What do they mean by holding the second mortgage? So they got 75% from their credit union - where did the other 25% come from? Did the seller finance that for them? I’m confused a little….

This is interesting. However, the private seller that held the second mortgage is at greater risk if the first mortgage falls through and the bank forecloses on the property. The private lender could lose their investment or most of it at this point, no? How is that mitigated during negotiations? Also, what did the bank think about this arrangement?

I believe this is sometimes disclosed to the bank and sometimes it's not. Depends on the scenario.

Depends on the lender but I've seen 0 interest in some cases. Usually something comparable to a mortgage rate is the norm though. Not very often are there additional lending fees on top of that.

Hi Darren, does Mel and Dave’s comment about the tax advantages of the seller take back financing only apply if the seller owns more than one property? Asking because if this property was the seller’s primary residence, I believe the transaction would be tax exempt. Also, great channel. Great guests and very informative content. Thanks for sharing!

Great question. I think in most scenarios we would assume that a rental wouldn't be a primary residence but if it was, yes it would be tax exempt... for now :)

I’m in the same boat as you. I’m looking to get 75% on a commercial loan from the bank and 25% from the seller in the form of seller financing. I’m trying to find a lender that will take this risk. The property will cash flow very comfortably after debt service and operating costs.

Can someone dummy the seller financing way down for me. Seller is asking 700K Bank wants 25% down. That’s 175K. The property is paid for. So how do I get the seller to do the 25% mortgage? I’m confused.

They register a 2nd mortgage behind the bank for $175k or they give you a promissory note for the $175K. The banks don't like anyone in second position so this is not as easy as it seems.
