In this episode, Dr. Hackie Reitman speaks with criminal defense attorney and autism expert Carol S. Weinman, Esq., C.A.S.. Carol is a former Prosecutor and has been a criminal defense attorney and family lawyer for over 25 years. She focuses her law practice on special education and specializes in advocating for the interests of those with autism. Ms. Weinman is recognized as an autism expert and legal consultant, author, mediator, trainer and nationwide speaker on autism. She is passionately committed to educating others worldwide about understanding the autistic brain and behavior, and how autism plays a role in the commission of criminal offenses and inappropriate behavior. Carol discusses her experience as a mother to a son with autism, and how people on the spectrum often find themselves in misunderstandings with law enforcement.

I wander lots of autistic people get aggressive if things dont work in their way. And they are vulnerable to be bullied. If they were bullied and led them to fight back the bullies of any age, then how criminal justice deal with this?

I taught for many years and had trouble with certain individuals with ASD being overly aggressive. Not toward me, because I understood their needs, but toward those that didn’t coincide with their egocentric wants and needs. More and more research is showing that certain subsets of criminals have ASD. Many of the mass shooters and certain serial killers. I feel that there are too many cracks in the system that need to be filled early on when these individuals are young. Certain skills can be taught with various means using early intervention. Quite frankly, I stayed gaps, but it’s actually chasms between what needs to be done vs what’s actually being done.

I was tricked into applying for a ppp loan and wasn’t until today I realized what I had been guided to do... I’m autistic and mental and legally incompetent I genuinely didn’t fully know or grasp what I was actually doing .. I’m so horrible .. why am I so stupid I can’t stop crying I would never commit a crime 😭😭😭

I salute you, Carol, for your expertise in this field. It takes a special person to understand the unique condition of ASD's and we need more people like yourself to represent these individuals in the criminal justice system.

I have autism. Nobody gave a shit. I am very high functioning. I think I am now constantly on survival mode. Even today. I'm very scared.

I would really love to network with you and your guests. I am a psych nurse practitioner with high functioning autism characteristics, I have several family members who also demonstrate autistic traits, and a nephew who has been diagnosed with ASD. I am trying to specialize in this area, particularly with females on the spectrum, and it would be so great to connect with other professionals with knowledge and experience with this condition.

How can I have an autistic person who is incarcerated for stocking his ex girlfriend because of his repetitive behavior in detaching from a relationship?

I see Carol is an ABA trainer. Much of the autistic community is pretty opposed to the ABA. I wonder if she still trains in ABA , or how Carol views the overarching viewpoint of the autistic community's view of ABA.

Great to see your expertise, but the criminal law is very bad with autistic people especially with some of us who have unusual computer skills. See Gary McKinnon, Laurie Love and now myself. I’m in England and my actions which were about a very unusual computer action . I have been convicted but am appealing.

There is such a thing as diminished criminal responsibility/not criminally responsible which depending on the context with autistic people should be a valid defence There is also an ethical problem with throwing an autistic person in with people with antisocial personality disorder in prison may lead to things like lynchings and prison rape What is your response to my aforementioned points?

It's rarely enough to be a total excuse for illegal actions. Though it is important to consider when sentencing.
