I have been in a deadly force encounter. I can attest that even though I knew what to do to defend my home, after the gun smoke cleared, I was more afraid of the consequences of my decision. The adrenaline dump sucks. Not only during the incident, and the investigation shortly after, but the thoughts and dreams long after. There is nothing glorious about winning a gun fight! Alpha male comes out, but it really eats at a man long after the official ruling. Planning/training for a deadly force scenario should also include training for de escalation techniques. If it is possible to avoid drawing a lethal weapon to stop a threat, employ that tactic. That said, if you get cornered, remember that it is your life or theirs. It is a real possibility, and it sucks to make a split second decision that could possibly end another person's life. Even coming out on top feels like a loss when the magnitude of force requires terminating the life of another person. Think before you brandish that firearm, and think a bit more before deciding to pull the trigger. Set ego aside. NEVER use deadly force in a battle of the ego. Always walk away. Sorry for the novel. Most of these examples SHOULD NOT be uttered to the police. If you are in a self defense incident, ask for a lawyer and don't say ANYTHING to the police.

To say not to say a word to the cops is probably not wise, as they will need at least some context for what went down. More like "This dude forced his way in the house and I shot him in self defense. I'd like to talk to an attorney before I say anything further." Simple and concise. Some may take 'don't speak to the cops' as just refusing to say a single word whatsoever and the cops now might assume anything, including that the guy didn't break in and you just murdered him for no reason.

If possible absolutely, for example in a break-in, turn on ALL the lights (disorients the dirtbags) tell them you are armed and have called the police. 99 times out of 100 they will flee-at that point just be an excellent witness, oh and your weapon did its job-protecting you and your family. Do NOT under any circumstances do the "prepper" thing of vest and NODs, etc. If it goes to trial the DA's office will have a field day showing you were "hoping this would happen".

I had a neighbor who was problematic and I spoke to cops many times about him over the years. EVERY time I made sure to say I was concerned about him and worried he would do something bad. I NEVER said I wasn't worried. Fortunately nothing ever did happen, but I have a feeling that if even one time I said I wasn't worried it would have caused me problems. Also I never lied. I was worried about him. Glad he moved.

Unfortunately IF there is NO physical evidence nor independent witnesses then it involves into a he said / she said and then that depends on who the officer believes . Especially in domestic violence cases the officer will make an arrest merely because they are afraid if they don't they will be complained on for not believing the woman or if the man returns at a later date and violence occurs they will be blamed for not doing anything , such as the case in Utah where the female was the aggressor but they wanted the cops to arrest the man , which they did not . Unfortunately the man later killed the woman . So that is why the first person to call usually is seen as the victim and the cops will make an arrest and say let the courts decide or make an arrest and let the DA decide all to cover their butts in this litigious society .

My cousin shot an invader and ending up having to pay thousands to a lawyer to protect himself from the police who were working to charge him for shooting the invader. The invader lived and lied to the police about having been invited into my cousin's home where he was shot. The invader was black and my cousin is white and didn't know the invader. BUT the police went after my cousin for shooting the guy. My cousin said if something like that happens in the future, the invader will not be able to lie to the police.

I just sat on a Voluntary Manslaughter jury where an off duty police officer was charged. Every avenue of attack from the prosecutor came directly from the post shooting interview with the investigating detective. He was not officially charged and arrested until 3 months later. If he had exercised his rights, he would have made his attorney’s job defending him a whole lot easier. My jury deadlocked and in his second trial, he was found not guilty.

Good point but you can be honest & be in fear for my life. Atty Mark Omera of Orlando FL advises saying you used Stand Your Ground. This shows you did NOT fire in a panic or a rage. If the PD or sheriff's deputies are honest, fair they will support your actions, claims.

I was part of a murder case years ago where the shooter told us "I was not afraid of that SOB". That SOB, his own son, was wanting to kill him. Dad shot him (but wasn't afraid). Dad is now in prison for murder, no fear, no self defense.

I'm not a felon, but I have a couple of misdemeanors. They denied me, and for the FBI to even look at my case I have to send them fingerprints (which are on record since I've been to jail) but they want them and my arrest record proving my case. What a load of shit, I don't know what to do.

I would believe a Duress Defense would be better than I was in fear of my life. Because after my close with nearly having to act in self Defense. The cops that showed after I called 911 said that they could not even use that they are in fear of their life. Although then they started talking about all the items on their batman belt. Which I only have a pistol that I carry with me in Oklahoma.

@@MK-ft3qt having respect for a situation and dealing with it is not the same as being afraid of it. I have a fear of spiders and kill them without provocation. Is that fear rational? No. Did the spider take any action other than being in my sight? No. Different people have different tolerances for fear. Therefore in situations as these, fear cannot be the determining factor for innocence. Fear for your life is a feeling, knowing your life is in jeopardy is an assessment. I’m not sure if I could live with myself knowing I made a potentially irrational decision out of fear that ended someone’s life. Far better position to know that I understood the situation and acted out of courage to defend myself.

In Bradford County it depends on your race and skin color. Then they place cops in training in the same cell to befriend you to see if your telling the truth or not. Best just not talking about it to cell mate,anyone,over all recorded phone calls( none are private even speaking to your Lawyers/Attorneys) or letters and visits..

In the Texas case example would it have been appropriate to yell at the burglars informing them that you called the police and they're on their way? You don't have to remove yourself from cover and it may scare the burglars off.

So here in wv we have legislation in line with "stand your ground " law albeit not actually named that The jist is , you do not have to wait to be harmed to defend yourself , you are not required to retreat. You only need a legal reason for being there So if someone enters your property and has a weapon , threatens you with it and advances towards you , you have a legal right to preemptively dispatch the threat with reasonable force Years ago they had to have a portion of their body in your home , a foot , a arm in the window , you could relieve them of said appendage leaving them to scary off the property Obviously the measure taken had to be in line with the threat , simple trespass would not justify a shooting , trespass with a weapon and threats yes

Enjoy the video, keep it up. Very Analytical, these recommendations would be normal behavior for “Vulcans”. Problem is most of us here are humans and our emotions can/do get the best of us if we let them. Leaving Cover/Concealment could be perceived as switching from defense to offense. Lot’s of stupid drivers, practice defensive driving, don’t chase, let things slide. Way I see it, being in Fear f my life doesn’t say I’m controlled by my fear. If someone takes active action, then their actions trigger my fear and my fear triggers various defense responses in proportion to the threat. Calling 911 after the fact, especially when you resolved the problem may be a pain, that said, it sets up a foundation just in case. It also may help the police in other unsolved cases.

I am 75 yrs old, I am an Army Veteran of 1966/1969 and I have had a carry permit for over 50yrs. there have been many times in my life when I was treated like cow manure and called multiple dirty words by people that had nothing better to do with their lives, but I got myself educated on weapons laws and the use of deadly force and have all the knowledge that I need to NOT ever Brandish my weapon or feel lesser of a man because I took the verbal abuse and walked away because I don't have to prove myself as a man to nobody, I did that when I joined the military during the Vietnam war. my weapon is with me to preserve life, not to make me into Doc Holiday or Wyatt Earp. it is only with me to keep me or a third party safe from deadly force or imminent danger of grave bodily harm. an Idiot that thinks he is a big shot because he thinks he has had the best of you doesn't know that when you had the courage to walk away, you just blessed him with another day of living because of your self-control and not forgetting that your weapon is only to stay alive in fear of death. not for petty situations of life which could get you put in jail as a criminal. so, please be safe and educate yourselves! if you don't have self-control! then maybe a weapon is not right for you.

I heard a Navy SEAL say the same thing. He said if anyone wanted to fight him and squared off he would literally run away. This is man who has nothing to prove. Its a bit harder for young men though.

What if there's a situation where there's a conflict, and you don't know if the other person left or went to get a weapon. Are you safe to follow until you determine that the threat is gone? That fear of not knowing if you're safe is real too.

The HORN case especially proves the point. He was SUPER DUMB for leaving his cover and protection of his own home. He went looking for the trouble and found it!!!!! No, none of us want our stuff stolen. However, that’s nowhere near as bad as getting into a shooting on another’s property when he could have simply sat there nice and safely. He made a very bad decision. Very bad!!

Yep. you also risk being shot by the cops! How do the responding officers know who the good and bad guys are all they will see is the gun in your hand. Plus only the police have qualified immunity.

I could not disagree more. Trouble came to a property he was tasked to look out for. Your mentality is exactly the problem. If someone is engaged in breaking and entering and burglary and you confront them you do not lose your right to self defense! The burglars are in the wrong and they don't have the right to attack you with impunity. Everything you said is complete nonsense.

Good advice, a road rage incident where someone nearly collided with me, after Honking the horn, he turned to follow but I was able to do some evasive driving as I knew the short cuts and the idiot drove right past w/o seeing me. That's the smart thing to do if all possible

This is some of the best advice I have heard on line. I am retired law enforcement and it amazes me how many people can't accept, "Being afraid" is exactly what you must be to use your gun. I have been there in an official capacity and I had the benefit of legal counsel immedately, so I said things perfectly. But on your own, paying for every mistake with your money and freedom, you need to know these things. Honestly for police it's usually anger and fear all mixed into one. You are scared to death, but also angry as hell for them putting into this position. I believe anger is a reaction to fear, so it's not really a separate emotion, but you want to ensure that you convey that the reason you used that deadly force was out of fear, not out of anger. Juries are not psychologists, so they won't likely understand when you use the wrong term out of emotion. Also police have a justifiable reason to be there, most citizens do not. So keep that in mind when you react. You have every right to be in your driveway at 3am chasing away a car thief, but the jury can convict you and send you to prison as well. A reason why dogs are such a good addition to any home. A dog bite lawsuit is covered by your homeowners insurance, your shooting is probably not. Most likely a criminal would run when he sees the dog, which is better for you. Let the police find this fool. Your personal risk is just to great!
