This reminds me about Windows subsystem for Linux (WSL). It's a very confusing name because it sounds like it's not Linux as part of Windows, but Windows as part of Linux. Microsoft was asked about this and they explained that the name of your product can't start with the name of another company. This makes some sense as you can see many products with "[Company name] [Product name]" name, like Google Photos, Microsoft Word, etc. It's dumb to trademark common words like Photos or Word, so technically companies reserve the right to use their company name as the first part of *something*. This makes it clear that this thing belongs to them, is an official product.

My problem is that Arm (and other companies in past) can abuse fake (or real, sometimes) legal pressure in the thousands or millions of dollars, to have someone destroy their own work. Arm sent this 'stop' request, and then they just _took_ the domains. Just because a normal person can't spend thousands on a lawyer. Wasn't it Allen Pan who got that thrown at him just a few weeks ago?

ARM has the trademark in the context of computer hardware, and she registered a domain with content in the same context, discussing the ARM architecture and IP. I think legally is ARM in the right here, but if I was in their shoes, I wouldn't have sent a C&D until it actually harms ARMs business.

You can in the technology sector. You are right that it's too common overall, but it is probably uncommon enough to work as a sector specific trademark. For example: "ARM software tech support" would probably violate trademark, but not "ARM yoga".

I think this was just a overenthusiastic IT security guy trying to protect IP while not taking a good look. Probably just got a deepwep/darkweb search result with similar domain search and the analyst failed to take a closer look. P.S.: this is why automation does not replace sensible thinking and common sense. Just sending a mail to the site ASKING what the site is about first. PS, PS.: Personally I would fire the analyst, or the person who took this to legal. This is causing a huge reputation damage to the company. Just my two cents.

Afaik the fact that people use Arm to refer to the architecture and not the company actually is a huge problem. To quote Wikipedia: "A trademark thus popularized has its legal protection at risk in some countries such as the United States and United Kingdom, as its intellectual property rights in the trademark may be lost and competitors enabled to use the genericized trademark to describe their similar products, unless the owner of an affected trademark works sufficiently to correct and prevent such broad use."

Arm can control how you can use their trademark, when they allow you to use their trademark, so the "Leg assembly" joke would not fall under that, since the whole issue is that the Author didn't have access to the trademark.

Btw. this is why cars have so "funny" names - Toyota bz4X? What's a bz4X you ask? Well, it's a four-letter "word" Toyota can *trademark*. Same with the new Volkswagen vehicles id3, id4, id5, id7 (why no id6?) and idbuzz. Tesla seems to not have gotten the memo, since single-letter "names" (or -numbers) can not be trademarked because they're so common to use. Another stupid trademark registration was when Deutsche Telekom (mother company of t-mobile) wanted to trademark their specific shade of pink. Apparently (and luckily) you can't trademark a colour.

Apple has even been in disputes about the word "Apple" against Apple Corp ("The Beatles") for the use within the music industry, when Apple expanded their business to include music with products and stores like iTunes.

Any trademark owner will have rules to follow and if they want to protect the trademark they will have to enforce the rules too. RISC-V is a trademark. However, it does not seem to have restrictions as strict as arm-less, so there is that.

Problem is, by law, they need to do this. If you don't "aggressively" protect your trademark, you will lose it. See 'Monster Energy' as a good example of how bad this can get...

true. there is definitely some element of “the law says you have to do this” here but even then, Arm (the company) conducted themselves poorly. it would be interesting to hear what a lawyer says about this, because as much as the law looks to hacker mindset like “this is a set of codified rules, I can understand this,” it often is not, particularly around trademarks.

Domain names are what is validated by SSL certificates. If anyone can register domain names containing registered trademarks, this whole system breaks down. Even non-technical users are encouraged to confirm the domain names and valid SSL certificate icon when visiting a website. Have whatever headings you like on a web page, but don't authenticate the identity of your website as a registered trademark.

I don’t think “contains a registered trademark” should be the relevant concept there. It should be more like “gives a false impression of affiliation with or endorsement by some other legally-recognized entity”. For example, I perhaps shouldn’t be able to get an SSL cert for a domain which indicates the site is endorsed by the Vatican, but should be able to get one that implies that is endorsed by Bigfoot, or which refers to the Vatican or to a trademark without suggesting endorsement-by or affiliation-with

Uhm, no, it doesn't work like that. You can get an ssl certificate for any domain as long as you registered it and you can prove your identity as the domain owner. It just prevents spoofing ... And you can use web domains without certificates ...

My guess it wast caught by some automated system and then followed up by lawyer as per procedures. And that is good (what if that was anything malicious). Website can be reinstated later once misunderstanding is resolved and proper trademark use is applied.

The company's original name was "Advanced RISC Machines Ltd. " The Reduced Instruction Set Computer architecture, is a conceptual architecture, not something owned by one company Unlike International Business Machines, and its shortened nonsense name IBM, the acronym encapsulating another acronym "Arm" -not capitalized- is a common English word. It could be challenged as a trademark that is not enforceable, because it is a common word and could refer to anything that the company chooses to do in the future. That;s overly broad. The rules created by the company are arbitrary and capricious. Taken literally, the letters that are "parts of its trademark slogan and logo", "The Future is Built On Arm", if removed from use in discussing anything that might tangentially refer to a product or service use similar to that offered by this company, would create ripples through the entire industry. eg The company AMD would have to change its name. The best defense against overzealous lawyers in this case is to point out that the company by its laxness in not enforcing its claim against every "misuse" from the inception of the architecture, has reduced the use of the word to the same status as aspirin - and unenforceable as a trademark.

They can trademark a product name, sure, but they can not claim ownership over a word or phrase. I can arm myself with all the arm and leg puns in response to Arm's laughable legal claims. Not to mention their name stands for Acorn RISC Machine and has nothing to do with arms. This means you can talk about arm security all you want as long as it isn't in reference to their products or company. My Bosch saw features guards for arm security.
