Most people do, as sick as it is to say. My own mother blamed me. And I know other people who've been in situations like mine where the same thing happened. People suck at taking responsibility. Even if they didn't commit the crime, if they're even tangentially responsible, they will throw the victim under the bus.

I was the victim of grooming and sexual assault when I was seventeen by a volunteer coach of the academic decathlon at my high school. I sued the school district a few years ago and actually won a pretty sizable settlement. When I read their response to the legal complaint that the school was negligent, their defense was something along the lines of I didn’t tell anyone and I didn’t stop him so I must have consented. I WAS FUCKING 17! I mentioned this to my attorney who basically told me that this was not an uncommon defense and was most likely copied and pasted from a previous complaint from a similar kind of case and that those kinds of counter defense arguments are par for the course in the defense of a major corporation (or school district in this case) against claims of liability for sexual assault. It certainly didn’t quell my anger nor did it make the retraumitization more than twenty years after the incident happened any easier. With that being said, it sucks that attorneys use defenses universally Instead of attempting to formulate a defense based specifically on the situation and circumstances of that particular case. All I can say is fick American airlines and double fuck the attorneys for their bullshit defense response

not to defend them at all, but a legal filing like this would likely be handled by outside counsel (unless they have an in-house legal team for these civil cases, but still a totally separate department). so while AA did hire the law firm (likely they just had a contract to work with them on all suits of this type), no one on the AA team themselves likely reviewed that pleading before it was filed. so the real idiots here are the attorneys who either wrote something that dumb or didn’t read closely enough to correct the paralegal who drafted it. and AA is just dumb for hiring a firm that would let that happen.

As a lawyer, I 100% see the thinking behind the American Airlines victim-blaming. AA asked their lawyers, "How can we pay less money on this claim?" and their lawyers pushed the standard "Pay less money argument" button, a.k.a. "Contributory Negligence", ... without ANY thought about what that argument means when applied to the actual situation at hand. 🤦‍♀️

Not every family has the time or resources to switch to reusable diapers. I wanted to, but in an apartment, with no balcony and ridiculously expensive laundry machines, I was unable to reliably or financially use washable diapers. I remember feeling hopeless when buying diapers for my daughter back in the mid to late 2010's. We weren't struggling, but diapers felt like pads or tampons to me - a mandatory "luxury". The relief of receiving even a sleeve of diapers from family or friends is profound. The fact that there is a state that will lessen that burden, even slightly, is wonderful.

The craziest thing about the American Airlines story to me (besides the horrific victim blaming ofc) is that it’s not even close to the most compelling argument they could make. What legislators aren’t understanding is that some medications used for abortions aren’t explicitly for abortions and have multiple uses. I had to have a round of Methotrexate after my D&C concluded my miscarriage was actually an ectopic pregnancy. Methotrexate is most commonly used as a form of chemotherapy but can be used in situations like mine where they couldn’t find where the pregnancy was located on an ultrasound and didn’t want to just cut out one or both of my tubes and just hope for the best. Laws like this will inevitably put a lot of other medications up on the chopping block and hurt more people than the women they’re targeting.

On the diaper story. We recently got a batch of reusable diapers. Would highly recommend. On the pluses- environmentally friendlier. Just as easy to use and they have a much larger soakage area so they can actually be left on for longer. They are machine washable. You can also get biodegradable linings. This means that when there's a poop, you just throw away the lining and throw the diaper in the laundry without soaking . Only real draw back is they don't have the blue line to tell you the diaper is soaked so you have to open it up to check. You could say having to wash them is a draw back, but considering how often I need to wash the rest of her clothes anyway, it really isn't.

I wonder how often or if you even could request your surgery to be filmed? I'd be so happy if I could have a DVD or just some form of video of my big surgery I had years ago, I think it'd be really interesting to look at and I'd genuinely appreciate watching something like that. Though I imagine just knowing their actions are being recorded might make surgeons more anxious, which is the last thing you'd want your surgeon to be. Plus someone would either have sole cameraman duties (extra person in the room) or it would be added to their responsibilities (everyone there already has a lot of those that are way more important) so idk

The wild thing about American is that they could’ve gotten that case tossed out so easily by firing the dude and complying with cops. “We weren’t aware this was happening, we don’t monitor the personal private phone activities of our employees nor do we record our bathrooms so how could we know, he had no priors that showed on a background check (I friggin hope), as soon as we were aware he was fired and we complied with all law enforcement requests. We cannot be found liable for the behavior.” No rando mom’s lawyer could outlast them dragging it out, it’s one of those cases where the big business can squash this no issue. But by going with the MOST WILD DEFENSE EVER they have not only brought bad publicity on themselves, they also make me wonder why they couldn’t just go along with the bog standard “let the cops do their thing and then wait out the lawsuit and settle” big company thing. What would have been found?

@PhilipDeFranco regarding the American Airlines situation: I was the victim of grooming and sexual assault when I was 17 by a volunteer coach of the academic decathlon at my high school, Porterville High Scool in Porterville, CA. I sued the school district a few years ago for negligence and actually won a pretty sizable settlement. When I read their response to the legal complaint that my attorneys filed stating that the school district was negligent for not conducting a bg check (he had a prior sex assault of a minor conviction in WA that would've been easily found had a bg check been conducted) and basically allowing him free access to the campus because my English teacher listed him as a decathlon coach, their defense was something along the lines of "I didn’t tell anyone and I didn’t stop him, so I must have consented." I WAS FUCKING 17! I discussed this with my attorneys who told me that this was not an uncommon defense and was most likely copied and pasted from a previous complaint from a similar kind of case and that those kinds of counter defense arguments are par for the course in the defense of a major corporation (or school district in this case) against claims of liability for sexual assault. It certainly didn’t quell my anger nor did it make the retraumitization I experienced 26 years after the incident happened any easier. With that being said, it sucks that attorneys use universal defenses instead of attempting to formulate a defense based solely.on the specific circumstances of a particular case. All I can say is fuck American Airlines and double fuck the attorneys for that bullshit defense response.

I was lucky my Mum took on the childcare when I went back to work. Over the passed few years I've become more and more disabled and now I can barely leave my house. Back in March I got ADDICTED to this MMO called Sky: Children of the Light. The userbase is wholesome and friendly (for the most part), most people are happy to sit and talk for a while. It's a gentle, cozy, forgiving game. This game gives me the socialization I've been missing since 2020. I actually have more friends, I get excited to wake up and play every day. There's a lot of unofficial "quiet corners" where people go to just relax for a while, maybe talk to friends. A lot of people would say "Oh it's just a game' but this game has been HUGE for my mental health. I can talk to people!! I feel like I can do things- even if it's just through a proxy avatar. Games with a lot of fighting or stressful quests can make me tense up and cause myself pain, but with this game I can just. Relax. I can leave it on in the background while I do something like read in case any of my friends hop on and I can play with them. Fuck anyone that thinks video games make you violent

With the Louisiana law, it’s a good reminder that abortion bans are something that only a small percentage (13% if it’s all abortions, and around 35% for most cases) of Americans want abortion to be illegal, and while the numbers have changed, over the past 3 decades the majority of Americans have supported abortions being legal. It’s especially telling that when you consider that the people most effected by these bans, ie people between 18-30 the gap is even larger with only 23% thinking it should be illegal in most cases. In almost all cases abortion support has a 2/3rds majority so you gotta wonder why these laws are even getting passed.

As someone that developed Multiple sclerosis in my 20s (my brain is actively trying to destory itself) it feels like video games are keeping my hand eye coordination as sharp as it can be. As well as stimulating my brain to make new connections through the problem solving. I don't feel like it's a cure by any means. However, between managing the disease with medicine and me doing my part at home with excercise (both physical and mental) i feel like that is the reason that I'm doing so well comparatively to others I've seen. Something i started doing as a child in the 90s for fun and continue to this day feels like it's helping my quality of life. I only see it as a plus.

I’m not even going to watch the story because it would be too sad but you can believe I will never fly with American Airlines again. Phil is such a trustworthy journalist and thank god because there aren’t many anymore ❤

Thanks to the commenter who posted about va disability claim help. I'm currently filing mine and it's very difficult to understand what will help or even hurt my claim. Took a picture and will utilize if they give me grief. We all know how much the VA likes to give grief. They're like a parent who always thinks you're lying

I'm 50, and I've been a gamer for close to 25 years. About 13 years ago I was in an accident that caused a traumatic brain injury, resulting in neurological and cognitive impairments. Something my neurologist advised me was that gaming could help. And it has! Beyond that, some games, especially Dark Souls, have helped with the depression and suicidal ideation that comes with a TBI. It's also how, as a disabled person, I'm able to have regular interaction with friends. Basically, without gaming I might not have lived this long. I shit you not.

If I may be so nosey, what is it about dark souls and the other games that helped with your depression?
@kguile7832

@thatwaygaming8679 probably because most of those games are designed to force you to deal with your issues, even if it takes you many tries, i.e. never give up. - just a guess, but Ben Yahtzee Crenshaw said it best, paraphrasing, "keep smashing into a brick wall until you get through"

@thatwaygaming8679 in those games you're struggling your way out of darkness. You get defeated, but you come back and try again, eventually succeeding. Each attempt teaches you something new.

The video game is funny because it reminds me of a school project i did for science class “does playing video games improve reaction speeds” where as part of my project i listed articles, and put up a reaction speed test for people to do as they walked by my poster board, and list their times, and whether or not they gamed, and it was a pretty much unanimous result that the gamers scored WAYYY better than the non-gamers. It was a resounding victory that day
