That is a constitutional right. She is unlikely to ever be charged under this statute, so she is not relevant.

Every hypothetical uttered by the Justices in this clip focussed on the *act that might cause obstruction, while ignoring the *intent of the act. If the intent is clearly to stop an official proceeding, not just protest it, then it should be prosecuted under that law as a crime.

They were not a monolithic group. None of them had firearms. The vast majority were practicing their first amendment right to address their grievances through the right of protest. Some vandalized which should be punished by the law. Some committed violent acts which also should be punished; but the vast majority did not do those things. The Supreme Court will not get swept up in media hype or propaganda. They are the last wall of checks and balances between we the people, the government and the media as well. They are there to protect the Constitution and not protect a narrative that the media or the opposing party pushes. The Federal Government has been terribly corrupted. When you have a government who goes to war based on lies in which over one million people die as a result (Iraq) that's enough to make a large portion of Americans severely distrust the government. There are so many other events in over the past 30 years that have broken that trust.

The way that law is worded they could equally apply it in both cases - they need to get the law articulated properly and these DA's use these generalities in descriptions to go after anyone they want, and none of us can do anything about it until we appeal a conviction. Everyone should be disliking the ambiguity of this law the justices are simply calling it out.

The comparison isn't the point. They're determining a question as to a specific charge. What constitutes obstruction of an official proceeding? Whether you are an insurrectionist or a heckler is immaterial; it's whether your insurrection or heckling disrupted the proceeding. The point of them asking these questions is to determine the scope of the law, and how broad or narrow it is, or whether it applies to anything but financial crimes given that the whole act specifically relates to financial offenses.

There's been protest throughout the decades in america when it comes to proceedings being delayed but when it comes to jan 6 it was different. Some people were demanding to see pelosi, pence and some other politicians to be executed. They were going through the capital looking for them and doing vandalism. That doesnt happen in a protest. People can be angry or sad, have picket line and shout civil right until your voice is horsed. When you promote violence to get what you want that simply isn't a protest. I dont expect everyone to go to prison for what happen, but when you're there by association and knew about it that couldve stopped it thats when you get in trouble with the law. There is good amount people in prison for crimes that were guilty by association(rape, burglary, theft, murder, kidnapping and etc)

I appreciate what you are saying. I would like to add, if I can compliment your statement. Some people think "common good" is like helping poor people. And other people think common good is like banning french fries because those are not healthy. But in America "private rights" are the foundation. After private rights are secured is when we can build a Common Good. Common good is the exposure of the intent to commit an act of violence and preventing the execution of that violence. I believe you are saying that these people were broadcasting their intent to commit an act of violence. So I perfectly understand your position. I'd also like to add that perhaps security was neglected for the event. According to your statement that neglect could be "trouble with the law." But I don't think so. Washington DC was a lunatic asylum ever day after dark for weeks before January 6th. Live streamers from everywhere in the country were out running the streets all night. I think January 6th was the easiest day the police had at work for months and months. I think that day was at the end of human endurance as a police officer. I offer we need to be careful. I think attacking private rights of individuals DOES NOT serve the common good. I uphold private rights first and then common good second.

@@davidmanny5298 I think if you were to compare this to that in such a way then it is interesting to see that both conditions happened under conditions that included a nearly non-existent police presence. And the absence of police was more likely due to exhaustion in terms of human endurance before it could be viewed as police allowing the events to unfold for serving a political power grab. You didn't mention the police. But I believe both situations would have played out differently if police were equal to their tasks. You were talking about punishment for offenders. I'd like to add that police need help, too.

Those counter examples given by the Supreme Court weren’t very convincing. All of those examples were things that are done in the lead up to a decision where you hope to influence a decision or election to your preferred outcome. For 1/6, the election has already happened in Nov… too late. If their goal was first amendment speech to influence an election, the time to do so was before the election; to do so on 1/6 isn’t to express yourself and convince people in an election, it is to deliberately undermine the election.

I've developed a very low level of confidence in the US justice system. Even when otherwise sensible action is taken against the lawless, there is a decided deference accorded to the more rich, connected and powerful. An ex-con can mistakenly cast a vote, done with no intention to defraud, but can get a 5 year prison sentence. On the other end of the spectrum, even if the Orange Pustule is convicted on every criminal charge he faces, I'd put money on his never getting a custodial sentence. And don't forget that Michael Cohen served time doing a crime at Dump's behest and for Dump's benefit. Such a vast disparity in treatment of criminals sickens, disgusts and infuriates me. This fact of Lady Justice most decidedly not being blind, and that the Supreme Court is a cabal of unaccountable rogues, and that essentially half of Americans are seemingly ready to jettison democracy, and more astonishments besides, has my head spinning at the rapidity with which that blighted nation is descending into a nihilistic insanity.

I enjoyed my time living and working in the USA (NYC 1991/95 and Atlanta 2011/13) but I so prefer my home country Australia. We have an outstanding High Court (SCOTUS equivalent), justice system and police force. And a Trump could never get through the Westminster adapted system and be the national leader.

It is just utterly, utterly disturbing that the Supreme Court spend/waste time to argue this obstruction of justice appeal. Comparing it with so many other cases e.g.interruption at the SOTU, yelling in a movie theater a.o. is just nonsense. Yes, it has to be taken care of but the awful 1/6 event IS, unquestionably, obstruction of justice. And without the slightest doubt, Trump had played a significant role and so did many others, active/retired, from all walks of life. It truly looks like the Supreme Court is trying very hard to protect Trump. IT IS RIDICULOUS AND MOURNINGFUL. And yes, Thomas needs to recuse himself from this case. The Supreme Court is not telling us about Thomas's absent to avoid a commotion.

Term limits for all Federal employees including the Supreme Court and mandatory retirement age of 75. The exception being those running for President or Vice President : not exceeding age 60 to run. Separately. the people at the January 6 insurrection had been called to the Capitol specifically to disrupt the certification of the free and fair 2020 election and Donald Trump from the Ellipse told the armed crowd to go down to the Capitol and stop the certification count "or you won't have a country anymore."

Supreme Court Justice Clarence Thomas has not recused himself. His wife's involvement in the January 6th insurrection should have been sufficient for him to set these proceeding out. "Ginni" Thomas made compromising calls to then Chief of Staff Mark Meadows and suggested Former President Donald J. Trump basically should not accept the results of the elections. Ms. Thomas has never been properly investigated.. Mr. Leo Leonard is refusing to have any accountability to the Senate on his involvement with the billionaires financial support of the Clarence Thomas's lavish lifestyles. We are just regular people but we have the right as American citizens to ask them questions as well. Its wrong to ignore the "elephant in the room."

Donald Trump himself had stated the goal of the "protest" was to delay the Jan 6 certification long enough for his people to come up with evidence of vote irregularities. Therefore, the goal was to disrupt the Jan 6 proceedings to prevent the vote from happening, and the chosen method to achieve goal was penetrating the Capitol. This was not a protest that has side effect of delaying vote, this was an event whose goal was to delay the vote. However, I could see arguments that the people who attacked the Capitol were just following orders to attack the Capitol to protest without knowing that the goal was to prevent the vote.

Flat out, we were NOT prepared to handle a Jan 6th event. I'm not convinced we are even today prepared to handle a repeat of the same or similar event. This is a weakness. Our government should be creating rules and laws and processes that will respond to such an event efficiently and effectively. I have no confidence that is being done. I hope I'm wrong.
