The plaintiff hired the defendant to cater her daughter's birthday. However, they ran out of food during the party, so the plaintiff is suing for a refund. The defendant says the plaintiff wasn't sure how many people were going to show up. He does not believe that's his problem.

ALL HE HAD TO DO WAS DEMAND PAYMENT FOR 203 IN AN EMAIL AND RESTATE THAT SHE ONLY PAID FOR 160 GUEST. THEY WERE BOTH BEING DECEPTIVE!!!( IF HE WAS SILENT ABOUT THE COST OF THE EXTRA 43 GUEST, THEN SHE WOULD NOT CANCEL THE JOB. SHE REMAINED SILENT ABOUT THE EXTRA 43 GUEST AND PAYMENT SO SHE COULD AVOID PAYING FOR THE EXTRA GUEST. BEING SILENT ABOUT MONEY THE EXTRA $1000 GUEST COST(BY HIM), GAVE MILIAN AN EXCUSE TO RETURN $1,700 TO THE CUSTOMER????? WACKY LOGIC. HE THOUGHT BEING SILENT ABOUT THE EXTRA COST FOR THE EXTRA 43 GUEST WAS SMART, IT WAS VERY STUPID!!! IT IS ALWAYS DUMB TO REMAIN SILENT ABOUT MONEY YOUR DUE FROM A CUSTOMER (PLAYING IT COOL). HE LEARNED A $1,700 BUSINESS LESSON, DO NOT PLAY IT COOL, DO NOT PLAY IT SILENT(HE IS AN AVOIDANT PERSONALITY). You're assuming she lives in a hugely diverse Latino/Jamaican area and is aware of ALL the different ethnicities that have Quinceneras. The People's Court filmed in Los Angeles for a bit; California borders Mexico. It's not shocking that she defaulted to Mexican parties as her frame of reference.

The defendant has no shame! Claims he reverted back to the original contract, however, only provided enough for 145 people instead of the original 160? He knew he didn't provide enough food and had to stop serving, but refused to offer any refund? What a clown!

I cook occasionally for big groups, and I always make more. We invited roughly 200 to my daughter and son in law wedding. I cooked for 250 lol I was not going to run out. It was the first weekend in Nov, so nice and cool. I made my new son in law favorite meal. Homemade lasagna. Garlic bread- Homemade Mac and cheese a salad bar and mini cheese cakes and brownie bites. We did order the cake in. We had 3 1/2 pans of lasagna left over 2 of which were still uncooked in the fridge as we saw we wouldn't need so we auctioned off the one cooked pan and both uncooked ones to family. And made care packages with the left overs for the elderly that went home before the dancing. I have to say I would gladly do it again. I've been to a few events that run out of food and that's horrible. One wedding needed to order in 10 pizzas because their catering didn't make enough. The parents of the bride and groom were so upset. They ended up taking the catering to court to pay for the pizzas. The judge was upset for them and not only made the guy pay for the pizza he ended up having to refund all the the fees. I guess he was rude to the judge.

So for those who don’t understand the caterer should have wrote 203 with the additional amount of money it would cost to feed them along with a due date for the additional payment. He lost because he was too lazy to write in the complete modification of the contract.

I’m confused. Even if he had written the rest of that on the contract, the problem still remains. By his own admission, he didn’t even serve the 160 she originally paid for much less the 200. Twice he said 120 and several times he said 145. He lost because he massively underserved. Am I missing something? Thanks!

I cooked for daughters' weddings and my mother and father bought the meats for the smoker and my aunties brought the side dishes for my wedding dinner. It was a giant potluck. And glorious! We all ate constantly lol

Many times I don´t get her. And I say so because she DOES spale Spanish. Yet, there are certain times that she pronounces things in English. Or say things wrong. Not long ago she was talking to a demandant that his last name was Hernández and instead of saying it as is in Spanish she pronunced the H as in English when in Spanish has no sound.

I think he should have only had to pay back the 15 plates. The agreement was for 160 (if she didnt confirm 200 ppl by a certain time); But he said he only brought enough for 145 ppl. So I dont think mom should have gotten that much money back. I think she really didnt want to pay for people she thought werent going to show up. And I think JM was showing favoritism. This was a contracts case and she always says, there no pain and suffering for a contracts case, but she sure did seem to give to them.

As a Puerto Rican I do agree !! But we take these events very seriously and just to cause less stress and have a huge variety of different options. Also, the older generation love to cook and can be hard headed and we try to take the stress off them because even if we say no. They will still do it anyways. Trust me my grandmother even tho we tell her we have everything taken care of. She will still make a huge huge pot of arroz con gandules especially homemade and straight from the islanders it’s a lot of work.

Cooking for almost 200 is so much work. I just had a party and there were twenty people and it was a lot of stress. At 95, she should be kicking back and enjoying the fun parts of a party, not doing the hardest part.

My friend’s sister ran a catering business when i was in highschool and when she needed more staff, i was pressed into service instead of playing videogames at their house. My first task was to count the number of people at the venue. An hour later, she had me count again, and then right before dinner service, i had to count again. Later, i was told that when food gets served, extra people always show up from the parking lot or just got there to eat. She needs to know this early so she can tell the customer that you have more people than you expected, we can get you more food right now for $xxxx. You want that in writing if they refused. apparently i learned something in my first gig that this “professional” caterer hasn’t figured out yet

you have a cc on file, and if they go over the alloted amount you charge the cc for the additional amount. you put that in the contract of course, but one thing you don't do is run out of food!

Puerto Rican here... Several thoughts: 1. Spanish people? You mean people from Spain? Those are the only Spanish people that there are. Other than that are Latinos and Hispanics (that in that case it does include Spain. 2. Don´t get it. At first she said that she didn´t want the typical Latin food but later on she said that´s what it was. 3. The stupidity of being Latina and celebrate "Sweet Sixteen" and not a "Quinceañera". ....beyond all that... Yes, the guy was the one that messed it all up. But the mother said that she waited to talk to him the day prior. Really? You wait up until then to confirm?

What kind of Caterer gets a final guest count on the DAY OF the event? Doesn't the food need to be prepared BEFOREHAND? On the contract the number of guests needs to be solidified and it needs to be done by a certain date. That's the number of people the Caterer provides for. 100 people or 200, who serves only water at a party? Then, he admits he only brought food for 145 and not for the 160 he was trying to say was the number. So bad.

I have done many special events as security when i first started. The best ones are when the elders cook. The caterers never were authentic food.

I have a strong feeling that if the Defendant had brought enough food for 235 people, and only 165 showed up, she would still be suing him for all of her money back, because he supplied too much food and overcharged her.

Did she pay him for 165 or 215 people? That is a very important question. If the number of guests changed that dramatically and the price didn’t, I’d expect significant cuts to the food offered. You get what you pay for and if you want to save money this is what you get

At the end of the day both of them are wrong even if she gave him the final count the day before because if you told him 160 then added 40 more a day before you can’t expect him to have food for 200 not to mention the coast would be different and she said out her mouth she had over 230 people so there still wouldn’t be enough like I said both of them are wrong both of them sound dumb

If she sent invitations to 200 - 230 people then she should have paid for enough food for 245 people to be sure there will be plenty of food. Always buy more than enough food. That's party planning 101. If you can't afford to pay that caterer what he charges for 245 people, either find a different caterer or let your grandma make the food, who had said she wants to do it. The plaintif had said that the caterer's menu is not what she wants. Simple solution: either find a different caterer, or let the grandma cook. Plaintiff never should've hired the Defendant.

I agree and I think the refund was too big personally. Telling a caterer your numbers the day before does not allow them enough time to source the extra ingredients needed and to prep it. She was so scared about paying for too much that she messed up. On his end when he write down the 200 he should have told her the new amount and got her to pay it. Although with 35 extra guests there still wouldn't be enough food. I think they both dropped the ball. The judge was acting as though the Mum didn't help cause this mess when she clearly did. The fact she was being so scared about paying for extra food tells me that she was on a very tight budget, so why not get friends and family to help make the food. These parties are so crazy to me (I'm from the UK) it seems to be more about the parents showing off than anything else.

Defendant wouldn't be able to keep his story straight if you handed him a ruler. My guess as to why Quinceanera parties are so much fun is (keep in mind my experience with Mexicans is limited as I'm not from the USA or Mexico) from all the Mexican people I've met is that they are VERY family oriented, VERY social, enjoy sharing and overall happy. How can you not have a good time?

Everyone blaming the defendant but the plaintiff have to be blame too this is why you always stick to the original contract don't ever try to he nice and change and help and be considerate if the want to change anything let's void the first contract and do a brand new one just to cover your side of things

What part of the case states she had more than 200 guests? Maybe I missed it, so I'm not arguing whether it's true or not. However, even if he had truly reverted back to the original contract, he was supposed to provide for 160 people and admittedly only provided for 145. He deserved to lose.

So glad something like this didn't happen at my daughter's quinceanera. These parties are the equivalent of a wedding in preparation and expense. Running out of food and drinks is disastrous. This caterer really let them down.
