The Budapest Memorandum “Security Assurances” are existing written promises that U.S. President Clinton signed on Dec. 5, 1994 in Budapest, Hungary (where leaders from countries met for signing). Ukraine was given the impression they were going to be protected if they gave up their nuclear weapons (and also gave up the option to have nuclear weapons in the future!!!). Some legal experts today say the wording isn’t strong enough and should have been drafted as “Security Guarantees” instead. Others say the “Security Assurances” wording might be found supported in international court. As a humanitarian, the thing that matters most is that a nuclear-power nation (U.S.) should NEVER pressure a newly independent nation (Ukraine) to give up its nuclear weapons & the future option for nuclear weapons (especially given Ukraine’s location) unless the security protections promised in writing had substance. If legal trickery was used on Ukraine in 1994 or if they weren’t fully informed of the U.S. and/or international legal jargon, that’s not Ukraine’s fault, is it? Informed consent matters and if a country isn’t truly informed of what assurances vs. guarantees means for them down the road, then they haven’t really made an informed choice. According to Harvard Ukrainian scholar Mariana Budjeryn, Ukraine’s greatest concern at the time of signing the Budapest Memorandum was the fear of a Russian invasion in the future. That’s why Ukraine wanted a solid promise to be protected if they gave up their nuclear weapons and the option for such weapons in the future. Today, just look at the lost lives and physical destruction going on in Ukraine!! It sure seems some “do unto others as you’d have them do unto you” is the higher law that applies here.
