This. Best comment. Needs a thousand likes.
@chachichochacorta85772 жыл бұрын
Here is the entire quote by Mason. “I ask, Who are the militia? They consist now of the whole people, except a few public officers. But I cannot say who will be the militia of the future day. If that paper on the table gets no alteration, the militia of the future day may not consist of all classes, high and low, and rich and poor; but they may be confined to the lower and middle classes of the people, granting exclusion to the higher classes of the people.” “Forty years ago, when the resolution of enslaving America was formed in Great Britain, the British Parliament was advised by an artful man, who was governor of Pennsylvania, to disarm the people; that it was the best and most effectual way to enslave them; but that they should not do it openly, but weaken them, and let them sink gradually, by totally disusing and neglecting the militia. […] This was a most iniquitous project. Why should we not provide against the danger of having our militia, our real and natural armed strength, destroyed? The general government ought, at the same time, to have some such power. But we need not give them power to abolish our militia. If they neglect to arm them, and prescribe proper discipline, they will be of no use. I am not acquainted with the military profession. I beg to be excused for any errors I may commit with respect to it. But I stand on the general principles of freedom, whereon I dare to meet any one. I wish that, in case the general government should neglect to arm and discipline the militia, there should be an express declaration that the state governments might arm and discipline them. With this single exception, I would agree to this part, as I am conscious the government ought to have the power.” Virginia Ratifying Convention, June 14, 1788

Source, "James Madison: A Life Reconsidered" by Lynne Cheney. Original text by Madison that makes his intent clear: "The right of the people to keep and bear arms shall not be infringed; a well armed and well regulated militia being the best security of a free country: but no person religiously scrupulous of bearing arms shall be compelled to render military service in person." For all the people that want to focus on "a well regulated militia" when the founders penned that line they were succeeding from the rule of Britain and made it clear that it was each person's right and their obligation as Americans to keep and bear arms so that the PEOPLE were the ones in control of the destiny of the country, not the government or any potential foreign ruler. Militia refers to the minute men and others who would take up arms against the tyrannical oppression of the ruling class of Britain. Having this unalienable right bestowed upon EVERY citizen of the country would forever guarantee that the true power of the country would forever remain in the hands of the people. Look into our history understand who the founders were and what they were fleeing when they formed this new world. Understand what they knew and what they were ensuring by providing these rights to the people. Us, the people.

right, and i feel the whole thing is out-dated and obsolete. It might have been right in those days, but we are not too worried about england these days...the threat now is the crazy people with automatic guns.....time to change that right, or ammend it...I am sure the founding fathers would agree too.
@albertgaspar6272 жыл бұрын
except...not really at all. The folks who said "all men are created equal" owned slaves, so they didn't want ALL people to have rights, just certain people. And of course the Second Amendment doesn't mention ALL men, nor women. Does that mean women can't be armed? If we agree there's wiggle room in that simple problem, then there's wiggle room everywhere--what is labeled a "slippery slope". As far as the founders coming from secession, no, they were coming from a prior form of government--the Articles of Confederation. You learned about this in school--america's first government after the war was the Continental Congress, our first president was Samuel Huntington of Scotland CT, and this decentralized government ran into a problem. the problem was it couldn't raise funds for the Continental Army, which was a standing army that became the Legion of United States (so the founding fathers didn't fear a standing army at all, but they had little respect for militias--Thomas Paine spoke of the winter and summer soldiers, a reference to militiamen who abandoned Washington nightly during Valley Forge so only the Continental Army remained) to fight against Shay's Rebellion. what was Shay's Rebellion? It was armed vets in MA rising up with their own militia, and Samuel Adams declared these (not well regulated) militiamen should be jailed. the Founding Fathers met in the nation's capital (Philadelphia PA) charged with upgrading the Articles of Confederation. Instead the 1% threw out the government and formed a new one with a general as president (in some nations, we label this a coup) and wrote the Federal papers under psuedonyms to convince the 13 former colonies to accept the change. so what was a militia even for if there was a standing army in existance? Alexander Hamilton explains it in Fed # 29. The states didn't have a state police force nor SWAT team to handle slave uprisings, militia groups, native american attacks (folks still remembered King Phillip's War) and so the militia filled the gap. The Second Amendment mentions the security of a free state, and that meant "state", not national government. The Founding Fathers, like the wealthy of today, certainly didn't want the hoi polloi to take charge of things ! why do you think there is an electoral college to dilute the will of the majority? why did James Madison warn about the threat of the minority voice taking power ? Why did Thomas Jefferson become the type of leader he said should water the tree of Liberty once he became president? The Second Amendment clearly states a well regulated militia is necessary for a state's security and should not be infringed--the Constitution was defining what was government power and what was state power. to that end, guns are needed for the milita--but only a well-regulated one. if we ever think property owners want armed folks running around DC on Jan 6 or in the streets of Fergeson MI then we truly don't understand the Founding Fathers, who didn't agree well even with each other. But then, some love the Fed bank and fiat currency in their pocket--another creation of the FF to protect their wealth but no boon to the people. finally, the 1903 Militia Act clearly defines what constitutes a well regulated militia--the National Guard. According to the Constitution, so long as a law from Congress is not challenged by the Supreme Court, that law is constitutionally valid, and so the 1903 Militia Act clearly defines who is the militia (and the National Guard tends to lock up their weapons in an armory, not let soldiers take 'em home). that's why the Second Amendment was always a state right until 2008 when a black man entered the white house (coincidence) and Ronald Wilson Reagan could take the Milford Act from a Republican, and sign it into law--a law saying the people of CA couldn't carry their guns in public without a permit. The NRA backed this law, since it was aimed at Black Panthers. Guv Reagan would of course become President Reagan, a Republican most don't associate with gun-grabbing. then again, most Republicans didn't say boo when Trump took away their bumpstocks--guess its only when Democrats do something, its wrong :) but i digress.

The "well-regulated militia" identified in the 2nd Amendment is we the people. The reason the 2nd Amendment was written so was to insure that every citizen of the United States had the means by which they could take up arms against a tyrannical government if need be. Nobody wants to talk about that, but in the simplest form that was the reason. The last part about "shall not be infringed" was to keep it that way. Note that the phrase "shall not be infringed" is contained in none of the other amendments to the Constitution and for a reason. So in essence you are correct.
