Good video Sam. The FMCSA just released new rules for short and long haul driver. I believe as of 9/29/20 you now can travel 150 air miles from your home base with out a log book. And work 14 hours a day. That is up from 100 air miles and 12 hr working days. Just a little info for you. Even though highway patrol are just law enforcement doing a job to try and keep us safe it’s in my experience that they aren’t always up to date on the rules and laws. And sometimes try to get you for old regulations that no longer apply. Most of the time again in my experience if your are polite to the officer and ask questions on something they are saying or trying to write up for they will be polite back. But sometimes you will have a officer that’s just having a bad day and there is no talking to them.

It appears California will not be adopting the new FMCS a guidelines for intrastate carriers. So Sam and his crew will still be restricted to 12 hour days. His non CDL trucks can go 150 miles.

In my years as a DOT inspector the three biggest compliance issues for pickup trucks and trailers have been with no Class A CDL. Logbooks, and Drug and Alcohol testing. Load securement is up there too. Many small operators don't know how to calculate GVWR and when a CDL is required. Once required there are a lot of new regulations that become mandatory. As for a couple of the other listed comments. I wish I made $150,000 a year. Actual pay is less than half that. The DOT does write the compliance laws. Trucking companies do. The DOT just enforces them and in my area all revenue from tickets goes into the state fund specifically for roads, bridg as as transportation projects. In the end it's all about getting there and back home safely.

I know your pain. Over the last few years FMCSA has been changing regulations so much, and unless you're fluent in legal speak and check regularly on their website you will not know of the changes. If you have to run a log book most of them have a daily inspection list on them. Good luck getting everything together and stay safe out there.

Watch when you have your license renewed also. My neighbor went to renew his license and the lady only gave him back regular vehicle license and told him that he didn't have motorcycle and cdl. He had to go back another day and talk with her supervisor luckily there was a highway patrolman that seen the whole thing and stood up for him.

We used to do weekly truck inspections on a form from DOT. We kept a copy at the office and one in the truck. You would turn them into the office monthly and they had to keep them in a file for each truck for two years. Some parts of the inspections were done daily.

Before I went into business for myself I ran the bit program for the company I worked at. Then I ran my own and went through 3 bit inspections. Funny thing is, when I went to become an interstate holler out of Texas, and I got my 1st audit it was a walk in the park. I mean, the 90 day. It inspection schedule that California requires is not federally required. So when they saw all the documentation they were very impressed. Now that I run long haul over the road trucks, we still do the 90 day but we have it done by a 3rd party. Typically we just do it at love's. We request what Texas calls a title inspection. It's the same thing as a annual inspection but only cost $40. Same thing applies there, you keep copies of the inspections in your folder with the truck. Every time dot looks at your documents and they see all the inspections they really like it. By the way, I think I commented on one of your videos once that you are missing the stickers on the door. Don't know if you didn't catch the comment. But just having a not for higher sticker on the trader does not get you out of those requirements. You may be a private Carrier, but that does not relieve you of the responsibilities for signage and other requirements. You are still what's referred to as a regulated Carrier.

Here in Australia anything over 12,000kg gross combined needs a log book. Anything over 4,500kg needs an annual inspection by an approved inspector. Anything over 15,000kg needs to go over the pit at the the DOT yard. 45k (20,000kg) you wouldn’t be driving a “pick up” here either, you would be in a cab over but realistically pulling what you are you’d really be in a semi here. I love seeing how it works over there vs here and seeing how much is actually the same

I guess it is what it is, but why does everything need to be so complicated? lol

Going back 15 years ago, I had a class A CDL and a class M, motor cycle endorsement. Went to renew my license and was informed I needed a current physical or I could down grade to a non-commercial class A. I chose the non-commercial as I no longer owned my tow company, and I paid good money for the license just to let it go. Following renewal cycle, I went to the DMV office, presented my license, and the examiner informed my my license was expired. Mam, you're looking at my license, it expires new week on my birthday. The license had the correct date, but their computer never was updated. Three hours I had to sit while they fixed their problem. Moved out of state, 7 years ago. Just received a notice from my old state, that my emissions inspection had just expired. Funny, as my vehicle was re-registered in another state, 7 years earlier. One thing they don't tell you, is once you get a CDL, you can no longer use a mail in change of address card. In person changes ONLY. While you're on the paperwork thing, create a daily vehicle inspection sheet as part of your service hours and mileage. Mileage isn't required by most states, but you being in Commiefornia, they're moving to use your mileage declaration to tax you per mile. Watch out for expired fire extinguishers. Same goes for the auxiliary fuel tank on your bed and any permit required. My Freightliner tow truck had dual 175 gallon tanks, which put me in a high risk category with the hydraulic fluid. Think your 45k sticker was bad, my tow truck tags for a 72,500 actual weighted truck were $3800 a year. I paid over $10k for 4 trucks just in tags and another $22k for vehicle liability insurance and another $4k for cargo insurance (required for IFTA/ICC number).
@thompsonautomaticgarage20793 жыл бұрын
Ouch!
@gungadinn3 жыл бұрын
@@thompsonautomaticgarage2079 Ouch was correct. You've got to make $3k a month just to cover tags and insurance. A lot of the large tow companies purchase a $5 million surety bond instead of conventional insurance. You've still got to pay for cargo insurance to satisfy DOT/ICC/IFTA. Your driver crashes into something or totals a $400k truck and you're out of pocket as only the other guy is covered. I didn't have the asserts for the surety, so insurance it was.

In Canada its called National Safety Code or your NSC# I had a tough time getting answers on what the requirements and on-going obligations were. My F350 still has good payload at 11k GVW but I could be at 12.5k if I got a number. Guys I've talked to with NSC# say its a get-it-and-forget-it thing but it sounds like we have to keep maintenance records at the very least and more as your weights go up. Another thing I couldn't understand was the "for hire" or "not for hire" and how that mattered but it was on the application. Typical bureaucracy need a lawyer to drive a truck
@larrythompson86303 жыл бұрын
It really depends who you deal with. The fire extinguisher must be mounted. I use a DOT box. (What it’s labeled) behind drivers seat in ex cab. Inside fire ex, fuses, lights, triangles, 12v compressor, socket with just two sockets (truck, trailer ) breaking bar.. As the box is not mounted. Fire ex is not legit in some eyes.

The motor carrier unit is a arm of the highway patrol and safety compliance is very important, but they have a geographical area and BIT fee collection is number one!! That’s how they get a paycheck, bit fees. The BIT program has never gone away.....just pay your fee’s!
