You are very lucky or good at finding these people that not only misunderstand laws, they'll also confidently explain their completely wrong interpretation of the law to you. Other auditors have done loads of audits and they've never come across people like this or that PCSO in Elland. Great job, NA.

Also, I didn't walk up to someone and start filming them, they approached me in public or publicly accessible places, and didn't walk away when they knew I am filming. Imagine if you had to stop filming or not publish it online everytime someone just walks up to you whilst your making a video. On this one I felt harassed because everytime I was flying my drone and stood in public - someone from the business came out to challenge me in public whilst I was going about my own business. After I left the public part of their site, I never went back ONTO their site. I only flew my drone over from public to get the footage I needed for my artistic content. There were so many interactions i didn't include them all. When I did the night footage I went out of my way not to get their attention, but still a security guard came out poking his nose in and trying to intimidate, pushing me to leave the public space.

Apparently as a non-commercial drone operator/video recorder we’re allowed to do so without any interference, including the cops who are even more clueless about the law. So it was explained as follows, totally legal to record in a public area (camera or drone) but if you can identify individuals and the video is uploaded to social media (Facebook/KZbin etc) that’s where the GDPR starts to get involved as you’re now earning money, and as money is involved the GDPR starts to rear its ugly mug. If you already know better or understand it better then that’s great, but for everyone else I’d recommend that if you intend to upload to KZbin then it would possibly be worthwhile listening to the Blackbelt Barrister as he explains it in better detail than I (morphine does a number on short term memory). The staff here don’t get the irony of whinging about NA taking video of them, yet do the very same the femto-second they get the chance! @@northernaudits the issue is when an individual explicitly states they don't want to be identifiable. By rights you should at least be blurring their faces. Reputable media outlets would normally try to get people captured on film to sign a waiver if the intent is to publicly broadcast the footage. It is your believe this falls under artistic/journslistic exceptions. Could be a very expensive day in court if soneone took exception to your filming and the judge disagreed. If your intention is to capture drone footage and so that on youtube then theres no need to post these interactions. You're intentionally baiting these interactions to create content.

A pair of patronising pricks. The one in blue made a veiled threat. That was totally uncalled for. People may disagree with what you are doing but it’s not illegal. Making threats is. I don’t think I’d be keen on doing business with people like that. Security’s job is to monitor and contact the police not rush into confrontation. We see so many security guys doing just that. Aggressive, antagonistic, barking orders that is recipe for disaster. They need to be adequately trained it’s not fair to be in life threatening situations on minimum wage. Dreadful thing to happen but the firm has learnt nothing from that incident. ECHR European Convention for the Protection of Human Rights and Fundamental Freedoms ECHR) is a European treaty in which the human and civil rights of all residents of the member countries are laid down. it allows filming in the public sector, public and government buildings , everything you can see from public you can photo and record it since November 4, 1950,, same as Google Earth (with zoom options) Google Maps (with zoom options) Google Street View (with zoom options) hundred cars with a dash cam recording them every day and its totally legal

just had a google.. 2020 a member of staff kicked off with 2 youths.. this ended up in a knife (sword!!) attack where two members of staff were injured and one died from the stabbing! seems this was a particularly savage attack with over 100 injuries to the dead man! :o (both lads 15 and 18 convicted of murder) the company then invested time and effort into the local community to combat knife crime in youths to the sum of £10,000 surprising they were not a bit more open and friendly? rather than creating bad feeling towards their staff?? Police on way...? i guess never showed up

In claiming that you have a client, it then changes the rights of the property you are recording. You have then effectively made a statement that you are working for someone, and that puts it in the realm of a commercial video, and the property owners can then rightfully require that you cease making any recordings of their property. You must simply say it is for your private use and that you are recording anything that you can see from a public space, which is totally legal.

What Section of the Data Protection Act 2018 are they saying no filming ? As they is no such Section. There is a ICO CCTV Guidance report but again that fixed cameras, and bascially comes under PECR not GDPR. Public can film where they like and Section 45 does not apply to the public to supply footage as a SAR to a company or organisation. Companies and organisations thou have to supply their footage under Section 45 to the public if a member of the public does a SAR. Its also law UK GDPR and ICO rules, that a employer has to give quality GDPR training to their employee, but seemingly they do not.

11:45 I would steer clear of implying confidentiality because of commercial confidence. Gives the wrong impression and makes them think of commercial filming or being spied on by a competitor. Just stick to making a video for personal use. Then you can say you can't tell them because it's personal and private. And if they still want to know why then you can ask what colour underpants they are wearing - just as personal and private.

@@StuartJ Not quite. Commercial filming is defined as the promotion of a product or service. You don't have to be paid to produce a commercial video, just have a contract arranged for the production of the video, say for a sponsored video or one where the creator paid or offered a product to review. KZbin pays out for the opportunity to show adverts on any video that is played on a channel. So the money is for the channel, not individual videos, and KZbin doesn't payout to have the video made. Some channels run around a hobby might be monetised but that doesn't mean the hobby or the video is commercial. Same with auditing videos.
