You need a shoulder bolt in this application. The shoulder should stick through both pieces of material. You then use washers to take up the slack keeping said washers to a count of four. How it's done in aviation just for the reason you show. The bolt is weaker where the threads are cut when said threads do not go into anything.

Agreed, but this is not aviation...and I'm not the manufacturer. That said, as we're not flying with these, it's probably not critical enough to worry too much about it. Just check every now and then (if they are being tightened all the time) and buy new ones before they break. Less than $2 US, in 2023.

Need to also check into the hardness of the bolt and go to the higher hardness.

Could be an option. I merely went back with what the manufacturer had used.
