This. This right here is why I really enjoy watching your videos and opinions on matters such as ASA. You don't buy into the empty promises they spew out in order tell the players that "this time! This time we will actually release a good, well polished product that will be amazing". You don't bury your head in the sand and tell everyone "the game will be great, just look at all the things we will get", and overhype a non-released game to the high heavens. You look at the cold, hard facts and just give it to us straigh as it is. Even if it's not what we fans want to hear at least you're being honest about what Snail Games are actually up to. Not sure, my feeling was the release date and the private/community server clauses were separate events. Not that I would put it past Snail Gate to try to kill off SE. If they do, I really hope everyone in the community boycotts future products; not only as a lesson to Snail Games and Nitrado, but to game studios at large that we can refund they shotty practices by keeping our wallets closed. We the community and customers have the power here, simply stop giving bad companies money.

I don't understand why no one is picking up that this contract is Nitrado taking over server administration, not just rights to host them. They're also not stopping community servers, they're just making it so they get the profits directly from leasing the rights to host servers. Whatever company you rent from will still be able to host servers if they sign a new contract with Nitrado and Snail has no say in the matter.

Didn't Studio Wildcard/Snail Games say that Ark SA wouldn't be available for pre-order, pre-download, nor would you be able to load the game before the scheduled release date? This practically 100% confirms that they plan on extending the release date to extort everyone involved, whereas if they did make it available for pre-order and downloadable before its release date, it would HAVE to drop on that specified date. I've played Ark SE for well over 2000 hours since 2016, met one of my closest friends on a random official server, and have sooooo many memories with the game as a whole. It truly does make me inexplicably angry that this game is on track to basically be destroyed by a company/person who wants nothing more than to fill their pockets, even with the intent to rob its playerbase and truly screw over a game development company that has so much love and compassion for its game/players. I can only hope that Studio Wildcard takes a risk and gets rid of Snail Games, no matter the repercussions. Ark SE is easily one of my favorite and most memorable games, but if this continues, I won't be getting Ark SA, even knowing that my one decision won't even scratch the surface of Snail Games' greed. Snail owns Wildcard in a roundabout way, so they can (unfortunately) do whatever they want. Wildcard's parent company is SDE Inc, which is owned by the wife of the Snail CEO. Technically SDE licenses Ark to Snail USA as distributor, but it just seems like a way to move money around. The only way out is if the developers leave and start a new company.. 🤷‍♂️

In my personal opinion, ASA even costing us any money is a scummy decision. I believe ASA will 100% be worth the money we pay and devs need money to run their game and ASA will be very different from Ark. But it's still very wrong to make your community buy a game they already have. I love ark and have played it for years. I stopped playing in April when all this crap started and as of right now I have no intention of ever playing again unless snail games no longer have anything to do with the game. I have thought of playing on a private server a few times since April as I miss ark a lot but trying to find one I like is hard. I can't even play asa if I wanted to as I will not buy a $500 game system to play one game when my PS4 works just fine. I love how you said everything at the end of the video as I am already there and I know many who are on the fence. If ase is fully killed like this it would be the exact push many of my friends would need to never touch ark again.

You are probably that person that buys every new system as soon as it drops just tossing your money away like it is nothing. I have a child, house, pet's and other things I can spend that $500 new PS5 money on. By the time PS5 comes out with an exclusive PS5 only game I want to SUPPORT and PLAY we will have the new upgrade of the PS5 and I will have to go buy that one with another $500 bucks if I want the newest version out. Currently every play station game I want to play can all still be played on the PS4. PS5 does have two games besides ark that are do to come out in the next year or two and I do intend to upgrade my system at some point but it will not be now just for asa when I will not support the crap snail games is pulling. They do not deserve another cent of my money and as such I have no intention of buying asa and at this point I don't even believe anyone will ever see ark 2 unless something changes. So with that if ase private servers are killed the only ark I will even be able to consider playing again would be single player as let's face it trying to play dedicated sucks when you are stuck in a bubble.

I already have a hard time getting friends to play ark and we play on a Gportal server as we left Nitrado do to the server being a crashfest. They have no interest in rebuying the game as ASA for upgrades. If they kill our server I think they are done.

As someone said this contract is between Snail and Nitrado, other hosting companies are not bound by it; So when we say they would close down unofficials, to do so they would have to enforce it onto players and other hosting companies in some way, which can be done by changing rules/guidelines or making changes in code itself. But as far I understand old purchases cannot be bound by new rules/regulations, its like you purchased a iPhone and then after a year Apple says you cannot use this for calling anymore. So to do that they would have to release some update or something; And game versions prior to that update should be free from these exclusivity terms. Another thing is they said they will be working on only crash fixes to ASE, if they go on this route to keep ASE alive and giving income from it to Nitrado they would have to invest more manpower(=more money) to keep it running and fixing. Because giving exclusivity doesnt get rid of loan, they still have to make it so that it brings in money and repay the loan. Then when they give exclusivity to Nitrado for ASE, player base that leaves wouldnt make sense that they will buy ASA because ASA servers will be hosted by Nitrado only and Nitrado is the reason they left ASE. Down the line they cannot let Nitrado as sole player in hosting because then players/other hosting companies would be able to sue one or both of them for causing/encouraging monopoly. Such exclusivity contracts can be between those 2 companies but I dont think it can be enforced to all over. So I think killing ASE that way they have more to lose than gain, because as you said players would just quit and say I am not gonna get into any game where snail has partnership, because in future we can just assume they will play something dirty like this to ASA also while releasing Ark2

Interesting thing to take out of the snail/nitrado deal is also that with nitrado have exclusivity on providing servers for ark, they could charge in theory whatever they want for use of private servers. Could also lead to a monthly fee for playing Asa but that woukd depend on the sales numbers as they would have to be quite high for that to be feasible

I originally took this to mean that if ASA isn't released by Oct 31 then Nitrado will be repaid a percentage of the income of ASE, if snail are strapped for cash then this clause gives Nitrado a means to generate income from the ASE servers. I wouldn't be surprised if the ASE official servers came back online with a small fee to play on them (season/annual pass) under control of Nitrado if snail fail to produce ASA on time.

On the plus side, if you release something "to the public", you can't restrict the use of anything that's been distributed. So we all have the latest version of Ark server stuff with our client, and we can set up community servers all day long if we want. But we probably can't charge for them, although we could share server costs. Lots of precedent in US law about this stuff.

Assuming our contract reflects the terms in the vod, free to use servers are allowed as Exempted Servers and can be financially supported by way of donations which is a financial model already used by many private servers. The purchase of ingame items may cross the commercial threshold raising a potential challenge to the Exempted status.

It is not legal (in the US) to retroactively change the terms of purchase - only changes to the terms for new purchases. So Snail / WC are scrood if they think they can restrict the use of software that's already been purchased, deployed and in use by direct customers. Let alone used to make money by commercial licensees. Literally everyone can sue them, and will win. However, one must remember that corporate lawyers get paid for saying "yes you can", not "no you can't". And then they get paid again for defending actions based on their bad advice. And sleazy companies tend to attract sleazier lawyers. So I've no doubt Snail will try this massive overreach and get smacked down for it in court.

Lawyers get sued for bad advice and if it happens to often they cant get insurance which puts them out of business. Any time I have had that issue the lawyer settles out of his own pocket, its keeps the firms name out of the papers ! That said I still agree with you, I wouldnt put it past Snail to still try it knowing it is unenforceable

Some players might get together and write a server emulator to keep the ARK:SE community servers running. If you don't believe this sort of thing can happen, it has already happened for the Ghost in the Shell FPS for one and World of Warcraft for a second. Time for all concerned to start archiving the server binaries for future reverse engineering.

I can promise you all ASA is coming out in October, snail games is publicly traded, they have a debt to asset ratio of 80/20, and they are losing about 4 million a year, if there debt to assets reaches parity they fall into administration, the very survival of their business depends on ASA releasing in October, they don't have the capital to delay the release.

We don't know if they'll add microtransactions like in ARK mobile, they could sell dino revives, equipment, saddles. It would be absolutely awful but they would get a lot of money from the whales. I've something better : lootboxes with 0.1% chances to get a 500% shotgun 😂

Thankyou for making a video about this, was getting a lot of people heavily on the copium attacking me for pointing out private servers not on nitrado would also be effected and have to either change or be shut down due to this agreement. I think you are also on the mark with Snail deliberatly killing ark 1 by killing servers deliberatly as there has been a fairly (needless) pattern of them doing this with ark1 , like with gen 1 and gen 2. Gen 1 was made unplayable shortly after 2 launch with server quality being decreased and rewards from actually doing anything on those servers being made totally pointless, which was odd given we bought both as a package.

It makes me wonder if it will be possible to demand a refund on Ark SE and any purchased DLC/maps if SGUSA does in fact shut down all the private servers. If Ark SE is not making any money to pay back Nitrado and SGUSA doesn't really care if they lose the money that they're not making on Ark SE in the first place, then the only way to hit back is to not buy anymore Ark titles, and to get our money back for what we have bought and put them in the hole (hopefully).

I think snail should want to release it on time and make sure it’s good, because there are very few UE 5 games on the market now (mainly looking at immortals of Aveum and remand II) and none of them have been optimized well enough by their devs to take off. Ark however, will have to run at a ps5, meaning it will have to be optimized for that. So besides being one of the best gameplay concepts EVER and having what’s to be expected some of the best graphics of the century, it will actually be runnable! This will attract a TON of new players, getting snail more money than they would from killing ASE.

@@NOOBLETS That's a relief, as I've always run multiple servers for my family/household on my own equipment. I've a few thousand hours in the game, even though I stopped playing years ago when they started their nerf-fest of the fliers. I played a while longer with the patches that re-enabled speed upgrades, but eventually got annoyed with all the things they kept doing to make the game worse. I and my entire family were getting excited about ASA, but man... I'm taking a step back to see what happens, especially after your last video where you said they've completely *removed* the ability to put points into speed for *all* rides (that's just insane). That changes the game more than anything else they've done.

It is far better for snail to have the 2 games running at the same time, as they will be making money off the licensing for the servers on both games then. On top of that since SE is licensed to Microsoft on Gamepass, they are still obligated to make sure people can still play it and access private servers. But yes if Ascended is not released on time everyone will have to move their servers over to the new company, at least until the loan is repaid in full. So if you run a private server be sure to make a backup of your server (which you should be doing anyway) in the event you need to move to the new company.

Just say no to Snail Games folks they are a trash company with horrible behavior so let's not reward them with our already hard to come by as it is money's. I love the hell out of Ark and have nearly 12 k hours in on it along with 3 private servers not on nitrido so I understand but I'm closing them all down and removing myself from this ridiculous mess as well as the 70 or so players that are on my servers that we been playing together for about 6 years. We are just done with the nonsense.

From the way it reads, they can kill it any time they want even if asa is out on time. Which would make financial sense for them, I.e. bang released on time with all servers with nitrado ( no outside companies), give it six months then wham shift all servers for ase to nitrado. Nitrado gets paid off and snail still makes money (they are a publisher that's their one goal )
