Their mistake (both Roger for selecting that persona and Francine for trusting in) was that the base persona of Ed Dickle wasn't as a lawyer, just a showman. Roger's personas rarely fail, outside of external intervention. Like Jeannie Gold, Super Positive Asian Roland Chang, even charlatan medium Chantilly Dubois. All of them always make it work on their part. If Ed Dickle had been a good lawyer persona, he'd have gotten Francine out of it. Hence why he only called that persona The Ultimate Showman.
