A high court judge has nothing to do with giving permission. It is a discretionary power of supreme court and yes, judges of supreme court can deny giving the permission.

Sir,clarify please special leave means that SC can put stay order on any judgement and give leave( time) to aggrieved person for appeal or file case in SC. !

It is called an SLP, special leave petition and if it is accepted, it is heard as an appeal and it basically comes under the appellate jurisdiction of the Hon’ble SC. If the SC accepts an SLP, it might in its discretion, stay the orders passed by the lower court.

@@manoflawin Sir in laxmikant, mostly it is given that if HC give certificate then you can appeal in SC. So can we say that this SLP widens the appellate jurisdiction enormously, even in cases where HC doesn't give certificate.

Exactly, for filing an SLP no such certificate is needed. Moreover, in certain cases an interim order passed by HC can also be challenged by means of SLP ( but the scope is limited here and doesn’t apply everywhere).

It will still be called a SLP and it is special leave to appeal in supreme court. Civil appeal is a different concept. Issuance of Notice means before granting the leave the Hon’ble court wants to hear the other party. Leave can be granted ex-parte or after issuance of notice.

As per RERA Act, where the real estate project is to be developed in phases, every such phase shall be considered a stand alone real estate project, and the promoter shall obtain registration under this Act for each phase separately.

It really depends upon the matter, you might get relief on first day or the case may go longer for a year or maybe more
