Sir, I like the way your clarify the terms and rules, purily clear. My friend is having an issue and I was searching some solution on it. His father and mother were working, they purchased a land, build a house with their earnings together, house was in the name of mother, see died in 2013, honership was transfered in the name of father and three sons and no mention is there about the daughter. Two sons are staying out, Elder and the younger once, middle brother, wife and his and kids (2) were staying with the father. This middle son died in 2017 (he was alcoholic and was not bearing the need of his family) All the needs and education of their kids since they were born was fulfilled by their grandfather (mean my friends father). Now, the main issue is, his middle brothers wife, got the job is Railway ( they prefered the boy has a potential to achieve higher goals) and is also getting pension of her husband..... but slowly the problem grew big...... now she claims that because I am taking care of my father-in-law this house should be mine, all his pension should be spent on me and my children.. but she is not taking care of her father-in-law. .................. Long story short. No.1- Can this property be sold without her concent. No.2- Can he divide the revenew in 5 parts, father, 1st brother, 3rd brother, sister and 2nd brother family (40% for son, 40% daughter and 20% for wife{she is getting pension and had got a Govt Rly job of her husband}) .......This is a very diffirent type of issue, I request you to make a video mentioning all rules and regulation. Sir isn't the concept of coparcenary property eliminated? CWT V. Chander sen(1986) and Uttam V. Saunbhag Singh & others(2016) , In both these case supreme court said that property inherited under section 8 of HSA would be the seperate property in the hands of son and even several high courts supported this view, for instance, Delhi High court in Gyan Chand vs Ram Chander(2014) declared property inherited by father as seperate property. Sir on one hand, Hindu succession act preserves the concept of mitakshara coparcenary under section 6 while on the other hand it is terminating this under section 8 by specifying several heirs who can inherit property under which son of predeceased son is capable of inheriting but son of a son is not capable of inheriting. Gujarat high court in CWT V harshal lal(1974) held exactly opposite view of this and supported the concept given under old hindu law according to which property inherited by father ,father's father or father's father's father is ancestral or coparcenary property. Sir I'm not able to understand this controversy going on. I'm literally very eager to know the exact position of today wheather the concept of coparcenary is still persisting. If it is not in existence any more than what is the role of notional partition or deemed partion or in short what is the importance of section 6 now?? Plzz sirrrr replyyy....😥😥🙏🙏🙏🙏🙏🙏🙏🙏🙏🙏🙏🙏🙏🙏🙏🙏🙏

Sir as per the agreement document regarding the division of land between my father and uncle never took place. After their death it was learnt that the land was in the illegal possession of my uncle's son, who had kept the matter a secret. Further, it was found that the land was registered in the year 2015, years after my uncle's death. Now, he claims it and tells me that I don't have any share of it. Please suggest what should I do in this case?

How to access unknown family property details which has been hidden from my father by his brothers. Property belongs to my grandfather, property was not divided among his sons. Grandfather is nomore. मुझे पुछना है उत्तर प्रदेश से , सर मेरे पापा का 2 साल पहले देहांत हो गया था , उसके बाद से मेरे 2 चाचा पापा का पैतृक हिस्सा हड़पना चाहते है पैतृक खेत ओर घर जो 100 150 साल पुराना है मेरे बाबा का खुद से कुछ बनाया नही है , बाबा भी चाचा का साथ दे रहे है अभी बाबा के नाम है पैतृक संपत्ति, अगर मेरे बाबा अब पापा के मरने के बाद मुझे मेरी माँ भाई को पैतृक संपत्ति से बेदख़ल करते है या कोई वसीयत करते है तो क्या वो क़ानूनी माना जायेगा या नही ? हमे पैतृक संपत्ति मिलेगी या नही ?

एक बात बताएं क्या बच्चों के अधिकार के लिए कोई कानून नही बना ? क्या कानून को लगता है कि मां बाप ही सही होते हैं और बच्चे गलत, उन बच्चों का क्या जो जीवन भर प्रताड़ित रहते हैं , मानसिक यातनाएं झेलते हैं । मां बाप अपने बच्चों को शोषण कर के मां बाप होने की आड मे छुप जाते हैं , यह कहकर बचकर निकलते जाते हैं कि वो तो मां बाप हैं और उन्होंने बच्चों को पैदा किया है । क्या पैदा कर देने से, मां बाप को अपने बच्चों के जीवन पर अधिकार मिल जाता है ?
