The feds dictated decades ago, no pedestrian traffic allowed , no bicycles, no non motorized vehicles, no farm machinery , minimum speed required to be there. In an opposite situation about 25 years ago when I was young and broke. My cheap car broke down on a highway. I was about 20 miles away from home and no cell phone. I was by myself. So I grabbed my few groceries and started walking down the highway. A state cop (Massachusetts) pulled up behind me put on his lights. Asked me what was going on. Told him I broke down and was walking home. He asked if it was my red car he saw I said yes. He then asked if I would like a ride home. I said yes. He gave me a ride and we chatted about stuff like cool people do. A perfect example of the "serve" part of serve and protect. No long stupid conversation. Not even a cop at this point he was just a cool guy that gave me a ride home.

There is a law about walking on a limited access highway. The sign is posted on every on ramp. The law is there for the safety of all involved. I saw cops caring about the safety of an individual who was breaking the law and giving him opportunities to walk away until they had to do something about it. @@marrionna044 No you can't walk on a limited access highway. That is the law. Look it up. I provided the link. I live in rural WV everyone here knows you can't walk on certain highways. Usually when all access comes with an on ramp and an off ramp.

If you want to walk somewhere, you go on the alternate routes with slower traffic, sidewalks, etc. Limited access highways are created so that traffic can go fast and not have to worry about pedestrians or bicycles. Most states around here have those signs up as you enter the on ramp of the limited access highways.

@@jimikimble according to the host of this KZbin channel, he read through several laws which seemed to be relevant to these circumstances of walking along highways in that particular state, and accordingly the man was not breaking any of those laws. However, you say that there is an applicable law in that state which would prohibit anybody from walking along that highway, even though he would do so on the outside of the guard rail? Unless you can manifest that particular law, I am going to believe the host of this KZbin channel, who at least provided a copy of the law which seems to be applicable to this situation. Furthermore, how can you justify those troopers telling that man that he needs to go walk 30 feet away from the guard rail which would put him into an area of overgrowth and any unknown hazards (there could be venomous snakes, wild animals, unseen holes, ditches which he could fall into and get injured, etc. So what if he would have complied with that irresponsible order from them and consequently became injured or even killed? Do you really believe that order was in the interest of his safety?! And why would they "arrest" him and then drop him far away from his vehicle? If they really cared about his safety and welfare they could have at least dropped him at his vehicle! I think they were egotistical bully cops. They may have even demonstrated certain racism against that man whom I think is Hispanic. Would they have done the same thing if he was a white man? I wonder how they would have treated him if he was a woman? Anyway, I hope that man gets good legal representation and challenges their conduct in a court of law. By the way, I do not see how walking on the OUTSIDE of ANY road or highway could possibly interfere with any speed or volume of vehicular traffic! I think "limited access" applies to what sort of vehicle (including trucks, cars, motorcycles, bicycles, etc) are allowed to travel ON that road or highway. I do not think there are roads or highways that allow pedestrians to walk along them WITHIN the parameter of the "lanes" of vehicular traffic! I think a pedestrian can walk along the outside of ANY public road or highway in the United States!

Furthermore, governments can restrict the time and manner of access, for instance to transact specific business, roads may be restricted to motor vehicles, or bicycles, etc... Granted, in this case, a pedestrian may have a right to walk on the highway, but for purposes of travel not for observing. Not trying offer a legal opinion, nor do I know the law of that State, and the law I practice is tax and corporate compliance... But, facts and circumstances determine how the applications of the law is applied.

However, don't really have the time to research the law and, as you are well aware, the answer is almost always "it depends", rather than a clear bright line... I just shake my head every time I watch one of these auditors intentionally escalate the encounter; not to mention try to lecture the officer(s) on jurisprudence. While I do support the intent, and think many officers need more extensive training, the auditors generally have very little understanding (if any) of the weight and authority of the law; whether statutory or case. Clearly, nothing you do not already know, but you also see the same comments; the Perry Ed. decision has been around for decades, but all I hear are auditors citing unrelated decisions and others taking it as gospel. Maybe I am just optimistic, I hope others might learn something by reading dialectic conversations like ours!

His safety might not be, but others is. A trucker sees a shadowy figure to his right suddenly...when they’re already down to a skinny lane, that’s actually a big deal. Notice that channel 9 action news isn’t there. And Pennsylvania code does allow restrictions on the traffic on limited access highways. I found it quickly...wonder why abiayah couldnt.

LEOs only concern is to enforce the law and until you've broken the law they have no authority over you. Only time your safety is of their concern is when you're under their authority.

In PA it’s 75 3313(a). Abiayah was wrong or lying-it’s easy to find. And you aren’t completely correct re scotus. In the cases DeShaney vs. Winnebago and Town of Castle Rock vs. Gonzales, the supreme court has ruled that police agencies are not obligated to provide protection of citizens. In other words, police are well within their rights to pick and choose when to intervene to protect the lives and property of others - even when a threat is apparent.

Firstly, he didn't know his "rights." He entered a restricted area (A freeway requires you to operate a vehicle which can maintain the minimum speed), then refused a police officer's lawful order so that he could Livestream someone's misfortune on the Internet. There are plenty of situations of people of every race schooling ignorant cops. This ain't one of them. And understand, this is coming from someone who can't stand State Troopers! I'd love for this to be an embarrassment for those wastes of taxpayer money, but this specific cop was well within his authority.

What are the differences in PA between walking on a highway and interstate? The officer initially stated it's an interstate. In MO it's illegal except in emergency situations to walk along an interstate.

Now we know what is happening to the people that go missing on the highways! Apparently, cops are kidnapping people! Luckily this man was recording, so they were most likely scared that the video might have already been uploaded and let him go! How many people have dissapeared around there because they weren't recording? Apparently all their dashcams, body cams, and vehicle trackers need to be gone thru very carefully to see if any missing persons can be found and if police vehicles were anywhere near places where people have dissapeared!
