I am siding with the judge on this one. First of all, you don't ever make an employee change clothes on the floor and examine how the clothes fit. You have the employee use the company bathroom and then ask him how they fit. You don't touch the employee at all without their consent. With or without sexual harassment as an intent, this business owner made a very costly mistake.

+James Gafa Yes, I noticed that too. I feel bad for the woman. She has kids his age and it's a very normal thing for a mom to check the waist band to determine if a larger size is needed. Even in the department store women sometimes work in the men's department and check for proper fit and size by touching the waistband. This judge was ridiculous to give more weight to the supposed sexual harassment than he did the real reason this kid sued his boss. He was angry that his cell phone charges came out of his pay. So he sues her for the wages she withheld and figures what does he have to lose by throwing in a sexual harassment claim too! I have never watched this judge before and after seeing his decision on this case I would not want to watch him again.

There are 2 reasons for why he won and should have won. The first is that this is civil court, in civil court you don't have to prove your case beyond a reasonable doubt in order to win. The plaintiff didn't come closer the money he was seeking because he could only prove part of his case. The second is the defendant admitted to touching his waist, which this judge found to be inappropriate. Had this been a young female employee with a male boss who touched her waist this could have been a $100,000 lawsuit.

I guess I feel male or female either one, It's cases like this that make me livid, because we have people that are really getting sexually molested out there and it gets overlooked because of shit like this. The judge is correct in his ruling about sexual harassment. You would never make an employee change in front of you - you would send them to the bathroom. Also the "innocent" touching is a no-go for any employer, you do not touch a staff member unless it is a handshake. The males in the news who were really sexually harassed kept as quiet as could be. They actually liked it and did not even believe they were sexually harassed or assaulted. Usually, its the mother of the "alleged victim" who takes the case to court. This is the very first time I've seen a male, himself, charging a woman with sexual harassment. Something doesn't add up.

This judge was ridiculous to give more weight to the supposed sexual harassment than he did the real reason this kid sued his boss. He was angry that his cell phone charges came out of his pay. So he sues her for the wages she withheld and figures what does he have to lose by throwing in a sexual harassment claim too! I have never watched this judge before and after seeing his decision on this case I would not want to watch him again.

This pisses me off so much. This judge clearly hates women. He never gave any proof of his claims (he could've brought the uniform or a recording of his attacks). The boss had evidence of hew claims against him which makes her a hell of a lot more credible than him. Hateful need to be seriously educated before this world turns into a shithole.

Roderick Todd That’s kind of how sexual assault cases work his story was consistent but she seemed to make excuses. Also it’s a company uniform he wouldn’t be able to bring it in because it wasn’t his, however she could have brought it in to prove her innocence but she chose not to because she knew it was to small
