Not all discriminatory burdens of a protectionist kind (or with a protectionist effect) will breach section 92 of the Commonwealth of Australia Constitution. In this case, the High Court of Australia has demonstrated that proportionate discriminatory burdens with a protectionist effect may be justified and, as such, not infringe on the absolute freedom of trade and commerce.
