This is happening to me and my brothers right now. My step mother has been selling off all of his estate. We’re ok with that, but now she is after the land. That’s where we have had enough.

My situation is a bit different. My father passed in 2020 and left 100% to my stepmother. She'd been working on her will since 2019 but never signed it. She left 3/5 of her estate to me and 1/10 increments to two brothers, a family organization, and the local SPCA. She passed 12 days ago. Now her will is "intestate", meaning under very antiquated British common law succession rules which a lot of this stuff is based on I, as an unadopted stepson, have no standing to contest probate court's splitting the estate between her two brothers 50/50, one of who has been estranged for nearly 30 years.

But he could put it in a trust and sally could have changed the trust .

Paul, my parent has a trust and a durable power of attorney. However, when they went to the credit union with their trust book they were told that the credit union is unable to retitle the accounts to any thing other than the parent's name nor are they able to file a durable power of attorney. They said this may be something only "regular banks" can do. Not sure if what they're telling me is true.

Hi Paul, do you think you can do a video explaining how an irrevocable Medicaid trusts provides benefits over just signing over all your property to your children 5 years before you go into a nursing home. I was explaining to my wife how a Medicaid trust works and why it’s important to have one and she said well what if we just signed everything we have over to our child 5 years before we go into a nursing home? So I’m trying to figure out the advantages of a Medicaid trust over just signing all our assets over 5 years before going into a nursing home. Thank you. By the way, your videos are the best!

My dad passed according to my stepmom he didn't have a will, do his biological kids have inheritance rights.

What if there was a residuary clause that stated that the father bequeathes " everything tangible, real, whatsoever etc.." to my son? Would that change the outcome?

I don't talk to my 80 year father over this issue and he can't see his grandchildren. He's leaving ownership to my mother who has stated she intends to cut me out. I'm a gardener and I earn very little. The money matters. It's not entitlement. In this day and age it's just practical considerations. It's also exceedingly aggravating to see all the trust fund kids in my well heeled area on easy street. Unfair estate planning breaks up families and often the only one that wins is the greedy and unprincipled

Thank goodness the laws where I live allow the courts to intervene when step mothers do such deliberate wrongs. Dad s last will stated that after he and his wife passed remaining in state to be divided among his children. Our case is that she picked a favourite step grand child to control entire estate after watering it down with generous gifts of money to 2 step children and the other 5 step grandchildren.

A family connection of mine and his siblings are in this exact situation. Dad and mom had five kids and then divorced. Dad remarried. Dad told kids for years that they were his heirs and were entitled to a share of his estate with the step-mother. Dad dies and the step-mother produces documentation giving her sole control over Dad's estate. My family member has been spending years trying to pursue his father's second wife for the kids' shares of the estate. He is alleging fraud by the step-mother and malpractice by lawyers. He claims to have evidence but what he and his siblings don't have is a cent of their father's money. It is very sad all around.

I think if the stepmother had intended to cheat Sam all along, she probably would not have waited three years to change her will. maybe somebody was chirping in her ear and she decided to change things. Maybe after three years, she thought back about all the shit that her dead husband had done to her and decided she was going to give his money to her side of the family. One never knows, does one?

I am glad that I do not know Sam. He did not let Mr. Rabalais get a word in, to begin with, then said that Sally's nieces should not inherit, because they are professionals (so he should inherit the whole estate?). Dad left nothing directly to Sam, which says a lot. It makes me think that Sam's behavior (not necessarily Sally's) changed after Dad died.

This just happened to my brother and me. We are devastated! The stepmonster refuses to answer our calls or text. She won't even let us know the date and time of the will reading in probate court! My Dad continues to make our lives hell even from the grave. It's truly disgusting!
