack of ethics of the NYC Register clerk and rogue sheriff's brazen disregard for the due process of NYC PROPERTY owners we have detailed the aforementioned crimes in language that could be understood by a high school student and not just attorneys. We submit this "call to action" for: City Councilman Kevin Riley (District 12) to support the owners 2013 deed, that was supported by "Court Order", and assist with the restoration of the only 'bonafide deed' in which the owner shall take possession of the aforementioned properties, change the locks and render all current residents therein as 'tenants'. In addition, he must support and assist in the arrest of the current mortgage holders as it has been discovered that "mortgage fraud" exists on the aforementioned block and lots. And he must: 1. move the NYC council to ban all "Accommodation Recording/Courtesy Recording" Title Company activity in NYC 2. demand transparency of the title companies recording manifest {to reveal all of the other potential FRAUDS that have been occuring via the use of "Accommodation Recording"} The Accommodation Recording Service, as being used/abused, renders Title Companies into virtual "fraud machines".
