Bester requests access to a laptop: Elton Hart weighs in

Convicted murderer and rapist Thabo Bester has made a plea to have access to a laptop in order to prepare for his upcoming deportation case. Bester has formally filed a court application requesting access to a laptop and a modem.
He is currently facing charges of escaping from the Mangaung Correctional Centre in Bloemfontein in May 2022, fled to Tanzania with his girlfriend Nandipha Magudumana. They were arrested and deported to South Africa.
Bester argued that he is unable to defend himself if he does not have access to the device. He told the court that laptop he is requesting can have limited access like most others in prison. The case has been adjourned until Two O' clock for Bester to file a replying affidavit.

Irrespective of the person and his convictions. Bester argument to the Court was objectively brilliant. The judge failed to follow the rule of law which is the audi alteram partem rule, hear the other side apply your mind objectively before making a decision. The judge in just dismissing him before he could plead his case acted ultra vires and prejudged the issues and acted to Besters prejudice. Bester was brilliant in his arguments and fundamentally was on point which reasoning the judge should have applied her mind before coming to a decision. Denial by the state for access to tools to put forward his side of the issues is definitely infringing on his right to a fair trial and thus access to justice. His request was reasonable under the circumstances.

Truth be told Thabo was correct and the magistrate was found sleeping and i can tell u now she will treat him differently going foward. Law is law.

Him being convicted of escaping is only being delayed by the fact that for some reason the state insists of holding his trial with people who were not in jail in the first place cause they helped him for money and because of that a lot may still come to light
