So it’s been published in Rolling Stone that all the songs Burton wrote, he is also the publisher of them. So he’s only stopping the “fake Guess Who” from playing what he wrote from 1966-1975. They have music that Burton didn’t write, but without looking it up name 3 Guess Who hits after 1975. I love the original Guess Who and I don’t know any songs they released after 75 without using Google to look up the answer. Had they simply called themselves something like “Wheatfield Soul” a Guess Who tribute they wouldn’t have this problem

Burton owns the catalogue rights to "all" Guess Who songs, and can withhold permission to perform them, and he should, as they did not create these songs, and blemish the image of the Guess Who, and Burton and Randy want it protected. They can use the name the Guess Who, as Jim Kale has the rights to use the name, as of 1978, but just the "name" but not the songs. Also Kale was given permission by Cummings to use the name, in 1978, for just a couple of tour dates. Kale then realized the Guess Who trademark was not owned by anyone, so he bought it, under false pretenses. He put in his application in 1978, but did not say the band started in 1965, so that trademark obtained by Kale was obtained under false information, and should be retracted. Burton and Randy are the GUESS WHO period and I'm glad their taking action against fraudsters. Does not matter if there is 1 or 2 original members performing with this Fake Band -- it should not be allowed. Cummings and Bachman have big money, to hire great lawyers, and totally shut these guys down. As Cummings said on an interview, they had 45 years to create their own music, and didn't do anything.

I agree with Burton, but then you have Lenyrd Skynrd who I saw last summer, and they have no original members now since Rossington passed away. They still play the original songs. I guess the name is copyrighted.

Don't see why they even should have called themselves the original band since the world is thick with tribute bands. They should have just said they were the Guess What, a guess who tribute band. That would have been more respectful than calling themselves the original band with a member of the band that might have a claim on the name of the band.

I bought tickets to see this group, The Guess Who, at Renfro Valley in KY for Jul. 19. I did not know about this controversy, but got an email from the venue early the week of the performance notifying me the show had been postponed due to “copyright issues.” I am now aware that Burton Cummings and Randy Bachman have filed suit against this group.

The sheer irony that the entire video above contains NO members of the original lines up. Garry Peterson is not behind the kit. And if this band is as great as Dean is all over social media saying, why are they cancelling their shows? Why not go on and perform their own music? They've had 45 years since the new version of the band started. They've had 45 years to come up with even ONE hit song. If they haven't, that is on them.

I was at the live recording of the The Guess Who Live At at Paramount in 1972. After watching this video I wanted to puke. It’s quite obvious that Dean Baldwin had his own agenda.

a previous bass player owns the name The Guess Who. The current band intermittently features the original drummer and pays the royalty fee for the name. Burton Cummings has a an unusually strong hand to play because he solely controls the publishing. Very few songwriters have that advantage. Cummings and Bachman sent several cease and desist letters through attorneys to the management of the touring band and got no response and finally had to take the actions they took Hey this band needs to change their name to Artificial Paradise.

The Guess Who name was not licensed and Jim Kale saw that fact and licensed it for himself back in the late 70's or 80's. The current line-up has only been in place for maybe 10 years or so. Back in early 2000's Kale owned the name and they had a Re-union and most all of the original members were playing but lately Kale and Petersen had been hiring other guys to play as The Guess Who. Kale retired from active performing and Petersen has been the only 'original' member still associated with the band but even Petersen sometime's can't play the shows so then they have a list of drummers to call on and in those cases there are no original members performing. I saw the current line-up last August and I didn't like that they spent about 20 - 25 minutes playing the newer songs from the 2 albums that they released in the last 5 yrs , I wanted to hear the hits. The new music does not sound like the Guess Who, more like ELO than Guess Who.

The Guess Who would be nothing without Cummings and Bachman. But there are tons of 60s/70s acts that tour without the original lead singer. Journey, Grand Funk, 4 Tops, Lovin Spoonful, Foreigner, Styx, Temptations, Jay & the Americans, Turtles, Santana, Canned Heat, and on and on.

I don’t think so. I think it’s the integrity of the original Guess Who and its music. Burton will now make no money on any of his GW songs at all. This means grocery stores, malls, etc can’t play it without his permission. So losing probably more than half a million per year isn’t being greedy. Kale and Peterson should have done more to copy-write the songs when they were first written. They didn’t now this is what happens. They should call themselves a tribute band to the Guess Who and everything will be fine. Or keep the Guess Who name and come up with original songs that the crowd will like. I’m sure there are some from the 80s-now. Play those then they can keep their name. Burton owns the publishing rights so it’s fair game if he thinks the integrity of the Original Guess Who is being damaged to do this.

Since when is it "greed" to protect YOUR property rights" as in publishing rights? The fact they let it go on this long says a lot more about their attitude than the COVER band that was basically committing fraud by using Burton;s voice singing the classic songs when promoting the COVER BAND'S live shows 45 years later. How many concerts could these guys sell thicket to with "all the songs" they created over the past few decades??? I say right around ZERO. LOL

Are you seriously obtuse? This has nothing to do with greed. Burton is willingly giving up royalties for the ban against anyone using his music. They should have done it years ago; they are the intellectual property of Burton & Randy. This has absolutely nothing to do with the name, The Guess Who. It's about the imposters using their songs, showing their pictures in the ads, letting fans think they will be performing. If their booking agent wasn't aware of the legalities involved, then he shouldn't be booking dates for any artist. That's on him. The imposters have released albums the past years, but they suck. They lack the talent of Burton & Randy. The only reason they've been booking gigs and releasing music, is because the name. But, the name is meaningless without the talent. It's no wonder they don't want their work & reputation sullied by imposters. Burton & Randy were the band. They wrote the songs. They left the band in the early '70s, each taking their talent to gain success as solo acts. They even periodically tour together, as they will this summer. This could be a great idea for other artists to safeguard their own music. Why, shouldn't they be the ones who capitalize on their creations

So first off Dean Baldwin, a Guess Who homer. He doesn’t agree with the current lineup of LRB with no original members but he is ok with the Guess Who with one original(who is part time at best) member. What happens when Peterson is no longer around? Do these guys keep the brand and keep running with it? He tries to make the distinction that we hold classic rock bands to a different standard. That they are frozen in time and some fans think they shouldn’t make new music and evolve. I guess the question is what is evolving? Evolving to me is when Tommy Shaw joined Styx, Joe Walsh joined The Eagles or Johnathan Cain joined Journey. This is different. I think he is missing the bigger picture. New music from classic rock bands is becoming less and less. The artists are either dying or they are just getting to old to put out anything new. But never fear other musicians are standing at the ready to join the classic rock band because they want to carry on their legacy. Right? Nope, it is just a hired gun looking for the next gig. If they are lucky enough they get to write a few songs and stretch it out for a few years. The problem being most classic rock bands are turning into brand bands. So the new music (legacy) Dean speaks of is being written not by the original band member, it is being written by the hired gun. They are using the brand name platform to promote their songs they have written that quite frankly might not see the light of day anywhere else. Then they go out and identify as that brand name and tour under that brand name and play the hits that they had nothing to do with. Money is money, right? At that point they are a tribute band that identifies as as a brand name. Myself personally as a musician I couldn’t do that. So when is it time for classic rock bands / brand bands to call it a day? In Deans eye as long as they put out new music never. To me that’s when the integrity and legacy of the band will eventually be tarnished. I commented on his Facebook page and if you don’t agree with his narrative he will ignore you. If you do you are his best friend. He hides behind the narrative that the music will die and be silenced if what BC is doing is allowed. Malarkey. This current lineup can still tour under the name The Guess Who and play the new material that they have put out because Peterson (the drummer) owns the band name. But since BC owns the song rights to the big hits they can’t play them because he put a halt to it. So they choose to cancel shows rather than just play their new music (which Dean Baldwin says is awesome and will be silenced) because they know hardly anyone will buy tickets. Their choice, not BC. By the way the video of the current lineup included in this post doesn’t even have Peterson drumming. It is essentially all hired musicians and they are identifying as the Guess Who. Like I said money is money right? Out of a 17 song playlist they play 5 of their new songs, the rest are covers of past hits. So basically the tour survived on the past hits. If it didn’t they would still be touring. Dean thinks eventually the setlist will include more of their new stuff rather than the hits. Good luck with that. So an open question to Dean Baldwin: your ok with this?

The bass player, Jim Kale, is the only original member. Drummer Garry Peterson has been in and out due to health issues. I give Burton Cummings credit. There are too many fake bands out there with one or no original members.
