We did a title search on a bank owned property and a federal tax lien came back in the old owners name. How do we clear that one so we can close ?

The easiest way to clear a federal tax lien is to pay it… if you don’t want to pay it, then research and see if it is one of the federal liens that automatically drops off the property if there is a tax auction. I am not giving you legal advice, I am not an attorney, real estate agent, or CPA.

You will want to check the county rules or the state statutes to find out the exact process for the particular county you are working in before bidding at an auction so you are aware of the rules and processes for that county. In most cases, the foreclosure must be initiated by the tax lien certificate holder. The county may also specify the steps you need to take to make the foreclosure process comply with the state statutes.
