How is Spousal Support Calculated?

Hey, Barry here with the LawFull channel. In this video, I sit down with Mark to provide you some information on how alimony or spousal support is calculated.
So, what is spousal support? Spousal support, which is often called alimony, is money paid from one spouse to another after a divorce. The idea of alimony is to maintain the lifestyle that the other spouse enjoyed during the relationship.
Spousal support applies to men and women equally. So, if the husband was making more than the wife, he may have to pay spousal support and vice versa, a wife may have to pay spousal support to her husband.
Spousal support is not guaranteed in Illinois. But every state is different. So I encourage you to look at your state’s laws on alimony.
What are the factors in determining alimony? The factors in Illinois to look to determine whether a spouse will have to pay alimony include:
What are the spouses’ current income?
What is their potential income?
How much non-marital property does the spouse seeking support have?
How much marital property will the spouse seeking support get in the divorce?
So hypothetically, if the spouse seeking support has a lot of money, it is very possible that the other spouse will not have to pay spousal support.
Also, if both parties make similar income, it is likely that neither spouse will have to pay spousal support.
But things are changing in this field as women continue to make more and more money. But there is a classic alimony situation that Mark still sees:
A young couple gets married with no kids, then they have kids and the wife stays home to raise them. The husband is in the work force and advances and continues to make more and more money.
The wife meanwhile remains at home, does not have a job and does not advance her career and/or make more and more money.
In this “traditional” spousal support situation, the husband pays spousal support.
How long does spousal support go on for? Does alimony go on forever?
The answer is, it depends on the laws of the state you are in.
In Illinois, there is a table that determines how long spousal support goes on for. Very generally speaking, if the marriage lasted 5 years or less, then a spouse will be entitled to 20% of the time of the marriage in alimony - or one year.
If the marriage lasted 15 or 16 years etc., then the spouse might be entitled to 80 or 90% of the marriage in years of support.
After 20 years, the court might award 100% of the time of the marriage in support, or 20 years. The court may also award support indefinitely.
Is spousal support modifiable? In Illinois spousal support is modifiable upon a substantial change in circumstances. Meaning, if the spouse receiving spousal support gets a job and ends up making a lot of money, the spouse paying support might petition to have the support payment reduced.
Also, losing a job might be grounds for modifying spousal support as well.
Is alimony avoidable? It might be. In Illinois you can agree in a divorce decree that spousal support is non-modifiable. In that case, it may stick no matter what happens.
Are there alternatives to paying spousal support? There are. The parties in Illinois can enter into a “maintenance buyout” which provides the spouse a large chunk of money or property up front, thus terminating the obligation for spousal support.
Are there times when spousal support might end sooner than expected? There are. For example, if one of the parties dies in Illinois, that will terminate the payments.
And again if one spouse gets a great paying job, then spousal support may no longer be needed.
Finally, in Illinois, if one spouse starts cohabitating with a significant other on a conjugal basis, meaning truly living together, that might be grounds to end alimony payments.

If I’m rich but I live modestly, I don’t waste money, no fancy cars and houses is her claim the modest lifestyle or my bank balance? Is it also based in income or net worth? Just curious: can the prenup include clauses to protect the husband's earnings during the marriage (so called "marital income") so that the wife doesn't get any of it except that which is agreed upon (e.g. basic clothes, food, utilities, and rent)?

What if one spouse is retired with pension, social security and 401k is 3 years older, the other has two years before they retire, no minor children. Would that be consideration for spousal support to pay the retired person? The only they have to split equally is the house. OR do they just give the house to a woman?

Divorce and spousal support issues are very local issues. I'm in IL and do not know anything about NY law. I would strongly recommend talking to a local divorce attorney. They're expensive. If you cannot afford it, perhaps there is a local legal aid clinic you can talk to? I'm sorry I cannot be more help.

Seriously? You should be suing your lawyer. Either you had a crappy lawyer or you were found to be the reason for the breakdown of the marriage. You have to prove he is gay, then cohabitate with analogous to marriage. That is, lovers, same bedroom etc. How do you prove it? Lay back and watch. Don't tell anyone you are watching. Get pictures of them out at dinner, etc. Send a certified letter to him ....something stupid, just to make sure he gets it. Then mail another certified a year and one day from then to be sure he is there for over a year. Other than that I don't know.

I have a question, I recieve SSDI and recieve Veteran Benefits for disability. I have no earned income, and my wife works as a medical assistant and she earns 45k a year. We will be married for 8 yrs will she be entilled for alimony?? We have no children. I also have a Veteran's Loan and my name is the only one on the property title. My husband and I have been married almost 25 years. He's been the bread winner while I stayed home raising our 4 children. Prior to our last child graduating he closed our joint account leaving me with no money and forcing me to hurry up and get a full time job. Not only does he withhold all the money, he won't help pay for any of my bills causing me to fall further in debt while he lives high off the hog. There is nothing worse than dealing with a narcissist during divorce. My husband cut credit cards cell phone empty joint accounts use psychological abuse intimidation coercion etc I was lucky to find a good lawyer and my twin sister helped pay for her. Make sure you gray rock the narcissistic spouse Do not let them get any reaction out of you whatsoever. Narcissists try to make you lose your temper so they can use it during the divorce to say you're unstable or violent so no matter what they do do not fall for that ploy you stay totally neutral in your behavior this usually cause their abuse to escalate for two to four weeks but if you stay strong in Gray rocking they give up after a while but don't let your guard down they are forever watching for a moment. Everything you say they will use against you so keep your eyes open and your mouth shut. The more you gray rock the more mistakes they make and then you make sure your document all those mistakes and give it to your lawyer. Best of luck you going to need it.

When families decide to designate areas of focus for each spouse; in order to have a smoothly running household. Normally, a stay at home mother's priorities consists of taking care of the emotional and physical well-being of her family. In many instances, the mother is the support system of the family, enabling the father to advance and focus on his career. When the marriage fails; the mother's role rarely changes. could you imagine having to instantly change your career and put less energy and focus on the things you have focused on for years? Divorce is especially, hard for mothers without the needed degree or skills to pick- up and start a new life.

I am a stay at home mom by his choice. I generally work but, after we moved to a new apartment, he made me quit my job. He got caught abusing us and left. I never asked him to leave, he was worried about police so he ran away. He had paid the rent but then reported his card stolen so it wasn’t paid. What If both parties agree on a set monthly amount without using any legal obligation. Only amounts e.o. does it have to be on any legal documents. In my case we have no kids we just fell out of love and of course we had our problmes we just do not want to be together. However she does not have a job and she has not worked in over a year. I have already been helping support her altho she is in a different state . I'll revisit the question : Does our " alimony " agreement to e.o. have to be on a legal document? Another reason that the job of "stay at home mom/dad" is not a good route to go. In the case of a relatively long marriage, not only does that person lack any real resume for the workforce, but they've also not accrued employment time for social security. If the other party no longer makes or never did make much income, then the stay at home mom/dad is in for a rude awakening and tough time. I tell all young girls to make sure they can support themselves BEFORE ever getting married AND having children these days. This is no day and age to be uneducated/unskilled/unemployed. Then I found out that he had not only planned to leave me high and dry but for the last 20 years filing taxes he never claimed my income. He insisted he file the taxes and never claimed my income so my SS is squat. My friends said to me "E, you have no choice now but to seek out a lawyer. He really has you in a corner this time."
