I provided my description along with the information that I was carrying a rifle to stop a vehicle burglary. I found out that it was a hoax before police arrived, but they came rushing in looking for the suspect dressed as me carrying a rifle! Very unhappy with dispatch, I could have been shot. Thankfully I got rid of the rifle as soon as I confirmed there was no threat.

Would I also not want to give my description & instead only describe the intruder who surrendered & I was detaining?

I run a security company. I make my guards carry a checklist in their wallets. I understand a self defense case will be stressful, but the best mitigation of the risk, is to have a well-thought out plan and sticking to it. Also doesn't hurt to have important phone numbers on the back of the checklist (like your attorney's POC). Just my 2 cents.

As a former Professional Firefighter from the City of Austin, I have seen and took training at the 911 center there. When the dispatcher answers the phone, they ask a simple question or two. Then, while it might sound like they are delaying, they actually reach over and press 1, 2, or 3 buttons telling Police, Fire, EMS to pick up on the line. While you think you are talking to one dispatcher, you may well be talking to 4 dispatchers and a supervisor. For example, if you say that there is a fire in the house, the dispatcher might be asking questions about "can you get out?" "is there someone else in the house?" "Don't stop for pets or purses".... While at the same moment, the police dispatcher (Silently listening) is dispatching the closest LEO for traffic control. The EMS Dispatcher is activating a Medic Unit (maybe two) and supervisor...and the Fire dispatcher has just alerted 50 fire stations (standing by), 3 fire engines, 1 ladder truck, 1 rescue truck, and 1 Battalion Chief (20 firefighters total) - if they see fire, 3 more fire engines, another ladder truck, and the shift commander. Alarms are going off all over town. So, telling that one dispatcher to "Hurry" is not necessary. In the case of a shooting (Self defense), the dispatcher will alert all three. -->All LEO's available in the area and a supervisor, EMS is sending a Medic Unit and putting another on standby with the medical director. Fire is sending the closes Apparatus that has EMT/First Responders. All while the one dispatcher is talking to you (But they are ALL LISTENING).

As a USCCA member, the first thing that I would do after a self defense shooting is dial 911. I would tell the dispatcher "I am [your name here] and I am at [location]. I am a victim in a self defense shooting and I had to defend myself because I feared for my life. Please send the police and paramedics right away. I will give any other pertinent information to the first responding officer that arrives." Make sure that they are on the way then hang up. It's very important that you tell him/her that you are the victim because the assailant may have also called 911 and told them that you was the aggressor. Clear your firearm, set it on the ground/floor at your feet and never leave it. The next thing to do, if you are a member, is immediately call the USCCA Critical Response hotline and tell whomever answers the phone that you have been involved in a self defense shooting and answer any questions that they may have. The USCCA is your friend and will provide legal counsel in said shooting, especially if you are charged with a crime (more info on that below). NEVER give the police a statement without the the presence of legal counsel. Anything that you say can and will be used against you in a court of law. The Fifth Amendment is your friend. Use it. Tell him/her "I will cooperate 100% but I will need to speak with my attorney first before giving a statement." Give them a description of the assailant and where s/he ran away to if necessary Show the police your CCL and ID if requested and comply with any instructions that they may have. You may also be requested to hand them your firearm as evidence. The best thing that you could do is to inform the police that you will exercise your right to remain silent and you will give a statement after you have talked to your legal counsel. Remember, if the attacker breaks off the attack and runs away, DO NOT CONTINUE TO SHOOT. At that point you are no longer under attack and the threat of death or bodily harm is no longer present. If you continue to shoot and hit the attacker and kill him/her, there is a very good chance that you will be charged with a murder charge of some sort. Concealed carrying is a VERY big responsibility and you must always train, train, train and then train again. You may feel like there's nothing left to know/learn but there always is something that was overlooked by an instructor that another one will educate you on. Always be alert, be safe, thank you for reading all of this and God bless.

You may want to read the small print with USCCA. If you find yourself in court and you lose USCCA will come after you for all monies spent on your case. Also if you plead down to a lesser they will also come after you for all all monies spent.

I'm a dispatcher, location should be 1. The cops can figure out who you are when they get there if need be. If we can only get one bit of information, make it the location. Your right to remain silent is your biggest strength. Don't talk yourself into jail. It's the cops job to get you to incriminate yourself.

Some attorneys say don't invoke the 5th, right to remain silent, due to something Scalia wrote saying that that could somehow be used against you. They say to instead just invoke the 6th, right to have an attorney present during questioning, and then they have to stop asking you questions. Would make for a good Armed Attorney video here, if they haven't already done one. (I'm new here.)

I just attended my requalification for my CCW in Cali. My instructor told say nothing other than someone is down and needs medical, your name, what you are wearing, the location, and don't leave the scene. The when they arrive you state I need to talk to my legal council first then I am willing to help an any way I can. I'm a shaken up right now.

This also allows for your brain and body to clam down. However do not under any circumstance start telling the story to the medical staff about what you did. I had my phone locked on a 911 call a few months back. My dad was having a heart attack, I gave them all the information and then I needed to call my mom to find out where my dad's nitro pills were. I was pissed and I was screaming at them to let me make a call...they got an earful..and I totally understand why they do it but I was in dire straits

I've had that happen once with a mere 'fender bender' car accident. I rebooted the phone and made my call. Took longer, but I was able to break their lock. I expect this is something that they have resolved in 'newer' phones. It was around 2008 - Charlotte, NC.

I'm a LA/TX Private Investigator - your KZbin page should be required watching when carrying open or concealed in Texas. I've done a lot of work in the Houston and Beaumont areas including insurance fraud, process service, and domestic terrorism surveillance - I keep my EDC weapon in a steering column holster when inside the vehicle and have been asked several times about it by officers without ever having any problems because I was honest and respectful (and fully credentialed, ie: driver's license, insurance card, window tint waiver, registration, weapon ownership receipts, and carry license, etc.).

@@TheJimJonesKC5DOVChannel I also carry a safe inside my truck for times when I'm unable to carry onto a forbidden property. There are lots of arguments for not using or using vehicle holsters and most of them revolve around the fact that the firearm becomes a permanent part of the vehicle. The only con I can think of if you never leave the gun in the vehicle is control over the it should an attacker jump in the car. They'll know where it is because it's in plain sight whereas a concealed weapon on your person would be a suprise.

I like all your suggestions for information but as far as number 4, I was instructed by an attorney and the police officer who instructed my second cpl class to simply say “there has been a shooting”. There reasoning was you don’t want to sound like your arguing your case or trying to justify the actions taken over the phone.

It's been a little while, but just a point about the order of the call. The most important piece of information, and the 1st thing the dispatcher should be asking for, is "where is your emergency?" If they don't know where, they can't get anybody heading that way while other information is collected, or if the call is prematurely disconnected, etc. Where to send help, what happened (they will determine what to send based on what type of incident you report) and then contact information, follow up information (dangers/aggressors present, any/how many injured, etc.).

This was a great video with great advice, I even took notes. Having something like this and also as another comment said having a checklist is critical. Having been involved in a shooting the adrenalin is going to be pumping and most people can barely think straight let alone have meaningful conversation after this type of encounter. Having a list to fall back to like this helps you to take some control back especially the part about hanging up after you've said what needs to be said to 911. I know those calls are recorded but I wouldn't have thought to end that call. Good stuff!

Situational awareness in your first and best defense, it helps avoid a situation before it begins. Don’t drink and drive , don’t carry if you even think about a drink. It‘s a really bad idea.

Great info. Adding a description along with your name is what I have seen in the classes I have attended. That way thr first responders know who to look for. This is something that needs to be continually driven home as if it happens a person lots gets forgot or missed in the heat of the moment. Having it on a card in your wallet is not a bad idea. You both do a great job in breaking info down so an average person can understand. I especially like that you both do always agree as not all situations are the same. It is never easy.

I had an instructor who told us to call 911, say shots have been fired, subject has been hit, ask for police and an ambulance to location then hang up. Do not answer any questions from dispatch. Just make sure they have location and police and ambulance requested.

Texas law shield tells us to request 2 ambulances to the scene, one for the person who’s been shot and one for the person who shot in defense. Being attacked is a traumatizing experience. They argue that requesting the second ambulance for that helps your case.

If any jurisdictions are locking phones, preventing someone from calling the police, step one for all instances should be to call your attorney and then 911. I agree with Richard’s advice to raise the defense of self defense on the 911 call. At least in Texas, if the police introduce the recording as a “confession” they must introduce the entire “confession”. As a statement against interest, the defense may have to introduce it, but either way it provides the option of keeping the client off the stand while raising the defense. I would suggest a “Part 2” discussion of what to say/do when the police arrive.

I am a new subscriber to your channel and love it. I'm so happy that you give legal and common sense advice and I have just started working my way through your videos. I do have a question about this topic. I am a physician trained in Internal Medicine, Pediatrics, and ER Medicine and I also have a CPL and consistently carry. I would never hesitate to save innocent life from a threat. That being said, after I call 911 am I obligated to render care to my assailant? My initial response without even thinking (being a person, and in a profession, that wants to save lives) would be to administer care prior to EMS arriving. I just wouldn't want to be potentially engaged in the act of CPR, etc. and have the arriving officer think I'm the "bad guy" and act accordingly. I didn't know if a jury would say "he's a doctor, trained to save lives and he didn't do anything so he wanted that guy to die", when that would never be the case. Thank you.

In the state of Illinois, if you used a firearm to defend yourself, even a your home location, YOU WIIL BE ARRESTED FOR MURDER! The Illinois State Attorney will charge you with murder, as he says that ONLY THE POLICE MAY USE DEADLY FORCE. About four years ago, a Galva, Illinois farmer defended himself from an angry drunk that attacked the farmer after the drunk lost control of his pick-up truck and drove into a ditch. The farmer told the drunk he will call 911, the drunk punched the farmer in his face, the farmer shot the ground as a warning. The drunk continued the attack and the farmer attempted to wound the angry drunk in the leg, but nicked the femoral artery and the Angry Drunk became dead, face down in the ditch! The Farmer was arrested for MURDER, but put his ENTIRE FARM PROPERTY as bond/bail. The trial was held about 18 months later. The State Attorney offered a plea of manslaughter and was rejected by the farmer. The State Attorney was given advise NOT TO PROSECUTE the case! But the ego-tripping State Attorney arrogantly continued to trial, AND LOST! The jury acquitted the farmer from ALL CHARGES! The State Attorney told the press "I'm very disappointed with the jury's decision" and later quit his position for the State. Many, many times Illinois citizens are charged with murder after a defensive situation using a firearm. The State of Illinois unofficial policy is to arrest ANYONE using a firearm that results in death, regardless of the claim on self defense. The States Attorney's Office say it is up to the defendant to prove the to the jury the shooting was justified. Illinois will hope THAT YOU WILL LOSE!

On mine, I called, said I was attacked, i am wounded, the assailant is wounded and immobilized. The scene is safe all weapons are now unloaded. He was dead, i never even went into station for more interviews. I kept my mouth shut. Then hung up because i needed to hold my arm that had a deep cut. I probably would of stayed on the phone if not for that. First on scene was emt she advised me to not elaborate and state facts then shut up.

The reason that I say nothing to 911 apart from my name, the location, and that an ambulance is needed after being involved in a lethal force self defense situation is my memory may not be fully reliable and I might end up saying something incorrect.

Great video! Some further interesting questions arise... OK, you've completed the 911 cal and the police (and EMS) are 'on their way'... Now... What do you do with the weapon you used to defend yourself?... I'm assuming your safety as officers enter takes priority but I'm also sure that optimizing one's legal position would come into play too. What statements do you make to the officers re where the weapon is? Are you required to turn over the weapon? Do the police have a right to search your home for more weapons under any "probable cause" or would they need a warrant?...If the police ask to search, my understanding is it's always best to say 'no' and force them to establish probable cause in court (if things end up there) but, on the other hand, in court, the prosecution could say, "LOOK, the defendant didn't even want us searching his house to figure out what happened..."

I think all of this goes back to the KISS saying. Keep it simple stupid. And like you said no matter what you say the prosecution will have months to figure how to twist your 60 second call at the most stressful moment in your life. We were always taught to give location name phone number and only that I was involved in a self defense incident and I need police and EMS and say nothing else

Something I have done for years is to hold the phone upside down along with turning the sound all the way down and not lessening to the other person talk. This way you are much less likely to answer any of the questions they ask and remain in control the full time and I think this would be a big help with 911 dispatchers. If you do this, you will find that as it dawns on the other person that you can't hear them, they will start listening and stop talking automatically. Having a cheat sheet handy will also keep you from making any mistakes. Just like defending your family, yourself and your castle, having a plan will always increase your chances of winning.

My 911 call will be "I'm calling to report shots fired at [address]. One person injured. Scene is secure. *click*" I'll let the dispatcher, who does this for a living, decide what services are needed. Also, I will give the police my ID when they arrive.

Great information and very informative! Love the channel. Both of you have to be the nicest attorneys I've ever heard of! I'm from the state of Oregon which has turned very liberal to the left and the governor has passed many new gun laws without the vote of the people. Oregon is an open carry state and I found it's relatively easy to get a CHL/concealed handgun license if you can pass a background check. Oregon used to be conservative, but my state has been taken over by Californians and Washington staters. What happens in those 2 states eventually spill into Oregon. Oregon's 2A rights are constantly being attacked. My question is what kind of personal attorney should I have on speed dial? Is a USCCA membership sufficient? I know that USCCA is not recognized in Washington State. God bless Texas! I'd move there in a heartbeat but it's too hot for this native Oregonian lol

I appreciate Emily's instruction to state you were attacked, then relate that you had to use deadly force to end the threat. This very much mirrored my LTC class instruction. Don't just say, "I shot someone," relate that you were attacked, and forced to use deadly force. BTW, if you're carrying, you need to join USCCA or Texas Law Shield. Keep that card in your wallet next to your LTC, so you never misplace it.

Those are great ccw insurance companies. I’d recommend using CCW Safe, as they don’t have limits on their coverage. Love USCCA too!

Firearms Legal Protection covers me. There is a real difference between insurance coverage and other options when you need legal protection after an encounter. Everyone should research their options (and read reviews) before they blindly buy into any of them. But, everyone should have *some kind* of coverage though. Saving lives shouldn't cost you everything else.

EVERYONE should have a printed prepared "check-list" ALWAYS at hand, (with their lawyers contact details & instructions, at the very top) when dealing with the police, like pilots do before take off. This list should be checked by your lawyer beforehand. Great video. Many Thanks.

The cop, a 20+ year veteran, who taught my concealed carry firearms proficiency class said the basic and simplest 911 call should be your location, name and just "I need police and an ambulance. Someone has been shot." then hang up.

I've been a 911 dispatcher for an agency in central Texas for 18 years. I don't know about all the recording systems in use throughout America, but if you call and I answer the recording starts before you hear the "ring" and it will keep recording until I disconnect. You may think you have ended the call but it doesn't end until I disconnect or until your phone has no power to operate. And it can go either way-you may say something that will totally clear you and you may say something that puts you in the worst bed and breakfast in Texas!

On a 911 call, why say "shooting," "shot," "gunshot," or the like at all? Everything "gun" just escalates the matter several levels. Rather, "A man I don't know attacked me, and he's injured, send police and EMS. He's wearing a gray hoodie."
