I keep hearing different rules. I had DACA and I lost it because I did not renew it after 1 year. It expired 04/22 Im single and have never married. Am I eligle for PiP?? I take care of my mother and have other siblings who are citizens and live with me. I also do not have any citations or felonies nor minor tickets.

I thank you for your video and your responses. I saw someone else asked a similar question but I wanted to see if you could clarify how the process will work if you have an I-130 already. It would seem to me that having already submitted that information would speed up the parole process. My specific question is will there be a way to submit the I-130 instead of re-filing the same information again?

Does getting approved for PIP mean that we loose Daca ? I’m a little confused since I would technically loose my job without Daca right

No, you can maintain DACA and apply for PIP simultaneously without affecting DACA.

​@@DarianLawI looked over the FAQ posted on the USCIS website and it states: "If you submit a DACA renewal request while in a valid period of parole or are in a valid period of parole at the time your DACA renewal request is adjudicated, USCIS will deny your DACA renewal request as a matter of discretion." So we technically won't be able to renew daca anymore right?

I am eligible for Biden's parole in place, my husband and I have been working on submitting the I-130 but it has NOT been officially submitted to uscis. My question is should we submit it before this new program applications roll out on August 19th or wait until we get an approval of this parole in place? The timing of the I-130 doesn't really matter (as long as you are eligible for parole). You can submit it now or after your parole has been approved.

The issue is that the multiple re-entries might create a "permanent bar" issue if (1) he ever received an expedited removal order, or (2) he ever overstayed in the US for more than 180 days and then re-entered within 3 years, or (3) he ever overstayed in the US for more than 365 days and then re-entered within 10 years. If there's a permanent bar issue then he'll need to stay outside of the US for 10 years. You should get a copy of his background from those other lawyers and schedule a consultation so that we can go through everything to see if he qualifies.

How about the person who was deported from airport for overstayed turist visa more then 20 years ago and and crossed the border 15 years ago and is married to us citizen more thwn10 years ago, can the person qualify? No criminal history, good income and always paid taxes returns

Maybe. I would have to screen for permanent bar issues if the person entered too quickly after being deported. If there's no permanent bar issue then the person probably qualifies.

yeah but you might be able to get away with just submitting all of your DACA approval notices since 2014

Single people might still be eligible for parole if they have an immediate family member in the military, or if they have DACA or TPS. But to qualify for the new program they must be married.

No, that is not the same thing. That is an ICE order of release.

@@Tendiesforlambos Oh, then that's completely different. If your spouse entered the US legally with inspection then the process is generally very straightforward.

If your spouse qualifies for Biden's program then it is definitely faster and easier than a waiver, and it's cheaper too.
