This documentary does not even begin to show half of the evidence that was presented at trial. There is so much information left out. Abuse is very often a factor in parricides and the idea that both kids would kill two totally benign, wonderful parents is statistically implausible and factually untrue in this case. The brothers had an incredible amount of corroborating evidence, including photographs, medical records and 50+ witnesses to corroborate sexual, physical and psychological abuse . It's one thing to make claims about the parents, it's another to have so much corroborating evidence to back it up and to have almost the entire family of the dead parents back it up. Also, they had been told they were already out of the will long before the homicides by their father and they knew that their father's five million dollar life insurance policy was not in effect. They thought/knew they had nothing to inherit when they killed their parents! The prosecution also failed to get an indictment on murder for financial gain at the Grand Jury in 1992. Not surprisingly, this documentary decided to leave all this out since it didn't fit their narrative.

@@williamtobin7282 Their story was slowly coming out in bits and pieces to their jail psychiatrist over the course of many months shortly after they were arrested. It didn't just pop out of nowhere a year later. Other people also knew about the sexual abuse before the killings. And they had hard evidence that they could not have faked (e.g. photographs, medical records) Also it's not my theory. I watched the whole trial. The greed theory was debunked at the trial so much so that the prosecutors gave up arguing it in their final statements. The point is that they didn't know PRIOR to killing the parents that they stood to inherit the money. Carlos Baralt, the executor of the estate, testified that Jose had told him several months prior that he had told the brothers they were already disinherited. Marta Cano, Jose's sister, testified that she had tried to talk to the brothers about the money they were getting, shortly after the deaths, and they kept cutting her off saying that their dad took them out of the will and they weren't supposed to get anything. It later turned out Jose was bluffing and hadn't written a new one but the brothers and other family members had been led to believe there already was one and that it disinherited them. Also the brothers knew the father's 5 million dollar insurance policy was not in effect at the time they killed. They would have waited for that if they were actually killing for money. I realize it's an easy link between post -crime spending and motive for financial gain but it's not that simple in this case. I don't disagree that their father was a cruel perfectionist, but he was not ONLY that. There's evidence to support their sexual abuse claims in addition to all the other forms of abuse that went on. And it does not solely rely on the brothers' word.

Their defense wasn't that they killed because of the abuse. That's what the prosecution wanted to claim, particularly in the first trial, because there was so much evidence of the abuse. The position of the defense team was that they acted in "imperfect self-defense", which is an unreasonable but sincere belief that your life is being threatened and you kill to avoid being killed. It wasn't hard to convince both juries in the first trial that there was enough reasonable doubt to the prosecution's case because the brothers said that Jose had many times threatened to kill them if they exposed his abuse. So when Lyle said he knew about Erik, and that if Jose didn't stop touching Erik, he would tell everyone, Jose became menacing. He threw Erik on the bed and Erik had to run away. So it was believable that the brothers thought the father would kill them.

They must have been riled up with anger and hatred. It's a pity they chose this course of action. Their mother was also a victim of circumstances! I can't believe how many people believe their bullshit defence! They may have been treated harshly by their father but he also got them out of trouble so they didn't ever pay for stealing & other criminal behaviour! These guys shot their parents cos of sheer greed - they wanted the money! The spending spree behaviour & the death threats made to the therapist proves what sort of people they were! I don't believe one word of their bullshit!
@moviemonster2083 Жыл бұрын
I believe in this case, whatever abuse suffered from the father was not essential to the story, except that some of that abuse was in raising amoral, narcissistic, conscienceless murderers and parricides. The excuse of 'abuse' as a precondition for murder of the supposed abuser just doesn't wash. From what I've seen of cases like these, the abused by definition DON'T commit murder, not even in self-defense, not usually. That's what the abuser does. I'm sorry, abuse is just another false alibi to exonerate murderers, from Lizzie Borden on down. And, like with Scott Peterson, their subsequent behavior after the crime and what we find out they arranged before the crime, demonstrated further their psychopathy. If it had been in any way 'self-defensive due to abuse' they wouldn't have set up this lying conspiracy; once again, it's not what the 'abused' do. It's what murderers do. Eric announced their motive in that screenplay: they wanted to murder their parents for the insurance money. It was not 'abuse' that made them do that. It was a narcissist's greed and psychopathy. Just like their post-murder spending sprees. The conscienceless, shallow, vulgar satisfaction of stupid desires for luxury typical of these types.

Even when you manage to leave as a fully grown adult, these types of abusive parents will stalk you, harrass you, denigrade you, call you constantly, threaten you, use both the sugar and the stick to manipulate you, make empty promises of good behaviour including offering money and items, and do anything they can to get you back under their thumbs. Such parents can drive you to have a mental and emotional breakdown. The combo is usually a violent, abusive father and covert (vulnerable) narc mom (who is only looking out for herself and even teams up with the father against the kids when she isn't playing the victim). While the parents are dysfunctional and have a terrible marriage - to the outside world they present themselves as normal and even friendly-social to strangers. These types of parents never leave you alone, no matter how old you are and they are unbelievably persistent, as they view their kids as their possessions. You can never be free of these types of abusive parents until the parents are in a home for the sick and elderly or dead. If you haven't lived this experience - you cannot understand what it's like. Even if not all kids of such parents end up killing them - such thoughts do cross your mind after you have endured decades of such abuse. If anyone is in such a situation, please try to move far away from the parents as it will give some relief but be prepared to handle stalking and all kinds of long distance abuse tactics.

Sometimes, I watch these true crime stories and I think I wasn't even born when these things happened. It tells us that the world is filled with evil and is not going to end anytime soon, so the lesson is to be watchful at all times. Also, the Bible admonishes parents not to provoke their children. Parenting is not for everyone, don't have children when you know you are not going to be loving, patient, and kind to them.

The questions here always boil down to why they did it and who is to blame. I think its obvious why they did it. But who to blame is not that cut and dried. IMO, both parents and boys are to blame. By covering up his kids' transgressions, they were actually creating monsters. Protecting family reputation came before his kids. There was no nurturing here. The family facade was just that. A facade.

The parents from Hell. Had this crime been committed and trialled today, I believe the outcome would have been dramatically different. I also strongly believe that they were denied a fair second trial and that the exclusion of crucial abuse evidence denied Erik and Lyle the opportunity to fully present their case, further undermining the fairness of their conviction.

The simplistic remarks are overlooking the genetic possibilities, grandpa Menedez SAd dad, dad SAd son, son SAd brother. Should brother have been murdered too? Why should a pedo be let out of prison? Consideration needs to be placed on why they refuse to have a diagnostic assessment. ODD, a neuro diversity, in childhood leads to psychopathy/sociopathy, it is genetic and exceptionally dangerous if left untreated in the early years of childhood. The arrogance, lies, retribution point toward, at the very least, the need for a full psychiatric assessment.

@@SatieSatie Yeah, family members spoke about it. In fact, 50 witnesses testified for the defense. Apart from the police, the main people who testified for the prosecution were Oziel, who was shown to be dishonest, friends of Lyle, whose stories were all torn apart on the stand, the gardener who was there part-time, and the maid who didn't speak or understand English. That's why the jury was hung - the prosecution didn't present a tight case beyond reasonable doubt.
