So if you think you might have a problem with someone leading up to litigation, keep a record of everything which you can then present in court. He usually charges five hundred guineas an hour for that kind of advice 😄

After working for a company that were a bunch of shithouses, when I was asked verbally to do something, I got into the habit of summarising the conversation in an e-mail, and sending it to the manager involved saying "thanks for the chat there Myr*n, from what you said, I understand you want me to do X, Y and Z. Can you confirm that?" It stopped a ongoing issue of being told to do something only to be told later that "No, I never asked you to do that at all".

This should always be done with job offers, no matter how well you know and trust those making the offer. Omitted doing this with a national charity's eBay manager position a couple of years back as the job started immediately. They then claimed I'd been volunteering. Fortunately I'd taken full notes at the job offer meeting but it later transpired neither of the two managers present had.

I used to do that when I was a school principal including as a follow up to conversations with the ministry. It was amazing how many people would suddenly remember what they actually said in the phone.

All good advice and would certainly follow it except how do you read all the paperwork involved in hiring a car? I recently had to do this and was presented with an IPad and requested to sign here, here and here.... Clearly this was a multi-part, many pages contract which would have taken a long time to read, understand, etc. What to do? Also I had reserved and paid (there's a discount for prepayment)a particular car which was a saloon and on arrival I was told that was not available (and they had the right to change the vehicle as long as it was in the same class. This was stated in the contract I had signed) and was given a small suv. I accepted as couldn't see an alternative. Do you think there was one?

I took my car in for an electrical installation (security device). My dashcam logged some unusual mileage, I checked it and found that the garage used my vehicle for 'call outs'.... electrical installation was free, as was the apology. We just don't check enough what others are doing with our stuff.

Very good. I had a dispute with some builders over scaffolding to be erected on my land for the benefit of my neighbour. The builders had "Rogue Traders" written all over them so I did due diligence on them which confirmed my suspicions. I presented this to my neighbour but they went ahead. The builders broke our verbal agreement over the scaffolding so I sent them packing, they threatened to sue me, unfortunately they backed down so I didn't get the chance to play the recording of our conversation in court. Instead they threatened the neighbour and she paid the builders about £1300 for breach of contract, much to my annoyance.

for the past 20 years, I've photographed all building work that I've done that is covered up, things like depth of foundations, drains, water pipes, electric cables, etc. anything which can't be easily inspected after the job's finished.

I knew a guy who dug the foundations for his conservatory and was mocked by the builders saying you could have got away with half of that.

@Andy Smythe All court proceedings have to be proportionate & reasonable to the claim & to the costs of dealing with a claim Unlikely a judge would ask for foundations to be dug up to measured accurately More like judge will accept the photos or videos and ask an expert to use said as a sensible reference point You can literally scan a 2D photo or video these days to create a 3D model to look around It wouldn't be conclusive but imagine how useful it could be.

@@PMA65537 that’s true a conservatory only needs a 18 inch concrete footing as holding up a single storey building basically it goes by weight and all that

I always film myself opening deliveries and to date, it has saved me a lot of hassle when the product was found to be damaged. Quite often the sender would attempt to dispute this, but as I showed the video, they always backed down and rectified the issue. It's excellent advice.

I am expecting that a very expensive item is going to be delivered to me before Christmas, and I will video its delivery from the point the truck stops outside my house. (The delivery will have be arranged so that I am in to receive it.)

Michael Schumacher famously signed a letter of intent with Jordan F1 team who gave him his F1 race debut but his representatives changed the wording before he signed it, instead of saying "We will sign 'the' contract in seven days" they changed it to "We will sign 'a' contract in seven days", this allowed him to sign "a" contract with the Benetton team instead of "the" contract with the Jordan team. This was upheld in court.

If you do cross out parts of a contract and send it off, maybe also film/photograph/photocopy that in case they replace some of the pages in the contract with ones that are not crossed out or even add new pages in, you have proof of what you actually signed.

My council landlord told me I must not audio record housing officers phone conversations and that I had to remove my CCTV cameras. I still record them and my cameras are still up and with regards to their threats to evict me .... I'm still waiting. I secretly recorded a work capability assessment in a building that stated recording equipment was being used ( this covered me to use my equipment) My assessor deemed me fit for work but on appeal I submitted word for word transcript of the assessment and the recording and the judge accepted it as evidence and I won. Another assessment again secretly recorded, the assessor lied about her qualifications this again being overturned on appeal. I then submitted the same evidence to the N M C as nursing staff get struck off for lying. At the hearing I was unrepresented and pitted against her lawyer. He said that I had doctored the recording despite having a witness in the assessment with me. She won her case but it doesn't change the fact that she lied. They seemed shocked however to find out at the end of the hearing that I had recorded this to! Police data protection officer informs me that where ever their are signs stating that CCTV cameras or recording equipment is being used then this also covers you to use equipment in those same areas eg; council offices, police stations, job centres. My local majistrates building however has a sign inside the building saying do not use recording equipment so to do so would be illegal If anyone has any doubts about if they can record or not my advise is to go ahead and record and this can always be deleted if you really should not have recorded something within the eyes of the law. The main agenda is to protect yourself in the first instance and argue the toss after. After being accused of tampering an audio recording I now have some proper covert video recording equipment.

I found out the hard way about the private parking....Rules....I was at Starbucks, over stayed two hours and got charged £60....my friend fought it...and refused to pay....I stupidly paid! ( I thought as long as I was at the Starbucks I was a customer....lesson learned....(I talk too much....a two hour parking limit is too restrictive for me...found another coffee place with unlimited parking....) sorry Starbucks!

The ellipsis ..., . . ., or (as a single glyph) …, also known informally as dot-dot-dot, is a series of (usually three) dots that indicates an intentional omission of a word, sentence, or whole section from a text without altering its original meaning.

One guy (who was videoing some actors on tea break from filming a period drama) documented a 'brutal assault' to himself which took place in Lloyd Street, Manchester by a bald gentlemen working for the filming company claiming to be a police officer before the 'real' police arrived. Luckily he had evidence and sued him and the filming company for thousands of pounds worth of damages!

I think that was Charles Veitch, and he was filming the film set not the actors. But yes he did film the assault by the 'security guard' and sued for it and won. I would be more worried about the amount of security people who think that they can dictate what people can do.

When I saw the heading about the 4 things I immediately thought that having a will should be the first, have a decent lawyer, sell everything third, and finally don’t get caught doing anything in life which will be used against you…by any lawyer or similar.

I once took out an educational contract for my son. I didn't read the little print well enough but soon found out that the purchase had been sold to a finance company so I finished up with a 5 year debt. If all had gone well I would have continued with it but I got a nasty letter from the debt company which was totally out of order. I keep every scrap of paper and was lucky enough to find a get out clause that fitted my case. It took the company about a month to realise that they were going to be taken to court and sued but someone spotted it and they agreed to refund all my payments and terminate the contract, which I agreed to. Keep all your paperwork as initially you don't know if things will go wrong later.

Thank you again for taking the time to explain the law to followers of your channel. lot of legal genres, like Judge Rinder and Judge Judy seem to be purely entertainment and dont have any education value and explain the legal principal of the cases, and how to avoid legal pitfalls for yourself. As a documentation professional (for over 20-years), I'd add one key point: Make sure your notes/records are contemporaneous (i.e. created at the time of the incident/issue, or as soon as is reasonably possible after the fact). This ensures that you're recalling the key details while they're still "fresh" in your mind. It also covers your proverbial behind if you take your notes in an app/tool that uses metadata to log when the record was created (aka: date and timestamp). Debunks claims that you made it all up "at a later date". All of this can improve your credibility in a legal argument. They proved *invaluable* to me in divorce court.

If I fill out forms I always put N/A in the space. If its Not Applicable as I wont leave blank spaces.

@@BlackBeltBarrister This unfortunately is becoming more common and the counterfeits are getting better requiring greater skills in spotting them. For example if you look at Apple earphones on Ebay there are many listings that look highly suspect. I also recommend not buying out of China due to the language barrier, uncertain source of the item, unknown quality and unpredictable delivery.

Here's a tip if you are in property in England or Wales. Set up alerts with HM Land Registry for activity on property you have an interest in, and for family, as they email you as soon as something happens, like a sale process starting.

I took my car into a main Dealer because the airbag had a free recall. They asked me to sign permission which I did but wrote over the contract 'NO CHARGABLE WORK TO BE UNDERTAKEN. Forty minutes of waiting the service manager sits next to me and says 'we've discovered a fault on the Ecu, we've got the part you need and it will be another forty minutes or so'. I told him loud enough to make the showroom echo that the car was running perfectly when I brought it in, if they've been messing about with it then they had better put it back the way it was or I'll get Trading Standards up here'. He replied 'You are Mr Green are you' reply No, Oh I'm sorry Sir I've got the wrong customer'. I thought Really, so that's how you get to make a profit from unnecessary or invented work.

Its very wise to have a camera viewing your gate and entrance ,several times i have had a message telling me something was delivered and it wasn't .An email to the courier stating this and how much CCTV footage do they want before and after the stated time they say it was delivered usually gets a result it was an 'error' and it will come the next day .I have even video'd a parcel van stopping outside to get a GPS fix then driving off . trust no-one!

My tips, check if your mobile phone has an auto record feature of all your calls. Some phones have it built in. If yours doesn't, try downloading an call recording app from your app store. They are worth their weight in gold 2nd, download or use your phone's voice recorder feature if it has one. It is so easy to switch it on at any time, and most minimise into stealth mode, so the record screen is not visible. I've found mine to be invaluable during medical consultations, where the doctors written report, varies significantly from his verbal discussion with me. Also excellent when involved in any type of verbal dispute or verbal contract where you can't or don't want to shove your phone in someone's space to video them. There should still be ample audio evidence on your phone.

Considering ignorance of the law is not a defence against that law, it is astonishing how little people like me actually know about the law. I check packages that arrive video opening them. Likewise when I send something back I video or photograph with 'today's paper' in the image. ... I honestly thought I was being slightly fussy, but it's good to hear someone else does it too.

My top tip, when paying for services, products etc. always get a written receipt, date & time, people involved and cost. Do not take things for granted, do not over trust anyone. Essential telephones calls must be logged, recorded, peoples names taken.

When parking your car photo those around it including registrations front, back, to the side and across the road, from my experience it's parking near large vehicles when you seem to end up with carless damage like vans, people carriers and 4×4s.

@@dshe8637 Usually any paint left on the car or height of damage would give a clue which car did it, you can report as hit and run to police if not reported to them in 24hrs, post office can give details of keeper fill in form, your insurance company can get info on other cars, if you have address of car you can go photo any damage it has.

@@marklittler784 I guess if your car is expensive, your insurance company might be interested. My daughter's car was totalled by a neighbour in the shared car park and despite his having her paint on his car, neighbours hearing the impact, his engine being warm, his being parked bizarrely, police attended but weren't convinced. Hers was an older car, so she just scrapped it and bought a new one, which she parked at the far end of the car park!

What if people don't know their rights and don't know where to look for information...? And what about cookies, personally to me what companies do are illegal/immoral, forcing you to agree with contracts just that you could access your bank account or just pay bills. If I have a contract with bank or energy supplier or some other company, WHY I have to agree with their subcontracts (cookies) which I don't want to...?

I would endorse the idea of reading delivery information carefully as well. Often the delivery information will say things like the courier should wait for you to open a package to check that the item is not damaged, and if they will not wait then you need to report any damage within so many hours.

I started filming opening of most parcels for a few months now. Just mentioning the fact has eased at least two returns. I've not yet had to produce the video.

My car was taken away to be insurance assessed after a minor accident, I photographed inside and out and when I went to pick it up a few days later it was more damaged and filthy inside - had to threaten my insurers but with the evidence they had to pay me damages!

I'd agree that for any contract involving the supply of a service you should write down what you think has been agreed. You really need to be quite diligent in reviewing what agreements have been made, especially if the other party wants to insert an Entire Agreement clause as this means that what in in the contract, and only what is in the contract, is agreed.

Can you please comment on the situation where massively big long contracts need to be signed by consumers for relatively small domestic contracts. IIRC this is under some kind of UK consumer law revue.

Good advice as usual. I purchased some power tool batteries...whilst trying to charge the batteries...one would not take a charge,,,,indicated by a FLASHING RED LIGHT on my charger... I reported this to the seller who asked me to send a photograph of this....I explained to the seller that this was impossible as the the light may be on...or ...off...at the time of the photo....(a video may be better me thinks).... Anyhow ...they sent a new battery without the need for the video.

When renting a house, make photos of any existing damage when moving in and share that with the rental agent and the landlord at the start. A later fraudulent attempt to steal your deposit can usually be stopped immediately by referring to before and after photo evidence.

Also, photograph the serial number of items you sell on on-line marketing sites or send away for repair. This can avoid a lot of problems further down the line.

With packages are you not signing it's all in order? You need to get driver at least to write box damaged on delivery note. If I get a damaged box, depending on item I just give it back and refuse delivery as damaged. I don't even check it. Seller see's they are getting back, are normally quicker to send a replacement or refund. Also they get delivery refunded and damages are covered by the couriers insurance.

When collecting a hire car, video the vehicle exterior and interior, pausing to highlight any scratches, dents on the outside and upholstery marks, stains or imperfections on the interior. Photograph the fuel gauge and mileage. Peace of mind for when you return it at the end of your trip.

During my studies at Abertay University I used to hire a vehicle most weekends to take my family out. Hertz had a rental office right in the centre of town that was very convenient. It was generally a Ford Focus that they gave me and quite ofter I found some part of the vehicle was dirty so, having the cleaning materials at home, I would for example clean the brake dust off the wheels. This particular week they gave me a dark red Focus and over the weekend I noticed that a lower body panel was dented. Now I knew I had not damaged the car so it must have been the previous customer. When I took the car back I said nothing and they accepted the vehicle no questions asked. A few weeks later I overheard two staff members discussing damage to a vehicle and how they had no idea when it happened and which customer was responsible.

One of the most critical things to do in contentious phone calls is to make a contemporaneos file note. It is not as good as a recording but it is the next best thing. But do NOT fabricate the date if you use a computer to make the note. You can be caught out by metadata. I make my file notes immediately after the call from memory. It is probably better practice to make rough notes from which to prepare the file note. Keep the notes and date and time them. Think carefully about keeping records if the document could be used as evidence of conspiracy, criminal or civil. And don't forget formal forensic discovery is intrusive and exhaustive (as well as exhausting!).

This is a good idea, and is one advantage of CCTV or a doorbell with in-built camera as sich footage can be captured automatically without having to worry the delivery driver.

I once had a contract given to me to sign by an estate agent (to sell my house) that was 4 sheets of A4 paper un-nunbered, no document reference, or anything to link the pages and the last page was just my signature... They wanted me to sign a blank piece of paper! I refused of course and they were dumbfounded... In this document they had uncontested rights of access to the property, plus rights of ownership, READ CONTRACTS!!!! I'm fighting with two broadband providers now over breach of contract and harassment because they keep billing long after I've left, even the collection agency they keep involving has dropped them as a client where it involves me...

I had a dispute with British Telecom years ago - they were adamaent I was wrong. I said: "you know you keep telling me you record calls for tarining purposes - well go awa y and play back teh recording and you will see we have a verbal contract which prves I am 100% right and you are wrong" - they did, an hour later they called me and said forget the fees and payments they were demanding.

If you enter into a contract which states you must follow a set of rules, then at a later time they change those rules, are you obliged to only follow the rules that were in place when you took out the contract or must you follow the new ones? It seems to me that this kind of thing could be a loophole to allow someone to effectively significantly change how that contract applies to you without changing the contract itself.

Contracts can allow rules to be changed (e.g. employment contracts often allow the employer to change certain things). Terms and conditions may be amendable if you are given notice of the change, and/or allowed to terminate the contract if you don't want to adhere to the new rules. When reading any contract, I would encourage everyone to pay very careful attention to whether the contract can be varied in any way, and how it can be terminated. When you are getting into a contract, it is really important to know how you can get out of it!

I once asked for a quote for some work and when it was finished they wanted more than the quote they gave me. They claimed they only gave an estimate but I showed a copy of the letter that stated QUOTE on it, they tried to say I had altered the letter so I produced the original that said QUOTE they tried to grab the letter off me but didn't succeed. in the end I just paid the price on the quoted letter.

I’ve lost count of the number of people that email me and ask if they can call me on the telephone. I always refuse, so that there is no confusion over what exactly was discussed! A few years back, one guy telephoned me, kept me on the phone for 10 minutes, then emailed me a few days later to say “thanks for agreeing to do X”, which I never agreed to. At this point I normally just tell them to F*ck off 😉

I am a photographer. People don't realise that if you're in a public place you can take as many photos as you like of anyone you'd like to photograph. You need a contract in a private building or business.

I think that tip five should be don't be scared of going to court. Easy to say, but when you do it, it's bureaucratic and there is risk. It takes time and lots of research and it's easy to lose confidence. Through necessity I've carried though three claims myself and always found the courts to be accommodating and made allowances for the fact I was a lay person versus lawyers. In far more than three cases I've had claims settled before going to court, just on the basis of a diy notice before action. Quite satisfying (though scary) when a lawyer meets you just before the court hearing for one last chance to bully you into settling, saying you have no chance and you'll lose and then the judge rips them a new one and awards you substantial sums of money.

​@@spacemanclips That's nice that you can afford a lawyer. But I was a student getting abused by college managers with lawyers, so naturally I couldn't afford a lawyer. Many people can't afford it & they get abused. For these people your tip 5 might make sense (if they have a small claim) because they can get some experience of the court that might protect them a little later on with bigger cases. On the small claims track the loser doesn't have to pay the winner's legal costs (unless the loser was badly behaved maybe). But for a lot of claims your tip 5 is dangerous advice because the civil court is often much more punitive than the criminal court eg Hopkins tweeted a few lies that Monroe vandalised a war memorial. Hopkins ended up having to pay £24,000 damages + £100,000 legal costs. Many people would prefer jail time to that.

Moral of the story - If you're guilty then settle and don't go to court. Hopkins was blatantly guilty but her ego meant she fought it. I believe it bankrupted her and in my opinion she deserves everything she got (and trust me I'm no fan of Monroe). In my experience the judges are pretty good at cutting through BS on both sides and coming to a fair decision. Don't go to court if you have a weak case.

I think your tip (to settle if you have a weak case) although right is, in practical terms, probably unrealistic a lot of the time. It's easy to know she had a weak case after the judgement comes in but before trial it's often different. Especially without a lawyer. *You want me to settle with me paying you HOW MUCH? 12,000 POUNDS for 2 BOOZE-INDUCED TWEETS? It was 'very upsetting'? OH GET TF OUT OF HERE. I get much worse insults than that all the time* etc. Even with a lawyer it can be hard to know I imagine. Look at the doorbell case, the Protection from Harassment Act doesn't say what harassment is. Many cases turn on their own particular facts. Thus learning about previous cases doesn't help that much & the parties have to 2nd-guess what the judge is going to do. IMO the doorbell camera guy seems to have been a bit of a wanker but there's no way it was "fair" that he lost what? £200k? I bet he'd prefer jail. How much jail time would you do for £200k?

So if you think you might have a problem with someone leading up to litigation, keep a record of everything which you can then present in court. He usually charges five hundred guineas an hour for that kind of advice 😄

Presenting documentary evidence doesn't always help, we had documentary evidence of a neighbour harassing my son for years,my son was severely disabled, the man verbally abused my son and wife on numerous occasions, i started documenting this contacted the police and local council supplying video and written documentation, they did nothing to sort this out, eventually the coucil suggested mediation , on that same night our neighbour petrol bombed our house at 2.30 am while we slept and only then did the police and council take this harassment seriously, the neighbour got a suspended sentence and soon after started the harassment again i contacted the police who were sarcastic and dismissive and would not listen instead an inspector warned me that this must stop and if it continued i would be arrested for anti social behaviour, the neghbour stood outside flicking lighters and making threats yet the police took no notice of the supplied evidence and warned me to change my behaviour and let it drop, Later we discovered that our neighbour was a paid police informant, i will never forgive or forget the distgusting way that we were treated despite providing documentary evidence of our neighbours threatening behaviour, so you see there are time were documentary evidence does not help in any way.

I disagree about being able to rely on Amazon. I had to return a product that was "fulfilled by Amazon" and while I did get my purchase cost refunded they only refunded part of the return postage, contrary to law, despite the means and cost of return being agreed by their agent before returning the item. I was left down by £17 and although I was in the right there was no way to recover that money that would not have taken me more than £17 worth of my time in chasing. In fact by the time I gave up I had already spent over 3hrs on the phone, getting absolutely nowhere. The moral is to buy from a company based in your own country, never reply on any country based abroad as if they decided to take the mickey you have no practical redress.
