"we don't exactly deserve to mod their games, it's not how it works" It USED to be how it worked. Contrary to how you seem to think it is, when you bought a copy of a game in the past, you were actually allowed to alter and modify it. Infact many franchises people adore to this day were made by people who bought a game, and then modded it and in the modding process created the new game, literally in the old game that they modified so far it wasn't even recognizable anymore. The problem is that people have accepted the new norm as 'well they said we can't, so we can't' when even in a legal and judicial sense, evidence to the contrary exists in the form of multiple copyright defense law. The issue is that the ones who have the balls to fight it, don't have the money, and those who have the money don't have the balls. Even on the mods/emulator lawsuits, nintendo didn't succeed, they simply out-spent, by bringing in the lawsuit and making the defense pay over and over until they ran out of money by stalling the case, which is the standard on how companies like nintendo and disney 'win' lawsuits. It's essentially winning a race by shooting your opponent in the leg at the starting line. Yet people keep accepting it as proof they can do what they want.

One thing is modding a game, other is making money with it. Claims demonetize the videos, youtubers usually take down demonetized videos and say the claim took it down. I don’t think a youtuber should be able to make money using someone else’s product and be immune to copyright claims, i mean some of them sell stuff in their stores which are clearly mario stuff

@@GL-tj8zg copyright on videos is covered by fair use (this is something that youtubers have fought in court and won on). This is because they are using the item someone else made, in a transformative way, due to the fact they are actually playing it, and thus the gameplay is exclusive to them. This also covers modding the game and making gameplay of that. As for merchandise, such as clothes, toys, etc. Those are areas nintendo actually does have grounds to make some profit off of it at the very least. Everything mentioned by me, and by you, except the merchandizing rights, is on the content creator's side in copyright and thus, in any instance where the creator had the money to fight them, they could and they could win.

One of the many unfortunate aspects of people letting themselves get gaslit by multibillion corporations to obey them for reasons little more arrogance. In the grand scheme of things, content creators will never notably impact a company like Nintendo's revenue stream, but their own size means they see any and all uses outside of what they want as something to be crushed. Because it's been perpetuated for so long, no one is brave enough to actually stand up against those kinds of companies, even if we'd all be better off for it, since most people as is the case in SO MANY other situations, look at it in the light of "well, that's not MY problem". Kind of sad tbh, and how companies like Nintendo has been approaching this stuff lately feels so unbelievably childish for a multibillion dollar conglomerate.

Doug is a moron when it comes to anything political, intellectual, economic, racism or what. I don't know for certain but it seems he grew up fairly privileged monetarily and has little understanding of the outside world beyond a very vague 'feel good' ideology that is part of the main cause of our current political system. People thinking polite equals right and complaints are wrong. In this case, Doug isn't technically wrong only because legally most games have Terms of Use and are software leases now, a dirty way to try and control your content more. Even so he is actually wrong because I don't think any game ToS has really been held up in court, largely because 90% of them ignore point of sale laws and fail to warn people about said ToS.
