WHAT IS THE "STATUTE OF FRAUDS"? FOR STARTERS, IT IS A POTENTIAL WAY TO WIN YOUR LAWSUIT.
In this episode, Attorney Steve Vondran shares his tips for breach of contract arbitration and litigation. Specifically, the "statute of frauds defense."
The gist of the law in California is that CERTAIN contracts, by statute (California Civil Code section 1624) have to be in WRITING to be enforceable. Some courts allow "tacking" to meet the wiring requirement.
If the contract is REQUIRED to be in writing but is NOT in writing, then the courts may find the contract to be unenforceable (meaning Plaintiff loses the case).
There are certain exceptions to the SOF such as:
1. Fraud
2. Promissory estoppel - justifiable reliance
3. Completed (executed oral contract)
and
4. Part performance of an oral contract.

i appreciate your channel. i was assulted with catastrophic injuries from an employee at a resort. i am in propria persona , i filed over a year ago, and the judiciary has shown biasness in favor of the defense attorney, conflicts exists due to the judge a former chair of that very law firm

what about incomplete written instruments, do they void a contract? lets say if a judge didn't sign an order or contract, does it lack legal force??? another question, are provisions, regulations and statues equal or greater than laws? thanks Steve great channel...
