Yes, I have been aware of all the Paper products involved. However: all these entities could loose the rights to PDFs, Kindle Readers, electronic publishing rights! This is huge!! That publisher could be allowed to sell all inventory and continue to sell electronically all these copyrights and sell to another publisher to pay off the debts of that company. The courts can take over the rights to publish. It’s a nightmare in cracked shards of black glass.

You need to retain a lawyer to protect your interests. The intellectual property is yours and needs to be protected. Do not let the legalize of the letter intimidate you. You have rights in the bankruptcy case and a lawyer can explain those to you and make certain that you claim any past and future royalties along with your intellectual property.

Baylee, I'm self published and small press published. Check the contract you signed, there should be something about this in there. Sometimes what happens is that the publisher will sell their assets to another publisher who wants them. So Impact could sell the rights to your book to another press that may or may not keep your book in print, or just wait out however long your contract is until copyright reverts back to you for however many years you signed it over for As for the interior of the book, usually how it works is that, while you own the images you created, the publisher owns the edits for the words you wrote. So if the your rights revert back to you, you might want to get the book re-edited just so you can say that you own the edits. I've never had this problem, but I'm not published with a major publisher. A small press I was with went out of business as well, but I got the rights back quickly. Not all authors with that company were as lucky. Most publishers don't check to see if the edits for the book you got the rights back to are exactly the same, especially if the edits are all corrected grammar, but changing around a word or two in each paragraph should be enough if you don't want to get an editor. Up to you whether you want to take the risk. Ultimately, your contract should have a stipulation in it that you can get your rights back if you send a written letter with X days notice. Image might ignore you if they want to keep getting money for your book to pay off their debts, but it's good for you to send a reversion of rights letter anyway. Send it by snail mail and email. If you have a good relationship with your editor, and since you only had one book, you might get lucky and they might give you the rights back with little hassle. Otherwise you could end up waiting to see if they sell your contract to another publisher. For more help on this, check the Kindle Kboards and ask for advice there. Romance authors know a ton about contracts, and even though Kboards is usually for self published works, a huge amount of people there are hybrid published with large and small publishers alike, and will know their way around the contract lingo as well as maybe helping point you in the right direction if you wanted to self publish. Whether or not to use IngramSpark or Createspace, Paper type, and how to get your own ISBN (Canadians get those for free, so never pay for one) Check your contract and good luck
@alycia78705 жыл бұрын
I would take a copy of your contract, a copy of the letter from the bankruptcy folks, and any other paperwork you received from the publishers (i.e. the royalty statements you received but didn't receive payment for) and speak to a copyright lawyer. I don't know if BC or US laws would apply, but something tells me if they didn't pay you the royalties per the contract, they have effectively voided it, meaning the rights to the images and text in the book would transfer back to you. If you have the rights, you're free to re-do and re-publish how you see fit. A lot of lawyers will do free consultations for you to discuss your options. (Disclaimer: I work in law in Ontario, and the laws are different by province/country.)

cats usually can digest their own fur. in my research, throwing up hairballs is actually a symptom, they shouldn't be puking. the same thing was happening to my cat, constantly throwing up and "massive" hairballs, but it turns out she was actually allergic to her cat food and treats (she eats high grade everything so it wasn't a low grade food issue). the vet said to remove "all chicken, fish, cow" from her diet and i found lamb, rabbit (even raw rabbit), turkey, and guinea fowl would all make her throw up too. she is limited to JUST a kangaroo stew (Koha), the vet prescribed (Hill's) sensitive venison and pea protein kibble, and there is a plant-based Ami cat food from Vecado i give to her as treats which she is obsessed with (normally she is not food motivated but these rock her world). she hasn't thrown up in months. no hairballs no nothing, and is maintaining a very healthy weight. please look into food allergies for your little fur-baby :)

Sorry to hear the company is going out of business, and def a shame about the income. :/ Speaking as someone who's self-published three times now, the process is very easy. If you did ever feel motivated to check through your contract, rework, and republish your book, I don't think it'd take you much effort to do so. (Apart from remaking the PDF, which is honestly the most difficult/time consuming part of the process x'D)

I’m so sorry to hear about the book! I agree with a few other posts, maybe there is a way to get rights to the full finished book in exchange for the $1k and all future royalties you are missing out on. There are plenty of free consultation lawyers who will tell you what you can do and decipher your letter for you for free. You could also go to a local library and ask the librarian to show you to the law section and help you find a book to help you decipher the words in the letter yourself. I think you put a lot of love and work into that book already and it wouldn’t hurt to put a few more hours into to try and save it. This could have been a blessing because if you can retain the rights to self publish since they are bankrupt and won’t be using it anymore, you could now receive way more income from the book!!

You probably can't use the PDF of the book as it is, however, since you own the art and most of the pages designs etc. basically all that is yours, is yours. They can't use it if the company is bankrupt and the contract is basically broken, you should get the royalties and you are allowed to either redo a book layout with the content and self publish it OR you can also reach out to another editor and work with them. Basically your previous editor only had rights to print and sell it while they were in business. If they stop selling and printing it, your business with them is done, you still own everything else, you're not bind by a contract anymore but you also lost money since the editor won't be able to sell the book. You definitely should get a lawyer to at least look at the case and see your options. Having legal background and an audit on that case won't be that expensive. There's some online for example, but I think it will worth at least seeing someone one time and expose everything. For the check already but also and mainly for the losses on the potential sales for the remainging time of the contract you had. If this was a book deal for a 5 years sale exploitation for example, you lost 3 years on that deal, they should compensate your sales and/or yield the rights back to you so you can self publish or find another publisher.

I forgot I was also going to mention this to you. If you track your mileage from your home to the post office and to chit chat and any time you use your vehicle for business things like picking up packaging materials etc., you can use that as a deduction on your business taxes. It may seem small, but it really does make a difference. I know a lot of people working from home forget to take business mileage as a tax deduction. We had a mileage deduction of $28 and it ended up putting us in a lower tax bracket, so it was small, but ended up having a huge positive effect.

All you need is the knowledge not necessarily the lawyer...yet. Ask around. It was your work, don't just give up on it. It is too easy for these people to take advantage of artists and not care. It is rampant in the art industry - the abuse of other peoples talent/skill. I get it with the lawyer costs - it would be impossible for me - but research for free and see what you can do. If nothing, then fine. Sorry if that sounded preachy, I just don't like to see creatives get abused this way and it's the norm, not the exception.

Difficulty with hairballs can be associated with kidney and liver pathologies . This is a quote from Hills pet food, “Hairballs in cats are a natural-albeit not fun-way for a cat to rid herself of hair that gets stuck in her stomach and are normal on occasion. ... If your cat is having trouble with hairballs, your vet might want to do blood tests to make sure your cat's liver and kidneys are performing as they should.” I did contact you before to say that Kiki has a coat which is often associated with kidney and liver problems and is often referred to as a kidney coat (at least it is in the U.K.)

I'd like to preface this by saying I'm not a lawyer, that being said: I would really encourage you and the others that are caught up in this mess to look into getting a lawyer and running through your contract with the now bankrupt company with a fine-tooth comb while looking for a lawyer....actually, make a copy of the contract and highlight anything you don't understand or jumps out at you on the copy (please don't mark up the original copy as that may or may not hurt your case). I'd also suggest looking up laws about being notified about the bankruptcy as some countries (at least I think I'm probably wrong) have laws that require companies to tell anyone connected to them about it before filing/declaring it. Look at it like showing up to a regular office job only to find the doors padlocked and a note on the door claiming the company is now out of business and you and your co-workers are caught flat-footed.....its a big deal! The reason I, as well as many others, would encourage this is to protect your legal interests in what you drew and wrote for the book. Those companies that handle bankruptcies try to dig up every single penny to repay creditors and may attempt to go after anything that is remotely connected to the contract...especially if you want to re-publish or re-use anything from the book farther down the road to publish something similar (better to know now than get a surprise copyright lawsuit in the mail or something similar as they'll try to claim you actually own nothing....of what you put hard work into...and that you tried to steal their property.) There are lawyers who have free to low cost consultations...... try looking up your country's legal association to see if they have a list of lawyers or try calling them to explain your situation and see what they recommend. Bring up (or take if meeting in person) anything connected to your book: the contract, all the e-mails from the company esp. about the royalties, copies of the check/deposit into your account, perhaps even drafts of what you did. You may even be able/ need to use any of the KZbin videos you did about making the book to prove that yes, this is work you did not someone else. Even if you don't need them, better to have it than not. And please, please, please don't be afraid to ask for help.... The law can be really confusing and it is better to know something now instead of always wondering if the other shoe will drop.

You need to research (especially in your contract!) what rights you have to take back ownership of the book. I don't know that they would give you the files needed to print the book, but if they do you could see about self-publishing it. It's worth a look! :)
