On December 11, 2021, at approximately 2:48 a.m., Officer Joseph Geil with the Pullman Police Department was dispatched to the Taco Bell restaurant at 425 NE Stadium Way in Pullman, Washington to reports of a female who had fallen asleep in the Taco Bell drive-thru. The woman was briefly woken up when the 911 caller had knocked on her window, but she soon went back to sleep. To mitigate against the possibility of harassment, the driver will be referred to as “the driver” or similar in the narrative that follows.
From the report of Officer Geil, lightly edited for brevity: "I arrived at Taco Bell and started walking toward the drive-thru and was pointed toward a silver 2001 Honda CRV. I approached the vehicle and observed its driver asleep in the driver's seat with the vehicle running. I knocked several times and asked the driver to roll her window down. The driver woke up and appeared confused, and then appeared to wave me off.
I knocked on the driver's window again, asking her to roll the window down. She opened the door. I observed that the vehicle was in neutral and told the driver to place the car in park. I was getting a strong odor of an alcoholic beverage coming from her. I observed the driver's eyes were red, watery, and bloodshot, and her face appeared droopy. She appeared to be having a hard time understanding my instructions. I observed an open case of beer in the back seat and an open beer can in the cup holder adjacent to her. The driver placed her hands on the steering wheel as if she was going to drive away. I reached in, placed the car in park, turned the vehicle off, and dropped the car keys by her feet. The driver's pupils appeared dilated.
I asked the driver what was going on. She said she was trying to go home. I asked her to step outside of the vehicle. She said okay and then tried to shut the door on me. She began trying to start her car without her keys, placing her hands where the keys would be and making a turning motion near the ignition, and then placed her hands on the steering wheel as if to drive away. I told her again to step outside of the vehicle, asking her several times. She said that she was ready, then grabbed her keys and appeared to try to find the key to start the vehicle with. I told the driver that she was under arrest and grabbed her wrist and her right shoulder gently encouraging her outside her vehicle. WSU Sgt. Kurht assisted me in getting her outside of the vehicle. Once the driver was outside the vehicle she became compliant. I placed the driver into handcuffs and checked for a good fit.
WSU Sgt. Kuhrt asked the driver if he could park the car, she said yes. I asked how much she had to drink. She told me "Not much, honestly". When asked why she fell asleep at the wheel at Taco Bell, she said it had been a hectic week with finals and she was tired. When asked about the beer in her cupholder she said it wasn't hers. She then said it was hers from two days ago and then told me it wasn't hers again or something to that effect. I asked the driver if she would be willing to perform some voluntary field sobriety tests to which she agreed. I took the driver out of handcuffs.
HGN: I observed lack of smooth pursuit in the driver's left and right eyes. She moved her head several times throughout the test. At times she would stop looking at my stimulus, look at me, and look back at the stimulus.
WAT: The driver had issues with balance while in the starting position, and had trouble getting into the starting position. She used her arms for balance while walking and stopped walking during the test. On her 9th step, instead of turning she began walking slowly backwards.
OLS: The driver began walking forward while counting out loud. I stopped her, gave her the instructions again. During the test, Ofc. Emerson had to remind her to lift her foot at least six inches off the ground. Several times during the test she raised her eyes from her foot and look straight ahead. She swayed while balancing.
PBT: I asked the driver if she was willing to provide a breath sample. She agreed. The driver provided a PBT of .249% at approximately 3:09 a.m.
It was my opinion that the driver was impaired. I placed her under arrest for DUI and transported her to the Pullman Police Department."

I use to drive for Uber and would always get questions about how much it must suck to drive drunk people, my answer was always the same I’d rather have them be in my car safe than on the road possibly killing them selfs or other people or even crashing in to me. Yes they can act obnoxious but I actually respect the fact they were smart enough to order an Uber instead of driving drunk.

I got a DUI in 1985 and shortly after quit alcohol. I’m almost 80 now and in very good health which I believe had a lot to do with zero alcohol or cigarettes for 35 years. Add up the plusses and minuses for either and you will have a short list on one side. Me getting busted was actually a good wake up call.

Sobriety is a fools game, the problem is if you can’t drink responsibly, know the law, drink at home, don’t drive, don’t cause issues, nothing is wrong with drinking. Learn your limit alone. Always get a ride home. And don’t bring any drama to you. Good for anyone who needed a wake up call but some people literally drink their entire lives and never start an issue.

Damn this brought back memories. I got a dui when I was 21, NOT something I'm proud of. I drove from one city to another and I passed through a mandatory check stop 5 minutes from my home. I blew a .22, I had a very high tolerance at the time because I was struggling with alcoholism. I didn't even feel drunk at that amount. I've been sober for almost a year now. A sober life is a better life 💯

She seems to not understand that by not signing the documentation at the police station, they can automatically suspend her license even before her DUI trial. The DMV will suspend it because she’s refusing to sign the paperwork.

I saw a guy do it once but he was being all sorts of odd... he did a back flip while in cuffs to prove he could, then stayed line dancing and singing and ended it all with a nice high jump into the splits. That was quickly followed up with a bit of a scream and him being for help to get up as he just pulled his groin muscle. He was taken to the hospital and then jail.

That's one hell of an alcohol tolerance. 0.249% is insane - 0.30% or above is generally considered the range of alcohol poisoning. And she's coherent and responsive!

Either she's on stimulants or has a very high tolerance. But being 24 years old I don't see her having that kind of tolerance. I've blown a .324 and I was totally coherent and honestly didn't think I was that drunk, but that was a bit over a decade of drinking in excess daily. So it's possible, but I don't see it here. Being a college student and her mentioning finals it is most likely adderall keeping her alive. Edit: BTW I wasn't driving, I learned that lesson when I was about her age. At the time I had to take random BAT tests at the methadone clinic I was at.

if you do happen to be suspected of dui remember when you do those field sobriety tests you have an inner ear infection affecting your balancing and also have chronic nystagmus affecting your vision, and you just started a new medication for it and aren't entirely familiar with how it affects you ;) whatever you do, don't admit to consuming any kind of intoxicant. be cooperative and say as little as possible.

@@ronp9709 @ABMcC86 yes except most of the time, being probably 95%, declining to do testing is almost a guaranteed conviction in most states. I've been LEO in two states now and it was that way in both. You can't exactly "wait until you're 100% sober" to do fields. I mean, are you going to show up after bonding out the next day and be like oh yeah I'm ready for those tests now? lol. Also in a lot of cases and states, depending on circumstances, refusals can also result in search warrants for blood draws which will show your BAC. But like the OP said, best strategy is don't drink and drive lol.

The sad thing is she seems like a genuine nice girl. Disagree on the attorney part of your statement. Nothing wrong with protecting yourself legally. I know someone who was arrested for a DUI without an attorney on hand and lost their career (went from 6 figure science-related occupation to a waiter working minimum wage) and another arrested for DUI with an attorney on hand who got their charges dropped (and learned their lesson because it was a huge hassle and involved large legal fees).

The bad apple rots the bunch. I agree that most just want to do their best. Same can be said in any industry. However, things change with time. Further, physical fields are trained to see their opponents as not human in order to perform their duty. It's a practice that leads to worse outcomes but allows the combatants to sleep at night. @@EvilDogProductions

Not true. I've had that said to me, had my car searched, and was let go. This was in Richardson, TX in June 2022. Most of the time, you are correct, but it's not guaranteed. I was 98% sure I was going to jail but the cops were cool and I wasn't drunk or high. Just had some bud in the car. They confiscated the weed and sent me on my way without even giving me a ticket. It all depends on the cop and the situation.

That cop was wrong when he said that they aren't allowed to help him jumpstart his car. Police are SUPPOSED to assist motorists and even give them a ride to somewhere or call a wrecker for you.

I was in almost her exact position 10 months ago. Open beer in the cup holder and all, except I totalled my car against the highway guard rail, thankfully not hitting any other cars. Blew a .23 The lessons you learn from this are so damn important. It haunts me to think about what I could have done to some innocent family had things gone slightly differently. DUI is one of the most selfish crimes you can commit, and also the easiest to prevent. Just don't get behind the fucking wheel.

I was pulled over for having a .08 although not high it is the limit. And learning from that lesson was probably one of the biggest wake up calls for me. Never put other peoples lives at risk because you want to drive while under the influence. It’s not worth it.

Doesn't matter if she does the breathalyzer at the station or not, she's already blown at the scene & registered a whopping 3x the legal limit...she has no defense now, because once you blow, that 'I was just sleepy' excuse is out the window...she was also recorded saying she had too much beer...& the Budwieser shirt wasn't helping her case at all either...Lol! As someone who managed to rack up 4 DUIs in my younger years, I'm pretty familiar with the process...I finally managed to quit drinking & haven't had a drink in 7 1/2 years...🥳🥳🥳

The fact she was so polite even while smashed shows me she’s a decent person, who made a poor decision to drive while intoxicated. We’ve all made mistakes, hers is just on display for the world. I sincerely hope she learns from this:

My guess is she was so stressed from finals that she over did it trying to relax. Plus, she's tiny and probably not eating much while testing and studying. But being conscious at .249 is impressive.

i thought so too. She’s gotten out of trouble way too much by just acting like nothing happened and leaving. And it’s told by the way she acts. She thinks “oh i’ll just say okay alright and then tell them i have to go” there really are people on the earth that don’t understand you can’t just tell the police you’re gonna leave and think they are just gonna let you go 😂😂

Cop was totally kind, understanding, yet still performed his professional duty. Very good job on his part! The DUI offender also was respectful and followed instructions. This, folks, is what we call a civilized society. Bad situation handled well by all parties.

Being that articulate with a BAC at her level is a telltale sign of an alcoholic. I hope she makes a change after this because it'll gets much worse as the addiction grows, and her life will unravel in way's she never thought possible. Alcohol is the devil.

I was thinking the same. At my peak of my problem, I could drink a bottle of vodka and go to the gym 2 hours later like nothing. Thinking about it makes me so disgusted with myself.
