Ga Secretary of State does not require names of members for LLC. Additional information in the Articles of Organization is optional. Incorporator doesn't have to be a member. Register agent companies and virtual business address are fixes for the other issues. I love your work. It's inspiring what you are doing.

Thank you so much for all of the helpful information you are giving out. At 20:00 you described how a predator could make the connection between a pre-existing Red LLC and the Blue Box. Thus, exposing the other Red boxes. Couldn’t he make the same connection with a “New” Red LLC if the owner removed one of the properties to do a refi? The county record would show the grantor and grantee on the quitclaim. Then, just look up that LLC on the state site in order to find the Parent. Or am I over thinking this? Lol.

Sounds like your talking about a Living Trust which uses Grantor and Grantee as titles. You need to be clear about what kind of entities your talking about. As each entity has its certain ways of operation... and when discussing forming a "plan of action or structure" you really need to understand the variations between entity types. Also there are "business trusts" and some "Land Trusts" which do not use the terms Grantor and Grantee at all. Additionally, if your wishing to be private... its hard to do if your the Grantor... or you record your name as a Grantor or Grantee. This gives everything away right upfront. This is why you do not want to use a Living Trust if your intention is for anonymity. And if you actually have a situation which your trying to escape from... any competent attorney would follow the chain of title, and try to dishonor all transactions, and would likely succeed. That is why he said... you cannot use a Living Trust for protection setup as this, epically for confidentiality . Unless you inherited the property... at which you would not want to put any property into another Living Trust when you transfer title from the Living Trust. Nor would you want to take the property into your name. I'm not exactly sure how you would do this transfer. You would want for sure to have some good Title Insurance on such a Transfer. And make sure you had no liens or encumbrances (or even potential ones) against you when you did such a transfer. Additionally, this would be a good time to use the UCC-1 to encumber the title after you do transfer it. As the first one who encumbers the property using UCC is likely the one who will get the asset or portion of the asset. You would want to really spend some time to go over a situation like this. I have had problems with transactions like this before.

I prefer to use a national bank where I have a personal account. You will need to provide your personal address when opening the account - do not try and use a WY address - unless you are in WY opening the account.

I recommended one house per LLC. The fact you do not live in WY or DE does not impair your ability to set up an LLC in either of these states. All you need is a resident agent and a local address. When we set up a WY or DE LLC we provide an address.

I get that question a lot. I use the program named Flow by moleskin. It can be found in the apple stroe and is made for the Ipad. I do not know if the company makes a similar program for windows.

Ok Question.When you Create your LLC to prevent your Assets from being Compromised. And your Personal Info used against you. Make sure you have a Registered state Agent. And label yourself as a Member of the Entity right ?

Great video! How do you select a manager for your manager managed LLC? Do you pick a friend or relative or can you list yourself as the manager? If listing yourself as the manager, does that completely negate your anonymity? Assuming yes but I'm not a lawyer :)

You would be the manager of your LLC. If you want anonymity then you will set it up as a member managed LLC. The member will be a WY LLC. You will me the manager and member of the WY LLC.

I have 3 partners, we have 1 (Wy LLC) taxed as a partnership for holdings and 2 local LLC's. 1 local for flips (taxed as s-corp) and 1 local for rentals (taxed as partnership) is it wise for all to have the same name with the ends different ie: brown holdings, brown investments, brown developments?

thanks for the video. So, a couple things. I'm going to be a landlord soon and will begin my real estate portfolio. I like the idea of anonymity, but what about if I'm running a website for the purpose of collecting applications, displaying real estate/rentals, etc and wanting to brand/market myself? Would I need to concern myself with anonymity in that case? or would I be able to still run a brand/logo on the front end but still be able to have anonymity? Or maybe I'm being too overly concerned about this since I'm just going to be starting? Any suggestions or thoughts?

I would avoid anonymity for the brand company and instead use it for the rentals that you own. Its kinda hard to maintain anonymity when you are trying to brand yourself.

My Wy LLC would hold (as the member of) my CA LLC. I would have bank accounts in both LLCs. I don't have a management company - I pay contractors directly. How (or who) would sign the checks that I write without defeating my anonymity?

Yes you would need to sign the checks because you are presumably the only signer on the LLC bank account. There is no way around this but why would you need anonymity with your contractors? Aren't you the one who is negotiating with them on behalf of your LLC?

@@ClintCoons Inside LLC protection. If somebody wanted to sue and subpoena the WY LLC nominee for owner information, the owner could never be found. I have a feeling there's an obvious contextual element that renders this approach impractical and I'm just not educated enough to recognize it.

The charging order is a remedy available to creditors of members in an LLC. The charging order (provided it is the exclusive remedy) prevents a personal creditor from reaching the assets of your LLC or forcing distributions.

Using the WY LLC Trustee solution, imagine the following scenario: tenant of 123 Main St Trust is injured. Tenant's lawyer checks county's records and finds that 123 Main St Trust has the WY LLC as Trustee. Lawyer digs a little deeper and sees that the same Trustee holds multiple properties. Won't the lawyer assume the trusts most likely have same beneficiary?

Attorney can assume anything and they typically do in my experience, but the trustee LLC is not the beneficiary of any of the trusts to that road leads nowhere.

What should a California resident do in this circumstance? ( I know, move) Someone is a qualified investor but an employee who has a plan to start investing as a limited partner in some private placements and doing some work with the goal of being a GP in the future. Should the person set up an LLC now? Is it worth the cost for tax and asset protection or should they wait? Can they write off education, travel and start up cost against their earned income from their day job ? What about depreciation, can that only be written off against earnings of one LLC and not income from a regular job as an employee? I can see your services worthwhile for someone who is established, but what about someone just getting started and moving from stocks to real estate investing in other people's deals?

"Provisions in the annual defense-policy legislation would require many U.S. companies to register their true owners-an attempt to discourage the use of anonymous shell companies for illicit means." "Publicly listed companies and many firms regulated by the federal government wouldn’t have to report. Nor would companies with more than 20 full-time employees, $5 million in annual sales and a physical place of business." I'm guessing most of us watching this don't have 20 full-time employees so there could be a serious impact to our efforts to remain anonymous.

so, the whole purpose is anonymity for land trust, but when you immediately resign, the "new trustee" needs to file deed that puts their name in public record again? lol whats the point of putting your name in first place if you are resigning and new person needs to be listed
