Attempts to evade Arkansas State Police in Ford Escape (Doesn't work) -

Trooper's Report:
On 2/16/2024 at approximately 4:52 P.M., I was traveling south on United States Highway 425 near Fountain Hill. While
patrolling this area, I observed a black Ford Escape traveling northbound at a high rate of speed. I activated my front radar and
clocked this vehicle traveling 82 MPH in a 55 MPH zone. After observing the traffic violation, I made a U-turn to catch up with
the vehicle. The suspect accelerated at a high rate of speed. It was at this time that I activated my lights and siren. The suspect
made a right turn onto Ashley 76. While traveling on Ashley 76, I observed the vehicle operating at speeds greater than 100
mph and taking curves in the opposite lane, showing no regard for possible oncoming traffic. When I caught up with the suspect
vehicle, the driver placed her hand out the window, indicating that she was surrendering. The vehicle came to a stop on Ashley
76.
I performed a felony takedown and ordered the driver out of the car and to lie down on the ground. I handcuffed the driver,
Tolessa Jeffers, and placed her in the rear of my patrol unit. During an administrative inventory of the vehicle, I located a
cigarette pack with ten suspected hydrocodone pills. This cigarette pack was lying on the passenger seat of the vehicle. Mrs.
Jeffers was transported to the Ashley County Detention Center without further incident.
Mrs. Jeffers is being charged with the
following charges:
Felony Fleeing,
POCS Schedule 2 GT 2 grams,
reckless driving, speeding,
no seatbelt,
failure to register vehicle,
driving left of center, and
failure to yield at an intersection.

I think she has a good case for false arrest. It took the officer almost 45 seconds to get turned around after witnessing the speed violation. It was another minute before activating his emergency lights. At this point she was out of sight. It was almost 2 minutes before she came back into sight. It was almost another 30 seconds before he was in her rearview mirror. At this point she was in a blind corner. She went around the corner into a good vision spot on the road and stopped. About 30 seconds after him coming in to view in her mirror. Was she speeding, yes. Did she see him turn around, maybe. Did she know he was coming after her, no, not for sure. Were they out of sight of one another when he went to emergency lights, yes. Did she stop within a short time frame after him being known to her, yes. I believe in court it could go either way.

She's gonna have a decent chance to maintain she was unaware of his pursuit. When he got within visible distance, she shut it right down. I'd lean towards she did know but there's plenty of reasonable doubt of that as fact. Otherwise, wish she'd made it a competitive race, I drive an escape. I'm confident the Escape is not mechanically equal to a standard state police dodge pursuit package, but I'd love to see how it might avoid and for how long.
