Fellow Conservatives, please don't kick me out of the club, but for the first time ever I had a bit of difficulty with something Sen. Cruz said. Im not at all talking about the case in particular but he inferred that because it was a heinous sx crime that it would be for the greater good of the American people not to grant a habeas (or retrial) to this particular defendant. I certainly agree with the sentiment but judges are supposed to be completely impartial and to follow the letter of the law. I don't know what jury instruction she was referring to nor do I know other particulars of the case but I do know that it would be dangerous if judges or prosecutors refused to make decisions about cases solely based on how they feel about the defendant or the crime they were convicted of. Every defendant needs to be afforded a rigorous defense and appeal process no matter how much the criminal makes us want to vomit. Otherwise it would be more in line with leftist behavior.
