Brooklyn DA: NYC subway shooter won't face charges

The Brooklyn District Attorney's office says the gunman in Thursday's shooting on the NYC subway will not face charges as it appears to have been an act of self-defense. FOX 5 NY's Jessica Formoso has the story.

Most buroughs of NYC enforce a Zero Tolerance of Violence policy and prohibit 'posession' of a weapon on the subway. Note that the article was that 'no charces have been filed,' but the 'shooter' was still arrested. No statement that he was released, either. My bet? He rots in jail for a while, then is offered a stark choice: Sign a felony confession and plea deal once he's sweated for a while, or stay in jail until he is read a guilty verdict in a court of lawfare. The case will only make the news again if the DA in charge can find a way to politicise it.

He tried to back away several times and bargain with the attacker to end the attack. The attacker pulls a gun, presumably to kill his victim/s, and the victim wrestles the gun out of the attacker's hand and shoots the attacker in self-defense. Where in there does the victim become liable for the attacker's injuries? Everything the victim did was to try to remove himself from the situation, plead mercy from the attacker or was self-defense.

As I remember the story, cray-cray guy was loud and menacing, even threatening, invading personal space, but he never attacked anyone, he was tackled and retrained by SEVERAL people and then chocked to death by ONE individual person. PLEEAASE!! Don't tell me that you cannot see the difference between these two scenarios. Bad Guy attempts to pummel someone to death. GF jabbed at Bad Guy's back a few times with a knife to try to stop him (Bad Guy was wearing a thick jacket). Bad Guy gets pissed and pulls a gun to retaliate against GF. BF notices what is about to happen and snatches the gun from Bad Guy hand, putting a few rounds in Bad Guy ending the violent episode. The two scenarios are in no way similar; you can't have multiple people retraining a person and have that person be strangled to death and call it self-defense or defending the public. Also considering the fact that the guy charged was a Marine vet who most likely was trained in doing serious harm the way that he did. This is not rocket-science, folks. And to answer that sad question that clearly indicates that you know absolutely nothing of NYC everyday life; it has NEVER been allowed for civilians to be "strapped" concealed or otherwise in the subway system. The most complex and biggest issue and problem is, "how do we stop people from bringing weapons -- especially guns, into the subway system...
