yeah you'd think, but nevertheless they'll keep fighting the battles. German national rail fought a huge long case about it cause changing their computer system was simply too hard or so they argued. They lost that case and then still tried to delay implementation further.

Yes. But it's still not at all a technical issue anyway. The UK already accepts passports and papers from many countries that have a third gender as an option on their ID. You can take a long business trip to London as an openly enby, and never be bothered for it. But staying there is where they draw the line apparently.

There was actually a very similar case in Spain, and the TSJA (Andalucía’s regional supreme court) ruled a few weeks ago that people whose gender is legally recognized as nonbinary in their home countries have the right to be recognised as such in immigration documents. However, Spanish citizens still can not change their national identity documents to a gender outside the binary.

I worked for the UK Civil Service about 10 years ago and some of the in-house programs we used seemed to genuinely be from the 1980's. They HATE updating their craptastic tech. That said, I don't believe them when they claim that it's all the computer's fault they can't recognise Ryan's gender identity- we had to use all kinds of workarounds to compensate for the general shitness of the systems we used. If there was a real willingness to help, I'm pretty sure they could find some way of cludging something acceptable.

As to the issue of the government running out the clock on things, I know a lot about that. A very good friend of mine was hit by a cop in NY and in spite of severe injuries, he wouldn't even take her seriously until she found her bag in the back seat (while pinned) and got her card to prove she was a lawyer. Once she did, he just got back in the car and took off. It took her well over 10 hears to even get a reasonable settlement offer from the city with buckets full of evidence.

This is the one reason I caution people against putting something other than M or F on a US passport. The warning I give is “If you ever intended to travel internationally, make sure you research the countries you ever plan on going to and make sure the X won’t cause issues with immigration.”

The more I think about this issue, as perhaps the great (new-ish, yet ancient) civil rights issue of this era/generation, the more I am concerned, frustrated, outraged. It was easy for me to check a box, decades ago, being cis, but, now, given how utterly outrageous that such historically recent yet persavise and dangerous relics (such as the very concept of dichotomatic homo/heterosexuality of the Victorian/post-enlightenment era) are poisoning the (so-called) modern, free world... I'm tempted to try to change... something. Or DO more... (I DO write to my reps, VOTE, donate what little I can) I'm just more and more aware of how bad it has been and how it may be getting worse in many places that ought to be leading the way into a more free future. What to do, though? I believe that encouraging others to do what little they are able or willing to do is a good start. Yet... Excuse my rambling, but, the seemingly clear lines delineating issues of sexuality and gender that were common in my youth seem more and more obviously uninformed, oversimplified, ignorant, bigoted, harmful, atavistic, and... wrong, these days. But then again, 'I was so much older then, I'm younger than that now...'.

I really appreciate you doing this video. I'm non-binary myself, and even though I live my life largely as a man, government forms always make me feel othered. There's no way in hell the particular dystopia we're working so hard on in the US is going to do anything about it, but maybe the UK will have a chance of doing a little belated good. It's always helpful when people in other spheres of influence share important stories that many people might never hear otherwise. It helps us all grow as human beings.

Sadly the 2021 UK Supreme Court ruling against Christie Elan-Cane has set a precedent that is going to be tough to correct, (especially with the current government and), despite the fact that the UK computer systems HAVE to have provision for a third gender due to at least seven countries already have a third gender on their passports and the UK accepts those passports!

Australian here who recently went through the gender change process to be recognised as non-binary, including a process to reissue my passport with the "sex" marker being noted as "X" which is allowed for non-binary people in Australia. While I'm not intending to be a UK resident, I certainly am planning to visit one day... but if even a UK resident has trouble being recognised as a non-binary person , I fear I could have the same amount of issues when it comes to identification. The Australian government does note that some countries may throw hands at a person who tries to immigrate through with an X to their gender, but I certainly wouldn't have expected the UK to be one of those countries... or perhaps I did, considering the nature of their current government. I do hope Ryan is able to push through with getting recognised within UK systems, and that as a travelling enby myself who knwos they'll face discrimination along the track of my travels, other non-binary people across the world can get the recognition they deserve as well.

Labor could not be more diametrically opposed to the Libs / LNP in terms of their accomplishments, priorities, funding sources, and more. That doesn't mean they're perfect, far from it, we can all name a dozen areas in which Labor is wholly deficient. But the difference between Labor and the Libs / LNP is that we can push Labor to move further left, while absolutely nothing can push the Libs / LNP further left. I don't say any of this to diminish the very real and important issues you're talking about, or to minimise your personal experience. I don't exactly love Labor, I don't think I've given them my primary vote even once in my entire life. I'm just very conscious of the fact that this sort of defeatist "both sides are the same" talk is exactly what drove America to the utterly insane position it's in right now, and neither of us want that for Australia.

I read about their case, it's awful. UK citizen here, our immigration system is notoriously bad under governments of every stripe but under this administration it's as bad as it can be. This lot is desperately fighting the culture wars to shore up their support and immigration of every kind is an easy target, unless you're cis het white and English speaking they'll erect as many barriers as they can. Fortunately our Conservatives don't dare roll back what gender recognition we have but they sure as heck won't improve matters unless forced.

Thank you for talking about this Deviant. As a British trans woman, I've often joked to friends that the easiest thing we get over here is changing our names, and it is... technically. A lot of companies and government bodies make it obnoxious to actually register that name change with them, especially for neurodivergent people such as myself. I'd always known the UK's immigration stuff was terrible from a Canadian friend who tried to live here, but hearing about all this mess that Ryan's brought to light is just saddening. There's also a load of dumb little things I've found out on my journey, like how apparently the number on a UK drivers licence has gender encoded into it. It doesn't show up anywhere else on it, but it's still noted there, and I'd bet money (if I had any) that the government will argue that they can't support NB individuals legally because of that (maybe not for Ryan's case specifically, but as a knock-on effect or in a later case). The public sector (the civil service) is honestly a mess; I've worked for a part of it in the past, and I dated someone who worked for other parts, so I'm not surprised that they're pulling the "waaaah it's too difficult" argument; The sheer amount of layers of bureaucracy that exist simply for the sake of bureaucracy is staggering and sad. Still, I hope the courts will drill some sense into the government, as you mentioned the US courts did with Kara's case.

Let me preface this with the fact that I'm all for the UK recognizing non-binary people. With that said, I *do* think it's an edge case. 1 million in the US *is* a small number. It's less than 0.3% of the population. Mx Castellucci says there are tens of thousands of non-binary people in the UK, which sounds like a lot, but even assuming the number is as large as 100k, that's less than 0.15% of the population. It doesn't mean we shouldn't care, however.

Thank you SO much for sharing this. Ryan is doing SUCH a good thing, but it's recieved next to no media support or coverage. I've donated to their fundraiser, not only because it's important for all, but also I have a vested interest as a trans-non-binary individual. It's a death by a thousand cuts on a daily basis dealing with anything vaguely official. I can have MX as my title on driving licence/passport/bank details etc. But my gender still has to be one or the other. My employer can gender me correctly internally, but the payroll and employee management software only has M/F because for tax reasons you have to be one or the other. My doctors surgery can't deal with not sitting in either box - and whilst there are health reasons for declaring your assigned sex at birth, they can't reflect my non-binary gender on any systems, databases or records.

The UK Immigration system a hellish! They brought in this insane points based system a few years ago while I was trying to get my American partner moved over. They are a vetenary nurse at a time when the government was desperate for vetenary workers and still they couldn't get anywhere near the points needed to live or work there. Having lived in both the UK and now the US for 4 years I can say that while the US is more vocally falling to fascism, they arnt as far as the quiet burocratic fascism in the UK. It sounds weird but I feel safer in a safe state over in the US than I did in the UK.

As another non-binary immigrant to the UK (though technically a citizen from birth), I've been dreading this exact issue. When I got my UK passport I went with what was on birth nation's passport because that was what was legally required. I need to change my name and I'm going to change my birth certificate's sex marker as well, which my birth country allows, but I have no clue how the UK is going to handle it. My passports are supposed to match but legally they can't, so I've got no fucking clue what's going to happen. (Also small note, you used England and the UK interchangeable a few times during the video. I'd avoid doing this because folks from the other countries in the UK very much do not like it when people do so.)

This might not get very far but it might be worth making a swift addendum to your vid, @DeviantOllam, for those of us (your community) that are UK resident or citizen to pepper the shit out of their local MP to raise the issue in parliament. I've asked the question of trans and non binary recognition a number of times with my local one and so far they haven't come up with an answer but if enough people raise the same question across the UK we might just force the issue.

Demiwoman, non-binary but pronouns are she/they. I can get at with ticking that box for woman without outright lying, but yes, the UK needs change. Legit question: Is there really a compelling reason for official documents like birth certificates and IDs to even have a spot for gender or sex? I cannot think of any for either field. It’s really not the government’s business what gender you identify with/as or what genitalia you have. It just opens up room for governments (like the UK’s) to discriminate against people. For medical care your doctor can just ask when it’s relevant (Eg an eye doctor probably doesn’t really have cause to ask).

I'm not going to blather on about my thoughts on this ( _edit: correction; I am_ ) topic, but I am going to throw out this possible solution to situations like this: Unless someone needs to know how you identify in order to "do their job" properly (interpret that as you will) - medical professionals being the first thing to come to mind - why the Hell do we even _have_ that ubiquitous "M/F" checkbox anymore? It's not like if you get pulled over by the cops they are going to skip right past your name, photo, hair and eye color, do the math to figure out how old you are, then check if your height and weight seem "close enough," but instead go straight to whether or not it says if you are male or female or an attack helicopter. Or how about applying for a job? If that check box *is* there, except in some relatively rare cases, all that box does is open the company up to litigation... so again, what's the point? Point being, there are definitely situations in which listing your _biological_ sex matters - and could be literally deadly if you put down something different (again, the medical field comes directly to mind) - but all the other cases? Man, I've hit the age where I'm starting to grow man-boobs (I'm super lazy when it comes to working out, so my bad), but I can't think of a single situation where someone will be scratching their chin and wondering "are those real?" for any purpose other than weird curiosity. Sigh.

If the british police system has variables specifically for identifying trans people in a hyper specific and degrading way, I don't think it'd be too difficult to add a little extra one on there though no doubt they'd want to add two which clarified gender assigned at birth

Regardless of what side on this social issue you take remember if in a “5 eyes” country WE are the weird ones…NOT the rest of the world, so don’t expect the world to change just for you. Last year I left Pride month in the states to go to a Muslim country for work…man, not seeing rainbow flags and seeing everyone’s freak flag fly sure was depressing…the almost 50°C weather made it that much worse…send some tank tops to the Maghreb region stat! lol

If everyone that claims they care about freedom, was like you, the world would be a better and more free place. Instead it seems like the majority of people screaming the loudest demanding freedom seem to only want it for themselves, and are actively trying to crush the freedoms of anyone "different" than themselves. I live in a country that has person identification code that's first number is indicating legal male/female sex and century they were born - right now if you change your gender you will get a new personal identification code... There have been some ideas how to implement the 3rd option but i do not see a simple solution that would not break the whole person identification number system AND give clear indication about their gender... and in the end in the medical system... So in some areas it is not as simple as just throwing more flexible field to sex/gender column in the database... i personally work in DBs where we have the legal sex and sex based on DNA(yes dna - not medical appearance) - we do not have the persons self reported gender(no such ethics approval)

For most, gender has become merely outward physical and social characteristics rather than sex (physiology naturally ordered towards gestation or insemination). If gender is merely outward characteristics and a social utility then so be it. However, trying to equate this to sex is a slippery slope and that's where all of this friction comes from in the conversation. The question then becomes whether if this equating of the two devalues the sexual power to procreate as an integral part of the identity thereby breeding other social ills or if its just whatever and people can choose to care or not to care about the label.
