Yea he knows his stuff. But if I’m not mistaken, theres a case in the past that would’ve allowed Hank in there. There’s the automobile exception, which allows warrant less searches of any vehicle with proper probable cause including Mobile homes because of the potential to flee. That one could be tricky because it is at a junkyard, the second being hot pursuit. Once he heard Jessie, if jesse had any type of wanted heat, he could enter.

One of the things that makes this scene so great is that even though Hank is basically the good guy here, the viewers are so emotionally invested in Walt and Jesse's characters that Hank instead becomes like this monster from a horror film scratching the walls and knocking on doors (even the RV has dim lighting and all), because you know that if he sees Walt, it's the end.

If Hank secured a warrant for the RV and the RV was on private property, he would be able to enter the property to search the RV, but would NOT be able to search anything else. He was amazingly wrong about probable cause also. Probable cause as it relates to vehicles allows officers to perform warrantless searches of vehicles based off of exigent circumstances. Exigent circumstances basically means that since the vehicle is mobile, Officers do not have time to secure a warrant and can perform a search after developing probable cause. The RV being considered a domicile or a vehicle is a moot point to this case since the RV is not on a roadway and does not appear to be able to be moved easily, so no exigent circumstances appear to be present. The vehicle is also on private property which Hank did not have permission to enter. This represents an unlawful search. Even if Hank developed probable cause and secured a warrant for the RV, any evidence discovered during the subsequent search of the RV would be inadmissible since Hank violated the rights of the property owner. Furthermore, the bullet holes in the side of the vehicle would most likely not be sufficient evidence to secure a search warrant. Hank would have to articulate that the holes constituted a crime and there is evidence inside that needed to be secured. The presence of the tape over the holes suggests that they are not recent and there was no reason to believe anyone inside was in need of medical assistance.

Technically Hank was breaking and entering. Unless he was acting under exigent circumstances, he could be charged accordingly. Even if the bullet holes were apparent it wouldn't qualify as probable cause as he observed no gun shot nor was he responding to a gunshot, and the vehicle wasn't moving. There was no immediate suspicion that a crime involving a firearm had occurred. Even with narcotics and the materials to make methamphetamine the two would almost certainly have had the charges dropped.

Indeed, and what this clip doesn’t show was when Hank was first inspecting the RV, he was trying to open the windows to peek inside of it to establish probable cause. The problem with that is that as Joe mentioned probable cause needs to be readily apparent. An example is someone getting pulled over for a traffic violation and there’s a bong in the shotgun seat in plain view. At that point the LEO has the right to search the vehicle

He just committed breaking and entering against a citizen without probable cause. Even if there was evidence that a crime was being committed, cops can’t just be breaking down doors of anyone because they have a hunch. That would lead to massive amounts of police abuse of power that was common place before cases like Miranda v Arizona reestablished that people have rights that protect against the lowest level of government

Funny thing is, from a standpoint of avoiding criminal liability, it almost would have been better for them to let Hank break in. It’s a textbook illegal search, and ANY evidence gathered as a result, including the lab, Walt’s overall involvement, and any information that comes from the discovery of Walt’s involvement would be thrown out as fruit of the poisonous tree. Both Jesse and Walt would have walked out of court free men with most, if not all charges dropped after the first preliminary hearing.

If you have a reasonable expectation evidence is about to be destroyed (such as an RV at a dump site) you can search the vehicle without probable cause/ a warrant. They should have kept Hank off with a warrant to search on the property of the landfill owner instead of the car.

I remember watching this clip for the first time while doing my assignment during my US Government period in my Senior year. 2 years later, I'm binging Breaking Bad & caught up to this scene & got lost in the nostalgia, not the best year ngl, 2020 go die in a bathtub of hydrofluoric acid, but this moment really stood out to me then since my teacher loved this show, also helped that he seemed mid 20s at least & that gave me the scope of how engaging & relatable he makes his classes out to be, something a lot of teachers can learn nowadays to make their classes better. Here i am now wishing i got to know him better since our time was limited & 2020 meant i was paying attention to a Zoom class 60% of the time, he was also had media preferences like gaming & Twitch & always made US Government less of a class & more of a engaging discussion. Schrader works for the DEA, which is an executive administration. (I think it's part of Homeland Security?) The rules are largely either legislative or from the constitution itself, which are different from the executive branch entirely. If he brought these two to court, he (well, his prosecutor) would have to make the case to a judge, who works for the judicial branch. The whole governmental system is set up so that none of the branches trust each other and keep each other in check. It's not a perfect system but it's worked pretty well so far, so I'm not complaining.
