Daily Driving time increases from 9 to 10 hours are linked to the fixed week which is defined in the regulations and not with weekly rest periods.
@ADRTrainingIreland
@ADRTrainingIreland 6 ай бұрын
Defined in what regulations? Do you mean they are part of Tachograph legislation not working time directive?
@Revellien
@Revellien 6 ай бұрын
@@ADRTrainingIreland EC561/2006 only defines one type of week and that is the Fixed week in effect Monday to Sunday. The “Fixed week” governs anything to do with Driving time - 2 x weekly increases, 56 hour max and the 90 hour fortnight (2 fixed week rule). A max of 3 Daily rest reductions are allowed between any weekly rest periods - the 2 daily driving increases from 9 to 10 hours are bound to the Fixed Week and crucially NOT between Weekly Rest periods. For example a driver could take off Thursday and Friday and drive 10 hours on Saturday and Sunday (if he didn’t drive 10 hours MON TUE or WED that is) and as a new Fixed week starts on the Monday he could drive 10 hours on the Monday and Tuesday and then take off Wednesday and Thursday. He is allowed to do this (in effect 4 x 10 hour drives on the bounce) as each pair of the periods of 10 hour driving fall in different Fixed weeks and are not related at all to when the weekly rest was taken.

Hi Martin, There is no maximum time as far as I am aware. You could take your 15 minute break after 3 hours and 14 minutes then do a minute driving and then take you 30 minute break. You could drive a minute and then take your 15 and then drive 3 hours and 14 minutes and take your 30 minute break and then drive for another 4.5 hours. There by driving 1 minute short of 9 hours with only a 30 minute break. This is a deep dive into tachograph lol

Firstly you should not have ran out of driving hours and that is a problem caused by your Transport Manager. You may not drive for more than 56 hours in a week or 90 in a two week period. What you do instead is between you and your employer. Working time directive says you may not work more than 48 hours per week when averaged out. How you deal with that is also between you and your employer

Hi mate, thank for this vid.. very helpful.. i have a Q, perhaps you can help as cant find help anywhere else. I just got my new minibus and starting a tours business. Im just getting started and try to insert my digital tachometer card into VDO tacho machine, I go through initial few questions then it starts flashing a message saying security breach 47 and pits my card back out! Ive tried looming for help but all anything says is “check the card” which isn’t v helpful. I only got the card about 3-4 weeks ago. Cheers for any help you can offer.

Hi Fred, sorry for the late response. The first thing I would do is try another card in the machine to determine whether the machine or the card is at fault. If it is the card which it probably is you can return it and have it replaced at no cost to yourself as it is faulty. If you are returning it in Ireland to the RSA you will have to pay €45 initially which the RSA will then refund. You may drive 3 weeks without a card if it is faulty but you must keep a manual entry write down everything you do with times and duration. Driving 4 hours, rest 45 minutes etc.. Let me know how you get on

3:20 To my knowledge you do NOT have to compensate the 2 hours shortage if you are doing a 9 hours break. Correct?

Hi, Yes as I state in my comments that was a mistake. You do not need to get back reduced daily rest, Only reduced weekly rest. You are correct!

Do you mean your Tacho is showing the wrong time ? Is it set to the correct country ? Should ask you when you turn it on. As long as you are driving within Tacho legislation breaks etc you should still be fine. Get your employer to get the Tachograph fixed.

what if you take 20 mins to get on a ferry, but for example the truck in front if yours is faulty and blocks you exiting the ferry for 45 mins... so your embark/diembark total time is 65 mins....5 mins over allowed time.... what happens?

You break tachograph legislation !! If it is a one off and was unavoidable you would hope the police officer would let you go. If it shows on your card ir truck you do it every other week then you are in trouble.
