Wow! I just found out that my spouse and I may be divorcing soon.
Ah! But I'm worried because I really don't have an income during the marriage.
And now I don't know what to do.
Am I entitled to any Alimony?
Hi, I'm Sergio Cabanas Attorney-at-Law here in Florida.
And today we're going to talk a little bit about your potential eligibility for alimony in Florida.
First of all, what is alimony?
Alimony is basically financial support given from one spouse to another after a divorce or during a separation.
So, now that we know what alimony is, we look at how the courts determine alimony.
Well, there are several factors.
The main factor they look at is one of the spouses' financial need for alimony or financial support, versus the other spouse's ability to provide that support.
The financial need includes the cost of maintaining the standard of living to which you become accustomed to.
Another factor is whether or not you're responsible for taking care of the children and the amount
of time-sharing you have.
And finally, another big factor is the length of the marriage.
Typically, the longer you're married, the longer the duration of alimony payments.
For marriages under 7 years, you may be eligible for some type of short-term alimony.
For marriages lasting between 7 to 17 years you may be entitled to some alimony called 'durational alimony' which is a little more than short-term alimony.
And finally, for marriages that are 17 years or longer, you may be entitled to permanent alimony.
