Hello, I am in Southern California, I was injured back in Sept. 2023, workers comp. has denied my case, I did receive medical care from Concentra but the Dr. there was pleading me to call workers comp. to agree on a MRI, W. C. always denied the care and case, I obtained counsel and counsel supplied me with a new Dr.'s I was put on temporary disability and received California EDD, EDD has run its course after one year. I went to counsel Dr's, and they put back to work on sedentary work only, my question is if my employer does not have sedentary work does W. C. start paying me. Thank you

im fighting trip and fall injury right now, a little over 8 months into my case.. broken elbow and torn tendon in wrist. had surgery august 1st 2024, now in December and im still having issues. Had another MRI done and they found a low grade tear along with carpometacarpal (CMC) joint of the thumb "did not have that before i was hurt on the job" i haven't got a idea what my case with worth, i see the state doctor next month. once i do, i heard that's when they will start pushing for a settlement. im worried i wont see a dime for a long time... will i be waiting years for this?

Good morning. I had an injury at work . I had a loss of hearing to my right ear and done 3 hearing tests from my insurance company. The last test from my audiogram shows moderately severe hearing loss from 50-70 on paper . Will my workers comp insurance settle now that my findings are positive in having hearing loss, and the hearing doctor recommends hearing aid for my right ear .

I’m middle aged 50’s and I need 5 surgeries 1. Two surgeries left and right torn rotator cuffs. 2. Torn meniscus 3. C6-c7 fusion 4. Hip tear that were certified already and TBI my attorney said I’m at 92% MMI SSI will be getting that money for when I’m physically, mentally and Healthy enough to get the surgeries. Can I spend any of that money 💰 on living expenses and bills.

@@victorvalenzuela6949 There will be two checks written. One for compensation and one for medical. They have to go into two separate accounts and you cannot use the money set aside for medical for anything but medical. This is mandated by Medicare here in California. I put mine in a short term small interest paying CD or money market account. Can’t even use the interest it earns but it’ll make a tiny more towards medical. Good thing is when we die it can go to our family without any clauses. I’m not the doctor going type unless there’s blood or I literally can’t stand or move my arms. I worked for three months with three fractured vertebrae in my neck thinking it was just a pinched nerve. I was a lineman for 25 years with a union company. Have all your issues and more. Took seven years for my case. You’re not going to get rich or even fairly compensated. I could be wrong. I should have just kept working though barely able to do my job without good coworkers that understood my ills as they too had many physical problems. Lost hundreds of thousands combined in pay and contributions to pension and 401k. Supposedly had a good attorney. Everything I’ve read and watched states that worker’s compensation is just bad for the workers. Here in California we are better off than many other states that have limits. Many think they’re going to get rich and retire from worker’s compensation. Must have low quality of life conditions or other means of income. If it weren’t for money contributed to my 401k and having a pension along with SSDI times would be very hard. I’m not sure how people live like they do here in SoCal like they’re all rich. Good luck with your case and do what you can to keep working. Contribute to your 401k or ROTH IRA if you have one. If you don’t , open one.

Hi there. I’m socal. I was just informed by workers comp that I have permanent neck disability that was determined to 13% disability. They offered settlement. Is it okay to seek consultation? I’m just not sure if I’m getting the full benefits 😢. It’s been so stressful. I’m still able to work 100%

Hi. I’m in southern CA but on average, do you know how long it takes before a settlement occurs from date of injury (average)? It’s been 15 months now. Also, I wanted to do a voluntary resignation as part of the settlement process but it’s taking a very long time and I was given restrictions to go back to work. Is this normal??

Hi! Each case is different but on average they can last 2 years. Once you have agreed to a settlement it has to be approved by a judge and that can take about 30 days

It is normal if you are not in the settlement stage yet. If you are given restrictions and if your employer has a job for you within those restrictions, it is going to be expected for you to return to work. If you decide to decline the job with restrictions, some benefits may be affected

@Tumble96 After you settle? Or before you settle? Moving out of state complicates things, but it doesn't mean you can't treat at your new vicinity. Some benefits might be cut off and a few other things might come tumbling down so it's always best to consult an attorney before moving.
