Thanks Joel for explaining this. We lived close to the rspb woodland "Broadwater Warren" and there you can't even walk a dog of its lead from March because of ground nesting birds and the potential damage the dog will cause to the birds ....so chuffing through the woodland with tree fellers and trucks during March is outrageous 😳

Thank you - I love the term "chuffing through the woods", that did make me snigger! Not good to hear about your experiences but they seem to reflect not only my own but a lot of others here too. It's so good to know that there are a high number of concerned people though and I'll certainly be contacting the Forestry Commission tomorrow and quoting their own rules about what's allowed and what isn't! Will keep everyone updated of course - best wishes, Joel

This happened in the woods in our village. It was heartbreaking to watch a bulldozer force paths through the woods. A friend and I challenged a surveyor about the destruction. He was sympathetic but that was it!!! The people who work for these companies have no understanding of the way nature works and are not interested. The ruts in our woods have destroyed bluebells and daffodils and the woodland management cannot see what we are making a fuss about. In the village we cannot touch a tree in our gardens because of the impact it may have on the local amenity, we have to get planning permission!! A local farmer is ripping out hedgerows at present and just leaving stumps instead of layering but if challenged accuses us Of not wanting change and it his his land and he can do what he likes!!!! I am a farmers daughter and have a lot of sympathy with the rural economy but do feel it could all be handled better. Thank you for being a voice in the wind!!

@@WildYourGardenWithJoelAshton good luck. I feel a lot of people who work the machinery to-day have little or no understanding of the environment they are working in. So long as they have a licence to drive the machinery they are totally divorced from the surroundings they work in and actually have no interest either. They are only interested in what the machinery does and not how it can be harnessed for the good of humans and nature.

@@helenyoung8012 Thanks Helen, totally agree here - I remember an Estate that used a very bulky and "built for the job" horse to take away logs... within a few minutes on Twitter people were complaining that it was "slave labour" for the horse, when it actually had decent exercise, an obviously caring caretaker and had a purpose in life, rather than lingering in a field! Oh boy....

Good vid and thanks for posting. I am going to say a few things. 1) Forgive me if I am wrong, but I always understood that Forestry Commission woodlands are owned by the nation. Their prime purpose is timber production, the impetus for which was generated by timber shortage in WW1 and WW2. However, the law is as it is and the Commissioners and their appointed officers and contractors should not be above the law. 2) Many former FC woodlands have been sold into private ownership in recent decades. 3) Use of contractors by the FC and the argument that the work must be done but the contractors are not available so the work has to go on into ‘bird nesting season’ is spurious. FC used to employ in-house felling teams. 4) On clay or wet soils the best time to work is as soon after leaf-fall as possible in the Autumn. 5) Presumably this is planned work? Why not plan it to take place in smaller lots spread over a longer period? ‘Economic efficiency’ is fine if you’re making buttons in a factory, but does not wash in this context - the ‘bird nesting thing’ again and, in any case, using ‘economic efficiency’ as an excuse to override other concerns smacks of small-minded lack of understanding of real issues. Smaller lots over a long period make it easier to book your contractor well in advance, so as to fit it all in at the best time - see 3 and 4. Smaller lots promotes habitat heterogeneity, therefore species diversity. 6) Good points about ash dieback. Concern about the future of ash is warranted and in many areas this has taken the form of felling out ash trees. There is an argument to be had whether this is warranted, especially when the felling works are heavy-handed. Felling-out in a vain effort to ‘control’ the spread of the disease is just what happened with Dutch Elm disease in the ‘70s, several conifer blights (ongoing) and will happen with other introduced plant pathogens in future. When is our government going to get its head out of its arse and give us a chance of preventing this in future by adopting proper phytosanitary practises? Oz and Kiwi models please! 7) Appropriate cultivation of the stacking routes taken by the forwarders parallel to the main rides would work, but woud be extra cost, would not help ancient woodland indictor plant species, but would be good for emphemerals and ruderals - good nectar sources. Any seeding would need to be well -planned and use locally-produced seed. Competent forward planning needed.Usually the forwarder travels the main ride when stacking to limit compaction issues... 8) Brash mats on extraction routes works a treat but costs money. I could tell you about them, but I’ve already written a book here! Shutting up now....

THIS is why you deserve all the praise and thanks you get, Joel. Your passion and empathy for wildlife is second to none. I watched your follow-up video, and your letter is spot on. I fully believe responsible forestry practices are attainable, and a must, and you have done a great job on not attacking the necessity. I just wish they would adhere to their own rules. One law for them, another law for us…. it’s sickening. It’s not much better here in the States. The workers do what the bosses tell them, and either don’t care, or don’t want to lose their jobs. Enjoy your ash trees while you can. The neighborhood I grew up in, and live in again, lost most of our tree canopy due to the emerald ash borer in the late 2000’s, early 2010’s. Thousands of trees lost in just a few square miles. There are very few old growth, tall trees anymore. Even worse, the city pushed the planting of invasive Bradford Pear trees, which also are weak, don’t get very tall, and spread like wild fire (and although pretty when in bloom, the smell is atrocious). Seriously though, THANK YOU for being such a good steward for our wildlife, our environment, and for our planet. You are a real life Lorax. You use the platform of your channel well, and with the utmost integrity. The world needs more people like you, and through your works, you are helping make that happen. Thank you, thank you, thank you. I pray the people in power to make the right decisions regarding you rightful plea and complaint. All the best, John

Hey John - I may well copy your message and save it for the next time I'm feeling low, to read your kind words and support has left me buoyed and not feeling that this might be a lost cause. I am determined to get answers, I am determined to highlight this to as many people as possible so these practices can no longer be ignored nor people left feeling helpless in trying to object to these issues they see around them too. From the comments so far it seems (and I obviously already knew) that this is not an isolated incident, nor is it confined to the UK. I was saying to someone earlier that we are geared to "panic" and take action regarding devastating loss in places such as the Amazon (and rightly so) but in the meantime all these other places are suffering destruction and loss and these added together must surely match that of the losses in the Amazon and similar places. I do wonder whether one day, people like us that make suitable habitats in our own gardens will be swarmed and almost over-run with creatures that are desperately trying to find habitat that they are losing daily and, of course, even as I type this to you. Again, I can't convey really how fantastic people have been here in this wonderful community we have built through this channel and I hope it continues to grow - the support from everyone has been priceless. Thank you, again, so much. I will keep everyone updated on this. Best wishes, as always - Joel

I'm a self-employed wildlife gardener and I don't do any tree work or hedge work during the breeding season. When you explain to a client why they get it. If you look on KZbin, it's a wash with gardeners cutting hedges in season. Many years ago, I worked for an arborist who suggested that cutting into a collared doves nest was ok because they were on the general licence. After explaining he was wrong and going to break the law, he still went ahead. I walked off the job and never worked for that monkey again. The problem is, they know they won't get prosecuted. If the law stated, such tasks couldn't be undertaken during nesting season, would this be the answer?
@WildYourGardenWithJoelAshton

I've experienced this too Adam, even with a neighbour who, knowing the young were in the nest decided to cut the tree down when I was on holiday! They will then go on to plead ignorance and I was advised "yeah, but doves nest all year round, so when to do it?" - maybe when a nest isn't actually VISIBLE and you've not been advised that young are there? All perished apparently after a half-hearted "make do" nest was quickly attempted to leave them in, expecting the parents to balance precariously on what was left and to watch their efforts perish. I am writing to the Forestry Commission and other bodies tomorrow Adam and I'll be sure to keep everyone updated. Thanks for your support and letting others know of your experience, it's appreciated - best wishes, Joel

Joel I live in Ireland (North East) and follow your you tube demonstration with joy. Naturally this one illustrates the blatent breaches of law by authorities that do know better but choose not to comply. We have, sadly, exactly the same here. I am currently actioning a high court Judicial Review against out local Council our transport authority and our national government planning authority for sanctioning a road through peatland, removing 2 Miles long of native hedge without any environmental impact assessment. And your so right to highlight these matters in your you tube. Someone has to give voice to nature. We coexist and need to respect nature in all its forms. Thank you I find you deeply inspiring. Hey Mark, it certainly is - I've emailed the FC this morning, along with other relevant bodies that should be more than concerned at this and have the "brawn" to make this halt whilst a proper assessment is made. From people's comments here and on my social media pages it is clear that it's happening at an alarming rate. We think about the destruction of the Amazon (and rightly so) but meanwhile there is a lot of individual acts like this that when added together no doubt match the size of the Amazon and the impact it's having. Thanks so much for posting this and getting the message out there Joel. I live in Aldershot and walk my dog in a nearby woodland which is semi-ancient. Teeming with wildlife and birds and a real haven. Recently there have been new build developments popping up all over the area and last week I was shocked to see contractors completely obliterating a large area of trees and scrub which I have seen tits building nests in with my own eyes. They drove in a chipper and have just left branches and even used coffee cups all over the site. I’ll definitely be using your email in the latest update to contact my local council. Can’t believe this is happening at such a crucial time of year for nesting birds. Makes me very angry!

So true, Joel. Same here. at a nearby forest, our "environmental protection agency" decided that the huge forest needed to be cleaned up of old trees to allow new growth to help the birds. So they cut down acres of old-growth trees and dead trees. Dead tree and old growth are needed for woodpeckers, owls, raccoons, squirrels, and MANY other cavity-dwelling creatures here. They destroyed the beautiful forest in the process.....Then we found out the truth...that they were making lots of money on logging! Makes me so angry!

So awful to read this, but your comment is important in showing that this is happening everywhere, not on a major scale such as the Amazon of course but with all these little trickle-incidents they sure make up for the same collateral damage when added together. I have just finished filming another short video with updates on what I've done about this so far and hopefully it will give people the confidence to shout for nature and help in areas that are of great concern to them too. Hi Joel, sadly this is becoming more and more common. We have little to do with FC woodland but we see a similar pattern of destruction during nesting season by developers (and their contractors that 100% know well they should not be doing it!) almost on a daily level this time of year. As always we report to both the Police and the Council Planning Department and in most cases, it falls on deaf ears. The Police have a rural crime unit, however, there is little or no impetus to uphold the law in regard to wildlife crime. I would also say that FC is not alone in not practising what they preach, NE and other government bodies are just as bad. Keep up the great work and keep the updates coming please we are watching with interest!

Hi there - thank you so much for this, you may not have seen the latest quick video from last night giving an update so far, but I'll certainly be bringing more info and updates to everyone here, and that includes those that I receive responses from, those that I don't and of course those that are indifferent! It's awful to hear of this developer destruction and, as you say, they know they are doing it but because there is little legal action that anyone takes, they continue. This reminds me of several large developers that knowingly cut down trees that they were strictly instructed not to, through tree preservation orders etc. They do this in the knowledge that any fine or consequence is far outweighed by the profits made in these developments. I really do appreciate your support and if you see the comments below this video and of the update from last night, you will be comforted in the fact you're not alone. Best wishes - Joel

Hi Joel. I really don't know what to say. This is heartbreaking. I'm no expert on woodland management, and I understand trees need to be felled at times, but it saddens me deeply when they are. Then there's the timing of it. The lack of consideration to wildlife. Those bluebells being destroyed is a bloody crime. The legislation being ignored. One rule for one and another rule for others. When I was in "the job" I was pulled by a colleague in traffic and ended up with 3 points and a fine. I was guilty. My colleague quite rightly didn't turn a blind eye. And that's the problem here. People in positions turning a blind eye. This world we live in, a consumer world. Basically if it comes to money or profit then they'd make their own grandmother homeless. Nothing comes before the pound sign it would seem at times, the whole thing sickens me. Those birds are being disturbed and distressed without doubt. As if I wasn't feeling bad enough my heart sank even deeper when I noticed the badger sett before you mentioned it. The heavy vehicles have caused so much damage. What takes decades for nature to create can be destroyed in a single afternoon. Absolutely heartbreaking.

A very interesting and disturbing video at the same time, Joel. I don't know I would be qualified to even comment on an issue as complex as this especially with your laws being so drastically different (and tougher in many ways) than ours. Although we have our own national forestry management acts , the debates over habitat protection management vs sustainable logging management are well alive in our neck of the woods when it comes to conservation and logging as well. As you aptly put it, common sense (and law by default) should prevail when it comes to legal logging timeframes especially if it is known to interfere with the natural breeding cycle of many species that may inhabit a managed logging area. Why not log when there is minimal disruptions to fauna and flora such as during late Autumn when most wildlife and flora are likely to be less impacted? Commercial interest probably, blatant disregard for the law more likely by the looks of it. I hope you do get that message through to the power that be. Take care and good job in documenting this👍.

there are easy fixes to the problems you point out. move all nest boxes the year before felling. fell the trees in a way that needs minimal ground disturbance to collect the timber and makes dedicated brash piles, which will become useful habitat once the brambles grow through it. the blue bells will recover quickly if the ground is not cut up by heavy equipment on wet ground. fell smaller areas patch work to leave enough habitat for wildlife.

I've seen an awful lot of felling since the winds along the roadside in particular - I get it BUT it seems like 'they' are using it as an excuse to fell to avoid future maintenance. A local business person who recently purchased a business park cut down all the established trees for absolutely no reason. I believe your voice will make an incredible difference because once people have the knowledge they then have to question their beliefs and values as to whether they can participate in any active role where actions like this are happening. Hi Joel Can I just say thank you so much for making this and bringing your own professional and personal experience to educate and inform and to highlight it’s not just about the one or two trees, but the surrounding area and floor cover that is also impacted which is forgotten about. I am a final year Environmental Science student hoping to work in ecology and environmental management for wildlife conservation and I notice this too elsewhere. What can we do to stop this? Who can we take this info to who will really care to enforce standards and the law? I wish this kind of thing could be aired prime time or brought to wider attention the way Blue Planet did for plastic issues. I used to live in Plymouth and the council have recently taken down under cover of darkness a load of old established trees this time from a urban environment in a bid to “make it greener” it’s madness! As I have an interest in ecological surveying and consultancy, I wonder if an independent detailed survey was done to assess the ecological impact as a whole as you say at particular times of year. A good few years ago there was a documentary where a man bought a patch of woodland and used traditional methods to turn it into a profitable and ecologically diverse woodland harvesting timber using pigs/wild boar to turn the soil to aerate and reduce impaction and horse and cart. Yes, hard work but still make a profit, helped the woodland into better health and provided employment while using low impact methods how I wish we could at least use a mixture of methods to reduce this kind of destruction. Would love to know your thoughts on maybe bringing this to the attention of the forestry commission or authorities, especially as spring and nesting seasons seem to be having to change in response to a changing climate too. All the very best 👍🏻

It's so frustrating when there ARE laws and regulations but they are still not being followed or not followed properly!! There used to be a forest behind my parents' house that had a beautiful, magical, natural pond. It was about 30x7 metres and between 3 dm and 1 m deep throughout the year. Then perhaps 8 years ago or so, the land owners decided to cut it. They saved some trees around the pond, 1-2 metres from the pond edge, probably thinking they did a great job protecting that habitat. But then they cut down all the other trees in the whole area. Apart from the obvious problem of making the whole forest into a complete wasteland, the problem for the pond was, of course, that the pond needed many, many more trees to sustain that amount of water, especially throughout the summer and it dried up pretty quickly. There were still a little bit of water in the pond during the early spring after that, but nothing during the summer. It was devastating to see! Such a lack of understanding of how the nature actually works! I really wish that the people who work with forestry would protect the nature more!

How absolutely awful to read, I am so glad you shared this though, it shows that it's not just in the UK that this is happening - I fret that in a while we will all have most of the wildlife cowering in our own greenspaces when they are made homeless from the land that is naturally theirs, they have to fight daily and it's not like we're not aware of the destruction in places like the Amazon, and yet under our noses it's happening worldwide on a smaller scale. Not only is it bizarre that the Forestry Commission, but it's entirely unnecessary to make so much mess after felling. Close to me is a woodland that is managed throughout the year, the company using horses to draw the trees out of the woods. I daresay they don't make anything like as large a profit out of woodland management as the FC, but it's obviously good enough to keep the company interested in continuing this project. Furthermore, it always remains a lovely woodland. While it doesn't invite the public to walk around (and I certainly wouldn't walk around it while their vans or cars are in the car park, I do have a look about when it's all quiet. It's tidy, varied, the ground always nice and level except for the inevitable drainage ditches. The life in this place is amazing: birds, butterflies, trees, right down to orchids - however, I have seen the latter uprooted en masse by the Forestry Commission when felling another woodland 40 miles away. The wilful destruction of orchids is as bad as disturbing wild fauna in Spring, in my estimation. I saw one tree physically pulled down by a machine, which tipped the root plate over, taking with it 3 species of orchid (including Pyramid Orchid). If I try to rescue these orchids - I'm breaking the law! But the same doesn't apply to the FC for lifting them out of the ground in the first place and letting them die as the root plate dries. There is so much to be angry about when it comes to the way woodlands are being felled in this country. The evident lack of consideration exhibited by so many tree-fellers (I've already experienced the lack of knowledge some of them have for myself) is appalling. While it's disappointing that the wildlife officers in the police Service haven't been able to help, have you tried contacting the RSPB? I'd have thought that they might have dealings with this kind of thing before and the police may feel they have a better degree of backing if they have the assistance of a society with more specialised knowledge.

I am not exaggerating here but every day I am contacted by someone or a small group of people that are trying to stop ancient trees being felled, vast areas that contain a few "suspect" Ash dieback etc, however they're taking out EVERY Ash tree - so no chances of any immunity building :/ I understand felling if it's due to DANGER to people etc, but more often than not, it's not at all that. Hi Joel Yes it’s infuriating seeing this type of totally ignorant destruction in the UK in 2022! It should only be allowed from September to February with less destructive machinery used in deciduous woods. The areas around Thetford Forest near me are managed by the same people but they do have sensitive areas that are ‘non intervention’ which you may want to bring to the attention of Bourne Wood managers? I feel like you have provided the answer to your own question with the legislation at the end of your video. “Make sure that the work is planned to ensure protected species are not intentionally harmed or killed; that their nests or dwellings are not damaged or destroyed…” Now I’m not saying I agree or disagree with the operational practices being carried out at Bourne woods but the FC, as you have documented, have clearly not marked nesting box trees and other highly likely habitat trees for felling. They are also not felling over the badger sets. I think your discussion is more in the realm of what is best practice rather than illegal working. A good document to research on is the UK Forestry Standard which all Forestry Commission forests are managed in accordance with. You will find a mixture of legal conditions and best practices with the UKFS. Finally, I’m sure we can all agree that Low Impact Silvicultural Systems (LISS) would be preferred but unfortunately economics play a big part in forest management which means the majority of harvesting is carried out using large scale machinery over a big area. Interested to see/ hear what, if any, reply you receive back from the FC.

Our parish council thinks it's a good idea to use our nature reserve as a willow farm. Had to stop them from burning a massive pile of brash in winter as we are a hedgehog hotspot and they probably were using it to hibernate. The guy I spoke to at the cricket bat company had no clue at all about the harm they could be doing to wildlife, which explains why they are today harvesting the willow on their plot next to the nature reserve and burning the brash mid-April. We live next to the nature reserve and there are so many birds coming into our garden collecting food for the young so there is no way the willow works are not disturbing nesting birds as it's a very sensitive area next to a river. Makes me angry. Laws need to be tightened and followed through.

This makes me so sad and very angry. I'm an unashamed tree hugger, I do understand forestry management, but over the years I've seen this happen far too often. Wyre forest, Cannock chase, Loynton Moss to name a couple. Wildlife is not a consideration for the Forestry commission, It's just about money. This year we have lost thousands of trees in the storms and to take more is going to have a huge impact in future years on the fauna and flora that rely on these habitats. We took the grandchildren to Loynton woods last weekend and basically its gone. Cut down. Even a six and three year old were shocked. These were old trees. It makes me more angry when we're told they're planting more trees. That's great for birds and wildlife in fifty years when the trees are grown and can support birds etc again but what about the time inbetween. Sorry to rant guys but I'm sure you all feel the same. Forestry Commission is an arm of the government and as evidenced by the HS2 route, this government has no respect or interest in healthy woodlands in general or ancient woodlands or habitat & wildlife. This woodland is a sad example of such policies and the easement of regs. Harvesters & forwarders are like airplanes, if they’re not working, they’re losing money. So contractors gain a licence based on tonnage or cut-blocks and they don’t stop till the contract has been fulfilled. The devastation left in their wake, will take many years to repair and may well be over populated with birch and alder in the first instance. But existing fauna & flora pay the highest price for such practices. I sort of understand about the ash, though as you, I disagree with the timing. I presume the ash are being felled and extracted due to dieback. It’s a sad situation, that if just one tree is identified as having dieback. The landowner is then obliged to fell every ash within the same woodland. From my understanding, the timber may then be either extracted or left in place but the smallest brash and particularly leaf matter must not be removed, as the fungus is maintained in leaf litter through the autumn and winter. The spores being most widely spread during June through October inclusive, may be part of the reason, why the felling is being rushed through at this time. Though it is still a poor choice of timing, given the other prevailing habitat and it being nesting season.

Absolutely disgusting. Thanks for bringing this to our attention. Thing is what can we do about it? Isn't it this simple - we just show your video to the RSPB & they will also be outraged ( because they are for protecting birds arn't they?? ) & they will decide to prosecute the Forestry Commission ? Why oh why wouldn't they? Please tell me that ' yes ' its really is that simple.

Love this Heather, some great points! I am emailing the relevant person at Forestry Commission in the morning, now I've collated the evidence and I'll also be contacting the RSPB (who rely on the public money, legacies etc) and also the Woodland Trust, they should be mightily concerned, shouldn't they?... I'll keep everyone updated - best wishes, Joel

One of the lowest counties in the EU with tree cover, around 10% I believe, we should be very ashamed of this.

Absolutely! Very ashamed indeed. It's so important that we keep trying to make our own green spaces hospitable for creatures desperately in need right now - but I wish our governments would feel the same. Best wishes to you, Joel

Hi, hard to watch this. Since Kaczyński Party is ruling here in Poland we have a big problem with illegal wood harvesting, without even a yearly plan approval (so they just cut, whatever they want). They basicly privatized the public forests. They sell future of our children to china for big money, and it goes for chopsticks. I'm not exaggerating, this was proven by independent journalists. We can rebuild democracy, we can rebuild trust for the police, we can clean the court system of fake-ass political nominees, but the forests could never regrow for my son, the way I had to enjoy them. I'm with all of you, love.

So good to hear from you Marek, but so sad to read this and I completely recognise the problem that you are facing in your country - so much wildlife in Poland and natural areas and yet it seems the same destruction is taking place with voracity. You make some excellent points here - hope to see you in your home country next year and we can document this together, plus all of the fantastic work you are doing and the issues you are trying to highlight - best wishes to you and yours, as always, Joel

It seems this way Viviana, I'm hoping I can get to the bottom of it, and more importantly halt these works for the moment when this time of year is so important for not only the birds but other creatures too - thank you - best wishes, Joel

Before making such "documentaries" it would be sensible to have some understanding of wildlife legislation - in particular the Wildlife and Countryside Act 1981. You labour the illegality of disturbance to breeding birds. The act of disturbance only relates to those species listed in Schedule 1 of the Act. For the species you were referring to, the legal liability refers to damage or destruction of nests while in use. It might also be useful, and fair, to speak to FC before assuming they have not done their pre-felling checks and implemented mitigation measures.

Hi John, thank you for this. According to Natural England who monitor the Forestry Commission their advice is "All wild bird species, their eggs and nests are protected by law. You must always try to avoid harming birds or to use measures which do not kill or injure them before considering taking harmful action. In most cases you should be able to avoid harming wild birds by: *timing your work to avoid the breeding season* using a range of methods that deter but don’t harm them I saw no evidence that the Forestry Commission had timed these works to avoid the breeding season, at least from March until August and therefore harming bird breeding and likely egg-sitting. I have already contacted the FC and have received a response, which I found to be vague and I and others have advised them so - I will be updating everyone with their response and my own regarding avoiding this season and not only the disturbance to these birds, but also destruction of vital food sources for butterfly caterpillars, two species that rely solely on two species of tree in that wood for survival. I'll update shortly, showing both sides as I clearly demonstrated in the video. Many thanks, best wishes - Joel

Does the Forestry Commission have Crown Immunity? If so they're not doing anything wrong. If they haven't they must obey the same laws as everyone else.

Thanks for this, as far as I know, and I do need to find time to research this in more length, the Forestry Commission does form part of Operational Crown Land, and they are exempt from some planning issues. However, I guess it's the same as if a member of the Royal Family or Government were caught shooting down a Goshawk or kicking a Nightingale nest to bits, it's still illegal in that respect and it would rightly cause public outrage. My issue is their practices and thoughtlessness during nesting season. Thanks for highlighting this though, I'm certainly investigating it, along with a few other bodies :) Best wishes, Joel
