The following are the specified person (s) who are liable to deduct TDS: An Individual or an H.U.F. is not liable to deduct TDS on such payment except where the individual or H.U.F. is carrying on a business/profession where accounts are required to be audited u/s 44AB, in the immediately preceding financial year. A person is liable to get its accounts audited u/s 44AB if during the relevant financial year its gross sales, turnover or gross receipts exceeds Rs. 1 Crore in case of a business, or Rs. 50 lacs in case of a profession. Anirudh Bagai ACA, LLB sir you're partly correct, the TDS returns you mentioned are the ones under the IT act, which have to be filed by all tax audit persons be it a manufacturer, retailer, wholesaler or service provider. but here, the 12 TDS returns are under the GST act, which is applicable only for supply of goods/services above 2.5 lakhs and only for specific goods/services, yet to be notified. these two TDS return types are completely distinct, please don't merge them together.

Mr. Datar, you are perfect in telling the gathering of intellectuals that what the GST holds for them in future but nobody is bothered. The addition of 2 percent is simply baseless & idiotic. The most serious problem is in relation to exports where refunds replace exemption. The world is not foolish to work with exemptions under the aegis of WTO. Refunds are simply unworkable because they are a distortion, capital is very costly in this country, there is no free lunch & this gives bureaucracy a chance to hold the businesses to a ransom. It is rather unfortunate that no business leader has spine to call spade a spade & stop singing praises of the impending disaster. Last but not the least important is the missing infrastructure therefore the system without a trial run is going to create chaos & wreak a havoc because I believe nobody has a magic wand in the government.

The GST allows input tax credit across IGST, CGST and SGST. Thus a retailer selling bike can claim input credit and therefore lower prices and therefore higher consumption and GDP.

Both the opposition and the government agreed to each and every article of the GST. The Congress and the opposition were trying to get this tax reform on the floor from the past 10 years. The only problem with this tax is, that it is almost leak proof, so no hiding tax. That's the pain. The positive thing is that the near future it will reduce the burden of the salaried middle class class by expanding the tax net.

Mr Datar, small businesses were easily escaping the taxation and hoarded black money for decades. Now they are brought under the radar. Also till now the so called learned people of India never even bothered to look at restaurant bills where even Non-AC stinky hotels used to charge 15-20 % tax in the name of Service charge. Now they shouldnt do that. Its all transparent. Also this Govt made you aware of looking at the tax in your bill, which is a big achievement in itself.

CGST, SGST, TN adds entertainment tax on 4th July 2017 in addition to SGST. Maharashtra increase registration tax on 4th July in addition to SGST. so taxes in India after 1st July, CGST, SGST, entertainment Tax, Registration Tax, and any other tax the State government wants to add.

The saddest part of GST in India is that the baby formula is taxed at 18% while condoms are taxed at 5%. Dosa batter is taxed at 18% while pizza has a tax of 5%. What an anti national GST this is which prefers condoms over country's future and foreign fast food over Indian homemade meal.

Why petrol and diesel prices are not brought under GST. Now for petrol and diesel the central exise duty is 23% and state VAT is 34%. Total tax is 57%. If these essential products are brought under GST , the maximum tax will be only 28%, which means the prices of petrol and diesel can come down by almost 50%. The public at large will be benefited. Please spread this message .

I am astonished to hear this from Datar. He has clearly not understood what CST is all about, and so have the majority of commentators on this video. in essence, both you and Mr Datar have failed to see the bigger picture in the Indian context of simplyfying the tax, removing the bottlenecks in the transport of goods across the country, the elimination of corruption at these toll nakas and bringing a sense on oneness amongst Indians. I am on the winning side, you are on the losing side in this debate, live with it. And now that CST is operational, embrace it and move forward WITH the country.

Whatever i learnt about GST so far will solve many problems for businessmen doing business in Intrastate will eventually grow intrastate trading. There are problems of implementation and filling returns but not agreed with him totally.. Their might be initial hiccups but going farward it can be customised....5 slabs 0 to 28 % can easily be reduced to 3 but keeping grain and SUV in same tax slab cannot make a sense...tax evaders will never like it at all..

The economy is so down today, the reason can be easily connected to GST, its compliance issues, the government has gone thinking that the high rate would budget its expenses, what actually happened was that it reduced the demand so much that we are heading into recession...... Let Mukeshbhai (RIL) run the tax department, I am sure that he shall reduce rates and increase volume and remove compliance bottlenecks to spurt the economy back on track....

If India is not ready for GST.. I wonder was India ready for IT mid 1990 and look where is India today in IT.. On one side you appreciate idea of GST (single tax for multiple taxes) but you have problem with how govt is implementing GST in India (even after knowing the facts/complications that Mr. Datar stated like power of state and centre has on levying taxes) Don't be hypocrat either you appreciate GST or don't.. I don't understnd, this guy is saying 20 lakhs limit in service tax means, more companies will be created in different names, right now 10 lakhs is the limit, only now are there more companies being registered in different names, to be honest, with 20 lakhs limit, the creation of fake companies will come down!! Actually majority of small scale industries I know, are breathing a sigh of relief, for the exemption being increased from 10L to 20L!!

I 100% convinced by Mr. Datar. In my opinion State VAT Laws are not success and GST is nothing new but it is a Nationwide VAT. State VAT laws are unsuccessful in absence of proper infrastructure i.e. Computerization. Our view is, Center must go through the reasons of failure of State wide VAT system thereafter introduce GST.

49 returns in a year instead of 3 and all online! Name me one govt website, which has the server capability to handle that sort of traffic! His basis that GST only succeeds when there is one GST for one country is absolutely correct. What is the point of having new taxes when they do not simplify the taxation regime. As far as revenue leakages are concerned, believe you me, they will continue to happen. It is the inherent nature of taxation, you cannot change it.

Dats the problem with the India. People start to defend/oppose anything without knowing any ground realities. You are absolutely right, technology plays an important factor this time. Govt. has learned from previous technological shortcomings or failures and deployed excellent IT infrastructure required to run GST 24*7. This guy(Aravind Datar) is highly polarized and trying to enforce some political agenda towards the audience. Comparing Singapore/Aus GST's to India is totally absurd. The amount of direct taxes collected in these countries is way higher than we can ever imagine. If GST needs improvement it should be done but negating it totally is just a sign of immaturity.

Yup, lets call the expert 'polarised' because we do not agree with his totally valid comparison with GST being implemented in other countries! (Although the govt probably did heavy research into those countries' gst implementation but how dare he compare us with them!) As far as the amount of direct taxes collected is concerned, the quantity is immaterial!! Infact if I am to take the GST implementation in India, one of the reasons' the GOI wants it implemented is to increase the collection of direct taxes! So your rationale that GST in those countries is different and gets more direct taxes, while our GST is different because we do not get the same amount of direct taxes is flawed, because we precisely as a country, want to end up in a scenario where our collection of direct taxes is exponentially increased! As far as the IT infrastructure is concerned, we shall have to wait and see for the first couple of quarters after its implementation. But a govt. that still hasn't been able to cure the problems of its railway booking website during peak 'tatkaal' time, does not inspire much hope.

Nicely explained.. I have a question and i would like answer on it. Let me put up my question through an example to simplify it. I went to a hotel for a coffee. The rate was INR 40/-. This incident I want to explain is when the GST was implemented and the GST was 18% (9% local + 9% center). I got the bill of 40 + 7.20 = 47.20 total. I paid the bill at counter and asked how old was the menu card printed and the rate not being changed. I came to know it was about 2 yrs old. Now I want to understand that when that menu card was printed there was no GST implemented. But on products like coffee, sugar, milk there must be some sort of taxes like excise, VAT, octroi (where applicable). So the question that came to my mind was why the actual product rate never decrease as those taxes are now out and if GST has simplified and lessen the tax burden than that coffee rate should be like 30 to 35 and than 18% GST implemented. Still today I see the rates are same as before the GST and on top of that GST is implemented. When will the actual effect of GST come in play and which government body or sub-body is responsible and on the field to that and show the result in numbers.

Thanks sir .As for as middle class people any tax is hard on us,particularly charging GST on medicine, Mediclaim is terrible.On all senior citizens in Mediclaim already the amount is very heavy charged by all insurece companies.for example Apolomunich is charged actual amount health insurance is 22,000 appreciate for my wife aged 62 years for this GST is 4500 nearabot 40 percent. And service tax and all came to rs29,585.i normally advise my family instead have a RD account keep seperate for mediclaim.this will serve ourpupose if we won't fall sick atleast this money help us.but in Mediclaim all will go to the insurance company.we all Indian people's were created and we are very helpless.

In the present VAT, the Tax structure on a particular product differed from State to State, whereas under the GST the Tax is uniform of any particular product. There were any number of other Taxes levied b the State and Central Govts., Under the GST the uniform VAT rate and all other service taxes etc and duties have been consolidated oin the GST. The wisdom of the GST Council comprising of all Sates and the Centre has been challenged by the personal opinion of an individual... Comparing the GST of Singapore, a city State and the GST of India which has 29 States and the Central Government... The earlier UPA Govt at the Centre attempted but due to resistance of some State Govts, the GST could not be passed in the Parliament and the State Assemblies. Finally, during the present NDA Govt., all State Govts (comprising of various political parties) and the Centre (NDA) managed to pass the GST Bill.

Ladies and Gentlemen,GST is not online mode(like some comments).officials will calculate and impose these taxes,they implement it not a supercomputer.Officers only make sure retailers are abiding not those servers.the comments I read here lacks knowledge of rest of india from their livingroom.

Every big change of this magnitude will have resistance.. it's hard for people to accept change always.. it's tough for them to get out of their comfort zone and do things differently.. But let's get back to business here.. people who talking about poor implementation I assume are just looking at it in a very one dimensional way.. while I pity on such fellow citizens who assume themselves of being an experts on this subject at the same time I am also happy to hear them out.. as it just showcases that we are on the right track.. Uniformity in any shape or form can never be negative and if implementation of it is a concern for few then please step ahead and make it better rather than blabbering your thought process which doesn't help the country in any way.

True... GST doesn't concerned with Geographic conditions in India... Consumers should buy through OEMs and not through dealers at all... also many goods will be sold in plains and not in hill regions... example traders wont sell items in Thirumala and SabariMala and Pampa or in Badrinath and Kedarnath... rather sell items in Tirupathi plains, or in Pattanampitta or in Haridwar respectively...

The government has very well explained the taxation system to us. But have they explained us what the heck they are doing with the tax collected from us??? Is there really any improvement in the infrastructure, medicine, education system, even in our basic needs etc??? And what the heck is this cashless system?? What if our account is hacked??? Also has demonetisation done any good to us??? Why havent they given any account on what they have done with the black money collected??

some people deliberately don't want to change the inefficient and combursome tax system and they also don't have such enegry to understand the difference. some people are not made for change. That's why they make objection.

earlier customer paid tax on the cost for which tax is already paid in VAT. now it's twisted VAT and bluffing people.

in India paying tax will always be an issue. Tax is the basic earning for the government to rule, maintain a country. How much and how to tax will always be discussed as different perceptions play a role. There will be difference of opinion between government and others.

If a Government wants to raise revenue, tax the sources of wealth; not the average person with GST. Put a tax of 1 cent or 1 penny on every stock exchange transaction and watch the money flow in.

vadafone case gone in favour of govt. in high court.. the lawyer in supreme court out smart law. govt has all right to impose retrospective . India is for Indians and not for foreign company . whatever may be the law FDI will come as India is growing

he may b right wid certain points but the truth is some of d business entities are jst for the purpose of doing hawala dealings... these entities as under d pre GST scenario they ve to file the returns for twice or thrice a year, they gets ample amount of time to receive the unaccounted money from various sources show it as the revenue from sales contrary that the actual sales never took place and then again return that laundered money in white nd get commission on it. If 1 has to file a return in such a small window of time, then it wud become very difficult to launder the money as they ve to show the revenue generated from sales for a very short period of time and any uncertainty in the filed returns would alarm the agencies and then finding the abnormalities wud also be easier for them.. I myself only ve a pinch of knowledge abt taxes, but since I'm trying to get into d business world these r a very few things I got to know... please let me know if I'm right or wrong about it

Illuminating speech on the practical aspects. Alas! Neither Modi nor his Finance Minister can understand this. Modi is an economic zero, and Jaitley is minus. Modi is a maniac, he has got some hidden agenda and fixed ideas. The bureaucrats under them are having a cushy time. Now chartered accountants and consultants will have roaring business. But it is doubtful if even they can unravel the complications. India has not had a single sensible and really knowledgeable finance minister since Independence. Modi is really making misery in India!

What you said is right that total number of e-filing returns and TDS filing will increase. But, how many are paying taxes, how many are coming forward to pay. Leave this topic. What people do is they don't/never show they earnings and pay taxes. At the end of every year, they say that they didn't had any profits and they don't have to pay any taxes. Now, lets say they have to show and file your taxes, now if anyone is caught or interrogated they will get complete track of the business. Presenter is worried about number of e-filings. What might be the problem for presenter is people might have to show all earnings and file returns and TDS continuously, that people are not interested to save BM.

nice speech...but its just one point of view of talk... the present tax system couldn't successfully implement bcoz of diversity.. that's why GST is better option..
