Antonin Scalia opinion District of Columbia v. Heller (Second Amendment) 2008

District of Columbia v. Heller, 554 U.S. 570 (2008), was a landmark decision of the US Supreme Court ruling that the Second Amendment to the United States Constitution protects an individual's right to keep and bear arms, unconnected with service in a militia, for traditionally lawful purposes, such as self-defense within the home, and that the District of Columbia's handgun ban and requirement that lawfully owned rifles and shotguns be kept "unloaded and disassembled or bound by a trigger lock" violated this guarantee.

his quoting from the miller decision should put an end to the whole 'assault weapon' argument, as semi-autos and more especially fully autos do have a direct connection to military service. there is no reason under miller that we the people shouldn't be armed identically to our current military

It's NOT Scalia's opinion, it's the opinion of the majority of the court! He just wrote the opinion for the court.

Of course, Thomas' Bruen decision is MUCH better -- and simpler. It's simply that the 2A means what it says (the right to keep and bear shall not be infringed), and that permissible limitations of that must be found in laws drawn during the founding period -- the period when the 2A was added to the constitution. It's direct, it's concise, and it's a sound bedrock.

So according to this decision, the right to keep and bear arms is NOT unlimited. 12:15 Justice Scalia references prohibitions against concealed carry which have been upheld, for example. 12:35 He continues with references to prohibition against felons and the mentally ill ownin12:15g firearms.

This is the foundational setup case that established the 2A as an individual federal right. McDonald v Chicago later expanded that right and directly applied it to State governments under the 14A. Then Bruen v NYSR&PA expanded the right further to "bear" outside the home consisted with the text, history, and tradition of this nation. So technically according to Bruen, Open Carry is legal in all 50 States. But States and Local governments are not complying with the court's decision.
