The "Get away with murder area" is kind of true. You can't commit any crimes if you don't have any victims or infrastructure nearby. And any victims you brought to that area would involve many serious felonies already and wouldn't save you any time off your "life term" jail sentence anyway.

@orionpark26524 жыл бұрын
There was a real case where a guy killed an elk in Yellowstone and brought the head back and cited that particular part of the Constitution dealing with Yellowstone saying he had the right to a jury by the Montana residents of Yellowstone. That was actually possible, though, as there are Montana residents there, but rather than trying to get the few of them together for a jury, they just ignored the Constitution entirely, because they didn't want to admit to a Zone of Death. He could have appealed to the Court of Appeals and would have won probably, but he took a plea deal instead and there was a clause in the deal forbidding him from killing anything else in that zone. Law still hasn't been amended and wouldn't be hard, but the state governments say they're just too busy with other stuff.
@1985ThePedro4 жыл бұрын
One of those issues where it really exists, but there is no feasible way to capitalize on it. If you go there with the "intent" to commit murder, then you've committed a felony, and are under Federal Jurisdiction, because you have crossed state lines with intent to carry out a crime. Even if you don't cross state lines, and just cross from the Montana side into the park jurisdiction, you'll be subject to the State Courts, having crossed a jurisdiction line with "intent", and therefore being guilty of a State level crime rather than merely a County or Local level. Often, murders are dealt with within the specific County or Jurisdiction that the murder took place in, but almost always under the Authority of the State Courts, so essentially just acting as a proxy. This is because most murders in the modern age involve people fleeing across County lines, etc. As for hunting Elk, or other illegal hunting, that would fall under DNR Jurisdiction, which would actually ALL fall within the specific jurisdiction of the DNR Zone of the Park. So, you will still be prosecuted for illegal hunting, in Wyoming, regardless of which side of the State Line you are on. That's because it is a Federally Chartered Park, which means it's the U.S.D.N.R. and not the Montana or Wyoming DNR that takes the lead, and the zone is specifically under the authority of the Yellowstone DNR Agency, which covers the jurisdiction of the entire park according to its charter.
@jwrosenbury4 жыл бұрын
@@Jonls As I understand it, in order to be convicted of a Federal crime the federal government needs to empanel a jury from the federal district where the crime took place. That's the point of this factoid. The problem with committing a murder there is the lack of people to kill, plus the Federal government's willingness to ignore the law when it decides to go after a person. Just ask Gen. Flynn how that works.

Oh... and the entire place is effectively abandoned since the government has declared it uninhabitable, cut the roads, removed it from maps, and has repeatedly tried to evacuate anyone who remains. Centrailia PA was the inspiration for Silent Hill. In the 1960s, the cities garbage dump and where they burnt trash was so close to an anthracite deposit that they started a fire that spread to all the coal under ground and it’s been burning ever since. I actually rode my Harley out to what was left of this area and to this day you can still see the steam rising up from the cracks of what’s left of the town, it was condemned by the government and now it’s basically a burning waste land. I’m from Philadelphia, Pennsylvania originally and people that like to explore always end up in Centralia at one point or another although the state has made it a lot more difficult to explore it now. But yes Centralia PA does have an underground coal fire that will burn for probably another hundred years before it extinguishers itself.

Centralia is a TRIP!!! In the valley below in January it was 10 degrees up the side of the hill, while there was still an asphalt road...blue flames flickered out of the hillside....on top the hill where there the town once stood and only a couple houses stood back 30 years ago when I was there...the outside temp was so hot, the AC needed to be on and I stood outside in my T-shirt , sweating!! What snow was falling outside the area was just a mist that was evaporating as it hit the ground! Eventually all the asphalt streets and roads around the area caught on fire and burned. A new concrete highway was built around the mountain where most of the coal seams that are burning are. I had driven through the area at night and had no idea I was driving thru Centralia...but you can't miss it once you drive near it! They had greenhouses there and tried growing tomatoes, but it got too hot and killed all the plants!

what happened with the ground being on fire since the 1960's, is someone either purposely lit or accidentally lit the coal mine on fire. coal is combustible and the fire spread in the mine causing it to forever burn until the coal is gone. moreover they cant put it out either or cover it, and the area near it is to be cleared at all times due to the heat. if I remember correctly (again) there is more than just one in the US as well.

When he say's the ground has been on fire, he should have clarified that the fire is underground in seams of coal. The fire started above ground at a dump site but that ignited a seam of coal that was next to it on a hillside. Oh, and Indiana had more than one battle in the war between the states. The Mississippi river may have flowed backwards for 24 hours in 2012, but it flowed backwards for days in 1812 during the earthquakes on the New Madrid fault line which also created Reelfoot lake in Western Tennessee.

from the area I live, near Corpus Christi, TX...a drive to El Paso Texas is over halfway to the Pacific Ocean. And you're still in Texas. Also think that a drive from Brownsville, TX to the North Texas Panhandle border is almost but not quite halfway from there to Canada. Texas is huge and varied, culturally as well as the scenery. Often the first blizzards in the year are in far North Texas, and where I live down here in South Texas the climate is more like Okinawa, Japan. Hot and humid, sub-tropical; it literally is like a whole other country.

The issue with Centralia, Pennsylvania is that back in the 60's a mining company was incredibly lax with their safety standards and a fire broke out inside the mine, which also happens to be right under the town itself. Originally they had sent people there to try and put the fire out but the massive amount of coal inside the mine made it impossible to safely fight off the fire so they closed the mine off and evacuated the town. Over the next 60 years the few remaining residents either died off or moved away and there is currently 1 resident still living there despite the State and Local governments trying to get them out. The fire itself is still burning beneath the ground and is expected to continue for at least another century minimum. Centralia is actually the inspiration behind the Silent Hill games as well as, prior to 2020, a neat little tourist spot to visit. A section of the old Route 61 remains where they closed it off after a partial cave in caused a portion of the road to collapse and created a massive crack down the center of it. They rerouted the new road away from the area and it became a place where many who visited would tag it with paint, known as Graffiti Highway. As of 2020, a company had purchased the land from the state and began covering the old Route 61 with piles of dirt. The State still owns a majority of the land and it is still actively used as a popular ATV spot. The actual risk of injury from being there is moderate given the toxic gasses in lower areas and the potential for cave ins, but depending on the day and how windy it is you can see small plumes of smoke rising up from the ground where the fire is still raging on. People are still allowed to visit and check it out but it's an "at your own risk" type thing and so long as you stay out of any areas that are marked No Trespassing then you are fine.

They miswall change the name of the city to hell on earth. Think how hot it must be there during the winter with a fire blazin under ground. My smoker burns a temperatures of 1000 degrees Fahrenheit and that just 10 lbs of coal smoldering on average
@Captain-Awesome2 жыл бұрын
It seems like since the coal is so valuable that they would dig a fire wall to block off the fire to additional coal fuel. That are dump a lake of water down the shaft but I am sure I am late to the part with my bright ideas. They would have thought of the same things already and decided it’s a better idea to let it burn. It will make for a cool cave in a thousand years from now, if Jesus hasn’t come back for us by then.

@@Captain-Awesome I believe they tried a number of things, but they just couldn't get it under control. I imagine the California wildfires as something similar, but with a much stronger accelerant
@veteranmaddox53332 жыл бұрын
The fire didn't actually start inside the mine. It was caused by burning trash at a dump which incidentally caught the coal on fire. The government bought the town but 6 people refused to sell their property and still reside there. The only reason I know this is because I get bored and watch documentaries... So if that's wrong, don't shoot the messenger lol

@danielmorton99564 жыл бұрын
It's literally the coal veins in the ground that are on fire. The town was straight evacuated. There are cracks opening where steam and smoke vent. Carbon monoxide levels are quite high (esp with lower oxygen) and the area prone to collapse.

sneak in? didn't know it was illegal. The big mounds of dirt they piled on rt61 makes it impossible to drive into, but always thought you were allowed to walk in (at your own risk, of course). Been quite a few years since I've been there though, so things may be different now. If it is illegal to enter, it's probably because of all of the ridiculous amounts of graffiti, and not for health or safety reasons.

@@DrunknRuckus Nah, its illegal because of the evacuation and subsequent liability. Nobody cares about graffiti on condemned areas (well maybe some cops will). Definitely an area that is unsafe an prone to collapse.

I have lived in Idaho for around 26 years, and that is the first I ever heard of that 50-mile stretch. There certainly isn't a whole swath of people in or around Idaho who are making their way to the 'forever purge' part of the state. So yeah...if you commit a major felony in that stretch and one of the states is going to prosecute you. Furthermore, there is a simple legal precedent in the US called "change of venue" when there is a jurisdictional problem that impeds on proceedings. ie. 'there is no court or residents in this district, so we are going to try you in another district.'
@halycon4042 жыл бұрын
Way way way late on this. It's a federal court which causes a whole slew, of well, problems with that. I'm sure there would be a change of venue, but it'd probably have to go up the ladder to SCOTUS to rule on a federal court changing venue because that specific weird thing isn't in the law which governs federal courts. Federal courts exist to supersede this type of problem in the first place. Unfortunately here there's a weird interaction between two sections of the constitution, the organic act, and the change of venue law. The base interaction is this. 1406 only allows the federal court to change venue to anyplace the case COULD have been brought, nowhere else... for very good reasons. Unfortunately The Organic Act specifically puts a limit on where a case may be brought inside land it controls.. also for very good reasons. It's interaction with 6th Amendment means the 9th district court which Idaho is part of can't kick it to the 10th district court Wyoming is part of since any change of venue has to stay inside the 9th district... also also for very good reasons. 1406 also says specifically that one district court can't kick to another district court, it's just superseded by the 6th Amendment. There's more but those are the basics, it's in how several federal laws interact and there's no precedent for this specific interaction. The only time the Zone of Death has ever came up they gave the defendant one hell of a plea bargain just so they wouldn't have to spend years sorting it out. There's no roads leading in or out. It's so remote and the terrain to get there is so bad this issue has only come up one time in history. There's an entire book just on this one small little piece of land and the legal problems it causes that noone will fix until they absolutely have to because it's such a headache for something that pretty much never comes up. The absolute easiest fix is reassigning Idaho from the 9th district court to the 10th district, which is still a migraine inducing. Yellowstone in particular is a huge legal nightmare. It predates The Organic Act and parts of the law which govern National Parks do not apply because it's covered by the earlier laws which created Yellowstone; when America was a very different place. Most of those interactions means Yellowstone can do whatever it wants to a stupid degree. There's lots of national laws where Yellowstone can just say, "F that, I'm not doing it.". It's exempt in some ways even military bases aren't, and noone feels like fixing it.
