Let's do the reverse, this same court will change law. Mother file a case upon sson for Maintainence and son gave all to wife. Which court have guts to attach that property. Pen will start shaking, that is our mind set. It is high time to interpret phrase - unless unable to earn and all this matrimonial litigation will reduce, because saari ladai paiso ki hai. If we start giving limited time Maintainence, that will again be good step because is sitting idle, practically, no benefit to society except causing litigation

the most important value of a trust is that the property cannot be attached readily. if the trust is not made, basically the whole house, jewellery, everything goes. so yes, you still pay, but then you do it without seeing your most important assets being taken away permanently. plenty of cases where the flat/house largely purchased by the boy's parents end up completely in the hands of the woman. it sets up the boy's family to negotiate better and harder. as for going to jail... any man brave enough to spend a couple of months there, will be the biggest winner in this bargain, because the courts will literally beg you to pay something and will bring the alimony down substantially to ensure that the woman gets paid at least something. so, trusts are a big YES in my view.

If the rules like that , some one will wrongly allocating like that what will do , will go to sanyasa(brahmachariyam) then court what will do, worked this many years for wife and childrens now they are not my side so why i have to earn . That is it, if court put jail also no problem

is there no legal way to avoid givinf alimony if the man's wife has a regular income above a certain bracket? a certain income bracket should be fixed such that if the woman (or even man in some cases) earns equal to or more than that per annum, the man (almost all cases) should not have to pay alimony

Even if the property is gifted under good and no benefits flows to husband still courts may ask to attach such properties? I doubt this won't affect previous transfers as alimony shall be based on income as well as assets which may be directly or indirectly held by third party for benefit of the husband with clear intention of avoiding hefty sum to wife as maintenance.

This is what the game plan should be a trust on cook Islands and bank account that controls that trusts financials should be in Switzerland or Singapore and that trust should own a business in our country and you should buy whatever you want from that salary (taken from the business owner by the trust)

@@susrisangitasahoo5109 Taxation is minimal (1 -3% that too if you reduce there are that the income is generated while in that tenure, if you generate cash while you are outside the jurisdiction of that country then it's not taxable) also A trust in Dubai is not advisable as our govt can easily get report on the business but a trust on cook Islands not even US govt can touch it
