"Ignorance of the law is no excuse" applies first to public officials. ESPECIALLY for law enforcement. They're our servants. We have reserved powers under the 10th Amendment and can do checks and balances individually as such. This is a BIG part of why we have the 2nd Amendment.

It’s a bit messed up how cops get qualified immunity, but I have seen so many videos that show a cop telling someone who did something minor ignorance of the law is no excuse. Well apparently it is for them. I want to add I support the police, but I hate this poor excuse for a person with a badge. Respect is earned and the ones who haven’t ruin it for those who have.

He knows the law but he also knows that what he did was 100% illegal and if he didn't write a ticket then the driver has a better case and reason to make trouble for him and technically he could be charged with a felony. If he writes the ticket, worse that will happen is he gets a in-service day for retraining. This happens all the time, in every part of the nation. Show me a good cop and I'll show you one that's breaking the law or covering for one who did.

Because fir whatever reason, citizens are REQUIRED to be more knowledgeable about the law, than the people who enforce it. If they fuck up, they have qualified immunity for their ignorance. If YOU fuck up, ignorance of the law, is not a defense for breaking it.

This happened to me, i got pulled over going 50 in a 40 but i was following this other car. There was a car behind me. But the cop pulled out after us and turned on his lights. The car behind me pulled over and the cop passed him up so i pulled over . He pulled me over for speeding. I told him i was just keeping up with traffic. He said i was speeding to catch up. I definitely wasn't. I ended up paying the $200 so i didn't loose my license since i had no camera to prove it

That officer is a disgrace to his profession. He only pulled him over because it was an expensive sports car. He flat out lied about running a stop sign, and those tickets were purely punitive because he felt the driver had an attitude. This cop wanted to assert his authority solely based upon his ego. He is dishonest, and abuses his badge. Beverly Hills should terminate him for failing to uphold professional standards.

We have to because it’s been a routine practice of American police to hunt migrating Canadian motorists on the I75 and I90 for decades. It’s also routine that they make laws up on the fly to take advantage of us. Recently, one in (Carolina I believe) arrested and jailed a young woman because he didn’t know how to read an Ontario auto ownership document. They know we won’t sue because we won’t go back and forth between home and the States for court. Your police in the states are more ignorant and criminal than any in the world. And we all know it.

Depends on if it is a qualified/verified complaint, and may stay longer if the officer gets more complaints with in the 5 years. Though may vary between departments/jurisdictions. Also CHP, State Police, and CBI are different. If you live in the jurisdiction you could be on a crap list by the officers friends. (former Law Enforcement USAF SP and Public Safety Officer Arizona. Also a few Cops in the family)

In my opinion, that's not even the problem. I wouldn't blame a city officer for not being 100% familiar with every single exception in a law governing international driving liscensure. But fucking CHECK YOUR EGO AT THE DOOR GODDAMN IT AND LOOK IT UP IF YOU DON'T KNOW. Doctors look shit up all the time, because obviously not having photographic memory shouldn't be a source of shame. The officer is either delusionally confident in his own knowledge, or he'd rather screw the driver out of their money and time than fact check.

Maybe one could argue that by not double-checking the law that the driver claims exists and by willfully acting against that law even after being told about it, the mistake of the officer is no longer an *honest* mistake and it would have been *reasonable* to do a quick inquiry by himself and therefore he would not be protected under qualified immunity. (But I agree that this jurisprudence should be abolished)

Exactly in the electronically advanced world that we live in he could have simply done a quick Google search without even touching his phone and had his phone read back to him the response. Or as the other commenters stated he could have used his radio to ask dispatch. He could have called his superior and got confirmation. So with all that said it's pretty obvious that this was nothing but retaliation (for having the nerve to question him) with a hint of jealousy (he knows he will never be able to afford a car like that) and also he knew that if he was wrong nothing would happen to him but he could still get to ruin this man's day, week, or entire vacation.

I was back in town for all of 15 minutes, and about 3 miles from home. On coming cop car, flipped a U turn, almost T boning me in the process. Pulls me over. Looked to be a rookie, with his trainer as his partner. Comes up to my car, and proceeds to bitch at me about my yellow driving lights. "factory Subie lights, just PIAA yellow bulbs" He then tells me, yellow is illegal, and that I can only have them on if I am going under 25 MPH. I inform him he is incorrect.. He goes back to his car with his partner. I pull up the 2 statutes that he was incorrectly quoting, and mixing together. He comes back with 2 or 3 tickets, I show him the codes, you can only have fog lights, and no headlights on, under 25mph in inclimate weather, and all light from a vehicles front can only be white or yellow/amber. He was sooo pissed, and his partner was laughing his ass off. I showed him the correct ARS codes, and off he went like a little bitch.

I used to drive a cab. I had been stopped due to the actions of my passengers. (collage students) The officer asked for their ID. They proceeded to hand him their PASSPORT. Officer stated that a PASSPORT wasn`t legal identification. I had to inform him a passport is legal ID in every country. He had to call his supervisor to confirm. His boss wrote him up for not knowing what proper ID was.

I work at a bar in Australia. We can't accept ID cards (Driver license, carry permits, photo cards) from any other country except NZ. The only thing we can accept is Passports. Because they're an internationally recognised form of photo ID.

Many Religions that we know nowadays, at their beginning were true and under Islam, initiated by one of the prophets of God, but their original teachings, history and scriptures have been corrupted over time with falsification and polytheism, or lost and replaced with false ones. That's why Islam is the only Religion accepted by God nowadays, which consists in bearing witness that there is no god besides Allah (God in Aramaic, the original language of Jesus and the Gospel), and that Muhammad is His servant and messenger, just like Jesus and Moses and others are His servants and messengers. Never a messenger of God said he was God or literally son of God, it was the people after him who changed the words of God and corrupted the Religion. God is unique and absolute, He does not need to have a family and sons or to associate anyone else with His kingdom, He can simply create whatever He wants, everything belongs to Him, and to Him everything will return. Allah said in Surah Al-Mu’minun : “God has never begotten a son, nor is there any god besides Him. Otherwise, each god would have taken away what it has created, and some of them would have gained supremacy over others. Glory be to God, far beyond what they describe. The Knower of the hidden and the manifest. He is exalted, far above what they associate. (91-92 / Translated by ITANI). Allah means the one and only God, the God of all prophets and creatures, the creator of the universe and mankind, and the Master of the Day of judgment, where our destiny, Hell or Paradise, is decided based on our faith and deeds in this trial life, and above all, Allah's mercy. Allah said in Surah Al-Ikhlas : In the name of God, the Gracious, the Merciful. Say, “He is God, the One. God, the Absolute. He begets not, nor was He begotten. And there is none comparable to Him.” (1-4 / Translated by ITANI). Allah said in Surah An-Nisa : O FOLLOWERS of the Gospel! Do not overstep the bounds [of truth] in your religious beliefs, and do not say of God anything but the truth. The Christ Jesus, son of Mary, was but God's Apostle - [the fulfilment of] His promise which He had conveyed unto Mary - and a soul created by Him. Believe, then, in God and His apostles, and do not say, "[God is] a trinity". Desist [from this assertion] for your own good. God is but One God; utterly remote is He, in His glory, from having a son: unto Him belongs all that is in the heavens and all that is on earth; and none is as worthy of trust as God. Never did the Christ feel too proud to be God's servant, nor do the angels who are near unto Him. And those who feel too proud to serve Him and glory in their arrogance [should know that on Judgment Day] He will gather them all unto Himself: (171-172 / Translated by Muhammad Asad). Allah the Most Merciful said in Surah Ali-Imran : Behold, the only [true] religion in the sight of God is [man's] self-surrender unto Him; and those who were vouchsafed revelation aforetime took, out of mutual jealousy, to divergent views [on this point] only after knowledge [thereof] had come unto them. But as for him who denies the truth of God's messages - behold, God is swift in reckoning! Thus, [O Prophet,] if they argue with thee, say, "I have surrendered my whole being unto God, and [so have] all who follow me!" - and ask those who have been vouchsafed revelation aforetime, as well as all unlettered people, "Have you [too] surrendered yourselves unto Him?" And if they surrender themselves unto Him, they are on the right path; but if they turn away - behold, thy duty is no more than to deliver the message: for God sees all that is in [the hearts of] His creatures. Verily, as for those who deny the truth of God's messages, and slay the prophets against all right, and slay people who enjoin equity - announce unto them a grievous chastisement. It is they whose works shall come to nought both in this world and in the life to come; and they shall have none to succour them. (19-22 / Translated by Muhammad Asad).. Salam (Peace) --------------

Got a speeding ticket here in Florida last year. It was pretty bad (41mph over the limit, I was being dumb). I hired a traffic attorney to handle the ticket. I never signed the ticket and was never issued a court date. My attorney called every week for six months for a court date until I was able to get it dismissed under the statute of limitations. I somehow slipped through the cracks lol

The officer was condescending from the start. I would postulate that the officers intent was harass this guy from the beginning. My guess is jealousy and authority ego. If anything it should be even more important for a cop to not be ignorant of the law since they are the ones enforcing the laws. The idea of qualified immunity is ridiculous. Part of being a cop should be that you MUST be educated in the laws you are enforcing. The idea that it is okay for a law enforcement officer to be ignorant of basic laws is baffling to me. If they make a mistake and violate someones rights then they must be held liable.

They accept that they will never really hold themselves accountable for their actions that has to be done unfortunately by the citizens but we have layers and layers of protections to have to go through in order to get to them through the judicial system. They have an unlimited checkbook because they can just keep going deeper into debt. It utterly amazes me how people continue to want to give the government more power, and more control while at the same time complaining about the government constantly. Do we really think it's a good idea to put people like this in charge of the medical system? Literally putting life and death in the hands of politicians and bureaucrats?

That cop shining the light in the camera knew what he was doing. Beverly Hills PD is known to do stuff like this. Officers have been reprimanded several times for playing copyrighted music while being filmed to make sure the videos get taken down. They don't like to be filmed, which is weird because there's police surveillance camera everywhere in Beverly Hills.

I once got stopped and got a ticket for the same thing in a Audi rs5 took my ticket then showed the court they made the cop pay that imaginary fine. Dashcam showed the speed hit zero for 1.5seconds before I moved as it was 11:45pm and it was clear

Yeah when I went to UK, Scotland, and Ireland they all honored the USA driver's liscense (I think even Wales does), and it's well known that Canada has closer relations with USA regarding visitors, so yeah, officer was either mentally challenged or playing dumb out of jealousy. Imagine if vsitors to another country actually had to pass a driver's ed course in that country before renting a car. A 3 hour drive to the beach would require a 2 week stay, all taken up by classes! THEN you can drive to Tesco for beer and snacks. LMAO.

In high school, I took an law enforcement class that was taught by a retired LA county sheriff captain, he stated that there is 20% good cops, 80% bad cops. I was shock when he said that. After years of dealing with cops, that statement was correct.

What you missed here . Is that the modified exhaust ticket is void as well. The car is registered in Canada and in his country there is no law for modified exhaust. And his car is subjected to Canada laws due to it being registered in British Columbia. He is just a tourist.

That's how we know the cop knows he's wrong, but issues the citation anyway in order to fill a quota. Qualified immunity is intended for officers making innocent mistakes, not corrupt cops using nonexistent law as a guise to hide their bruised egos and corruption.

Actually, that just happened to me last year. I got pulled over on my way to work for expired tags (during Covid it was nearly impossible to get into the secretary of state in Michigan to renew, in fact, the state later issued blanket immunity for expired tags during that time). Anyway, the cop came back to my car and told me my license was suspended (which i had absolutely NO idea of). I had apparently waited too long to pay a "using a phone while driving" ticket, and my license had been suspended for months. The cop ticketed me for the expired tags, advised me on how to contact the court to pay the old ticket, and how I could get my license re-instated after doing so. Then he sent me on my way. That cop could have REALLY fucked up my day. Thankfully, he didn't. I have no idea why he let me drive away with a suspended license other than that I was decent to him during the stop, and he was using his discretion to return that respect.

I find it EXTREMELY hard to believe that a Beverly Hills LEO, or any LEO in southern California, has NEVER BEFORE seen someone there visiting from outside of California... as if no one flies into LAX and never rents a car? It's absurd that this officer used the whole "you don't have a California driver's license" thing like it was real. My guess, the cop saw a guy driving an expensive car with Canada plates, and tried to strong-arm him into paying the fines because he's assuming the guy is returning to Canada soon, and would easily pay the fine rather than return to Califirnia again to hash it out with a magistrate. Dude should be fired.

That actually brings me to a question I've had for a while - can an officer even cite an out of state or in this case out of country visitor for violations of local modification laws? I'm pretty sure he can't, otherwise one would have to modify their vehicle to comply with local state laws every time one drives over to a new state.

A good example would be state troopers who patrol major interstates like I-80, I-75, I-35, etc. Many tickets get written to out of state drivers and are rarely challenged because the overall cost of a return trip would be more hassle than mailing in the fee for the ticket.

He approached the situation trying to rectify a legitimate complaint with one of his officers and did not appear to ever double down or back up the officer. Personally, and as a lawyer, I find that the concept of "qualified immunity" is completely counterintuitive. Law operates on the assumption that people cannot be excused based on ignorance of the law ('ignorantia juris non excusat')... and yet, the people who should be the least ignorant about law - as they are constantly applying it - are the ones who can get away with not knowing the law as long as the mistake is found to be reasonable. That makes absolutely no sense. If a reasonable mistake exempts an officer of punishment, it should also exempt a common citizen in an analogous treatment, particularly because common sense dictates that the common citizen is bound to know less about the law than an average worker in a law enforcement career. I really could never wrap my head around this concept, and am glad that this abomination is not ubiquitous all around the world.

that is actually a great argument against qualified immunity. Especially if the mistake is pointed out, and they refuse to listen. Like one in California you have the right to conceal carry without a permit while on your own property I have not tested this as I don't have the police out to my house often. I also threatened to shoot my neighbors dog if it left his property again, telling a cop this then citing the exact California code that allows me to kill my neighbors dog even if it isn't on my property because it has attacked my goats and chickens and killed 3 cats (cats keep the rats away and are considered livestock as well for this purpose)and I don't have prove that. Animal control wants proof.. I witnessed the dog attack one of out cats on my property that resulted in the cats leg needing to be amputated. pretty bad.. The cop wasn't 'happy' mumbling something about discharging a firearm in city limits, and I also in formed him we were in the county and the city limits was my fence line... again he wasn't happy.. but couldn't do anything as I am well within my rights and totally correct. I read the California code, I have a paper copy from 2014... so fun stuff knowing more of about the law than actual law enforcement

That is a very interesting explanation. I wonder what would happen if this cop got sued, he would be saved by qualified immunity, then I would drive there as an European, I would get pulled over and fined for not having a valid driving license, and when cited to court, I would try to defend myself by using this guy's case against the cop. I would ask not to be fined for my mistake, as the cop was cleared for his wrong doings for the same mistake. If that would happen, do you think I would be exempted from paying the fine? Would it matter that one of their cops was exempted for the same wrong doing?

@@theozBandit I am not Demetrius, but I will tell you how this works in Europe. Here you are expected to go to your embassy from that country to inform yourself on the laws present there. Almost no one does it, or at least no one I know, but I found this out researching the internet. From the day you arrive in that country, you are supposed to have at least the basic knowledge, before you could arrive to the embassy. For example every country has its own road tax, and many are different than the others in each country. For some you can pay for a sticker for all the highways. In other countries you are checked when you enter a certain road/highway, and you pay when you leave the road. The parking is different in each country, but everyone is expecting that you inform yourself before going there, not when you arrive. So.. this might not answer your question, but this is how it's done in the EU.

Let me tackle the points one at a time; do note, however, that little details might change from jurisdiction to jurisdiction, even though I will do my best to keep to what is more or less constant in all places. (Side Note: There is a TL;DR at the bottom with simplified observations.) 1. Definition of Ignorance: From a legal perspective, "ignorance of the law" means "stating that one did not know about the existence of a specific section of law, particularly one applicable to the present case". Although there can be some semantic debate on whether that would actually entail ignorance or just a lack of information, this is the overall definition applicable in a legal sense. For example, a defence based on a defendant that claims he "did not know smoking marijuana in state X is illegal" is a defence based on ignorance of the law. The reason for that lies in the Latin "ignorantia", which means quite literally "not knowing". Although common language kind of implies that an ignorant person doesn't want to know, we have no such assumption in law. 2. To put it quite plainly, yes - and this is something I find quite counterintuitive at times. The reason for that lies in the fact that laws are public available, so theoretically any person could, and should know, all laws that would apply to the place where they live. However, we do know this is an exercise in fiction. Personally, I believe that mistake of law should be excused in Criminal Law provided that the infraction is counterintuitive (for example, the illegality of carrying an ice-cream in your back pocket in Alabama) - however, this is not what happens. In practical terms, we do have some degree of selectivity in law - and by selectivity, I mean "police officers having a huge degree of discretion in reporting a crime or not". Even though ignorance of the law is not excusable from a legal standpoint, at certain times police officers will handwave infractions and let certain agents go with a warning - while prosecuting similar cases based on personal convenience and judgements that are extraneous to the legal realm. I have written far too much and reckon I should summarise my points. A. For legal purposes, "ignorance" actually means "not knowing". It's not a judgement on whether the person made their due diligence or not. B. By law, people are required to know all laws applicable to the jurisdiction they are currently at. (A mistake of law might, in some jurisdictions, reduce your punishment, however.) C. I disagree with the system in B. For me, the more arcane / counterintuitive an infraction is, the more lenient we should be when analysing a mistake of law. D. In practical terms, police officers can be selective in the system detailed in B. For light infractions, they might decide to prosecute Person X but just warn Person Y, even when they have done the same acts, based on factors that are not based on legal reasons.

The recruiting system is broken. That aside, end “qualified immunity” NOW! Qualified immunity for people that aren’t qualified to be cops is injustice and DANGEROUS. At best, ignorant cops, and at worst, bad apple corrupt power-tripping police officers, both know they can rely on “qualified immunity” to get away not just with mistakes, but the precedent has now expanded to encompass reckless acts, and then knowingly wrongful acts, and even maliciously criminal acts violating people’s rights. Fix the police force! This “qualified immunity” was created by court precedent for a proper reason once upon a time, but it has morphed into an all-encompassing police immunity from prosecution qualified by NOTHING. It’s now unqualified police immunity. The legislature MUST fix this judicial precedent mess with legislative enactment.

If you are from another country, you'd better REALLY enjoy your visit to the US because that will be your last one if you skip on the ticket. You will be arrested and the border and expelled. That's why cops love giving tickets to tourists. It is cheaper to pay the fines rather than make a second, third, fourth, and even more trips to fight the tickets. Nice extortion racket.

If you have a warrant, they will arrest you and then the state that issued the warrant has 21 days to extradite you. Meanwhile, you sit in jail with no bail. If they don't come for you, you're released..........until the next time you're pulled over. Then it's back to jail for 21 days until they don't come for you again. Know too many people that got stuck on that merry-go-round.

So basically an officer with less training than my hair cutter, can carry a gun and use it, or do basically anything for that matter, so long as there hasn't been a previous incident the officer has been "educated" or "corrected" on. Basically "oops my bad," is good enough to not be held responsible for their actions. I love and hate these videos lol I appreciate the education but really enjoy my ignorance until I find out just how small our rights are as a citizen in a situation with the police. I realize its better to know where mine as well as the police officers boundaries are, but damn this is a hard pill to swallow!

I understood AtA's a litle unclear explanation as applying only to aftermarket exhausts. There is no way a Lambo stock exhaust could be illegal due to noise regulations if the car itself is at all allowed in a country. They are small-volume cars (and with big money involved) and as such typically exempt from laws that wouldn't allow them to be sold this way. (Soemtimes it is actually quite questionable what car manufacturers get away with in high-volume cars even. Keywords HID headlights or touchscreen controls.)

And since he was never charged for noise pollution then they wouldn't have a reason to test the decibels of his exhaust.

No, factory tint legal in one jurisdiction might be illegal in another jurisdiction. You as the visitor have the obligation to look up the local laws and abide by their laws. The exhaust may be legal in Canada but illegal in Cali.

@@corssecurity fact 1: the ticket he was given was for having a modified exhaust. Fact 2: he does not have a modified exhaust he has the original factory installed exhaust. Therefore, the court can't find him guilty of having modified exhaust if his exhaust is not modified. The court can only make it's case against the actual charges. They can't modify the charges to fit the situation. I have no idea what varying window tint laws have to do with this. They wrote him a ticket for something he does not have and he can easily prove that to the court by having the court bring in a car expert to verify the exhaust on his car. And on a side note how does the officer even know his exhaust is modified just by driving down the road? More on that later. Furthermore, in regards to the decibels of the exhaust, he was never cited for creating noise pollution. So the court could never find him guilty of something he wasn't charged with. So again, your point about the window tint laws differing from state to state is completely irrelevant to anything I've said about this video. And finally, in regards to your very last sentence, the officer didn't charge him with having an illegal exhaust. They charged him with having a modified exhaust. Those are two completely different things and what you said is not based on the facts from within the video nor does it have anything to do with what I said about the facts from within the video. What the officer should have done was charged him with noise pollution if they thought his exhaust was too loud. Then from there the court can investigate the cause of the noise pollution. If he needs to bring his decibels down a few notches the court can give him time to remedy that since his car isn't from this country as you pointed out. But your entire comment makes absolutely no sense based on what was said in the video and what I said in my original comment. Learn how to comprehend law before entering yourself into a discussion about law.

Qualified Immunity sucks since a reasonable mistake in this case could be towing a car based off an error in knowing the law. That officer should be paying damages if they make a mistake like that. And this is just about a car and interrupting a person’s life, not taking a life or seizing assets that get lost.

I think it is important as a a whole. The cops generally are supposed to represent the state(city, country, or whatever) rather than their own person. If you mess up in a normal job, you'll be fired, but it won't be you who gets sued, it will your employer(in most cases). If you work in a job for 20 years, you'll mess up sometimes, that is bound to happen. Cops can mess up, like any other person can. Without these sorts of laws the cops would have way too many responsibilities.

The qualified immunity thing to me sounds like a good way to ensure that officers have no consequences for not thoroughly studying the laws they’re supposed to uphold
